We seek to identify, evaluate, monitor and manage tax risks to ensure that we comply in full with our legal obligations. We are committed to compliance with tax laws and practices. When appropriate to our business, we will seek to apply tax incentives and exemptions in the manner in which they are intended. We engage with the tax authorities in a cooperative and compliant manner. While we do not have prescriptive levels of tax risk, we routinely seek professional advice where the application of tax law to a material transaction or a given situation is reasonably unclear or uncertain. GRI Disclosure Index SUB-DISCLOSURE NUMBER DISCLOSURE TITLE DISCLOSURE STATEMENT Customer Health & Safety Program Throughout 2021, Wynn Resorts continued to update its comprehensive Health & Safety Plan developed in 2020, which became the gold standard of the industry. As an industry leader in creating and implementing COVID-19 protocols, all employees received Wynn’s mandatory training on health and safety. Additional comprehensive training was provided to employees in high-touch areas such as Housekeeping, Food & Beverage, Casino Operations, Public Areas, Hotel Operations, and Security. This assured the comfort and safety of our guests and protected our workforce. 4 0 3 -1 Occupational health and safety management system In May 2021, Wynn Las Vegas updated its mask policy to comply with changing CDC Guidelines. At that time, fully vaccinated guests and employees were no longer required to wear a mask, while unvaccinated guests and employees were required to wear a mask. In July 2021, all guests and employees regardless of vaccination status were once again required to wear masks in indoor public areas, unless actively eating, drinking, or smoking. Face masks were available to employees and guests at all resort entrances at no cost to enhance the guest experience. Employees were required to follow state and CDC guidelines regarding masks and other PPE. Signage was posted throughout the property, reminding employees and guests of the proper way to wear face masks. For both guests and employees, Encore Boston Harbor enforced recommended local, state and national PPE usage guidelines and also followed Wynn Resorts’ industry-leading cleaning and sanitization protocols. By summer 2021, Encore Boston Harbor enforced mandatory face coverings for unvaccinated guests and employees, while face coverings became optional for vaccinated employees and guests. All partitions were removed and there were no longer restrictions in restaurants or gaming areas as the hotel and casino resumed 24-hour operations. By fall 2021, Encore Boston Harbor required employees to test weekly if unvaccinated; and by 2022 testing requirements were dropped and masking became optional. The Return to Shows and Events Entertainment is an essential part of the Las Vegas experience and in June 2021, fullcapacity shows resumed in the Encore Theater. This was during the May to July 2021 period when the state mask mandate was dropped for vaccinated guests. When the mask mandate was reinstated in July 2021, guests were required to wear masks while attending shows unless they were eating or drinking. We kept the theater open and guests continued to enjoy shows, while following the mask policy so we could deliver the true Las Vegas experience. continued next page. 10 2 0 2 1 E N V I R O N M E N TA L , S O C I A L , A N D G O V E R N A N C E R E P O R T GRI REPORTING INDEX Mask Requirements Throughout 2021, state mask mandates fluctuated, and the Company focused on striking a balance between the comfort and convenience of guests while maintaining a safe environment for all. As mask mandates relaxed, we ramped communications to guests and employees through signage around the property.

GRI Disclosure Index SUB-DISCLOSURE NUMBER DISCLOSURE TITLE DISCLOSURE STATEMENT Employee Vaccination Rates Wynn Las Vegas became one of the first Las Vegas Strip operators to resume 100-percent capacity at our resort. Several factors led to our high employee vaccination rates. In January 2021, a University Medical Center vaccination clinic was implemented on-site to make it as easy as possible for employees to get vaccinated. Throughout the year, Wynn Las Vegas continued to offer on-site COVID-19 vaccination and booster clinics for employees, guests, and the Las Vegas community. In April 2021, Wynn Resorts made the decision to require all staff to either get fully vaccinated or obtain weekly proof of a negative COVID test. In May 2021, 85 percent of Wynn Las Vegas employees had been vaccinated against Workplace Safety Program Wynn has established a Workplace Safety Program that manages the safety and health of all employees and guests at our North American properties. This program includes extensive mandatory employee safety training, hazard identification and control, accident reporting and corrective action, accident prevention strategies, and employee committee programs to educate on safe workplace practices. This program meets or exceeds the values and practices included in the ISO45001 standard. (The ISO45001 standard has replaced the recently withdrawn BS OHSAS 18001 standard.) Utilizing safety education and accountability, our goal is to consistently improve human safety, reduce property losses, and maintain a stellar reputation with our stakeholders. 4 0 3 -1 Occupational health and safety management system To uphold employee and guest safety, Wynn Resorts commits to: Provide a workplace free from unsafe conditions and recognized hazards. Comply with the federal and state Occupational Safety & Health Standards & Regulations, state and local ordinances, and manufacturer guidelines. Administer and enforce occupational safety & health programs. Provide proper training in the safe use of equipment and machinery, personal protective equipment, hazard recognition, and emergency procedures. Inform all Employees of the safety rules, regulations, and standards for their respective duties. In 2021, Wynn Las Vegas experienced the tragic loss of two employees. On 9 March 2021, a team of Wynn Security Officers responded to the employee parking garage to perform a welfare check on a Wynn employee who had been absent from work for two days. The employee opened fire and took the life of an armed Wynn Special Operations Guard before taking his own life. Immediately following the event, Wynn leadership notified all employees of the incident details, available mental health resources, and opportunities to support the families of the employees lost. Grief counselors provided private counseling sessions on-site to help staff impacted by the incident. Additional time off was permitted for employees to attend funeral services. Wynn Executive Leadership donated flights to employees traveling to the funeral of the fallen Special Operations Guard, and CEO Matt Maddox donated 10,000 to the guard’s family.
