tions that may disqualify an individual from obtaininga commercial permit or license are: heart condition,hearing impairment, worse than 20/40 visual acuity ineither eye, insulin controlled diabetes, epilepsy, narcolepsy, and loss of (or impairment of) a limb.North DakotaInformationThe North Dakota commercial driver license requirements in compliance with the Commercial Motor Vehicle Safety Act requires minimum testing standardsfor the licensing of commercial drivers.To continue to be medically qualified to operate acommercial motor vehicle, you must be medicallyexamined by a US licensed health care provider every 24 months, or less pending health care providerrecommendations.You must have a commercial drivers license (CDL) tooperate: A single vehicle with a gross vehicle weight ratingor gross vehicle weight of 26,001 pounds or more,whichever is greater.North Dakota state law requires that if any licensedClass A, B, or C operator suffers permanent loss ordamage of a hand, arm, foot, leg, or eye, he or shemust make a report of explanation to the Drivers License Division. A combination vehicle with a gross combinationweight rating or gross combination weight of 26,001pounds or more, whichever is greater, provided thetowed unit has a gross vehicle weight rating or grossvehicle weight of 10,001 pounds or more, whicheveris greater.MEDICAL CERTIFICATEREQUIREMENTSFederal Motor Carrier Safety regulations (49 CFR383.73) require certain Commercial Driver License(CDL) holders to mail, fax, or email a copy of theirMedical Certificate to the Drivers License agency thatissued the CDL. This must be done at least 10 daysprior to visiting a driver license site for your CDL renewal or CDL testing. A medical certificate is also required even during times you are not actively drivingcommercial motor vehicles. A bus designed to transport 16 or more passengers,including the driver. Any vehicle that transports hazardous materials requiring placarding or any quantity of a material listedas a select agent or toxin in 42 CFR part 73.A special endorsement is also required to drive any: Tank vehicle.If you are required to send a copy of your medical certificate to the Drivers License Division, failure to doso will result in downgrading your commercial drivingprivileges to noncommercial driving privileges only.Downgrading will also occur if you allow your medicalcertificate to expire. You must be at least 21 years of age to drive a commercial vehicle across state lines (interstate).MEDICAL QUALIFICATIONSHow do I know if this applies to me?All commercial drivers (including bus drivers) mustmeet the federal commercial medical requirements in49 CFR 391. This includes drivers of vehicles greaterthan 10,000 GVWR that are used in interstate commerce, vehicles greater than 10,000 GVWR used inintrastate commerce if transporting hazardous materials requiring placards or if the vehicle is designedto transport 16 or more persons, including the driver,and vehicles greater than 26,000 GVWR that are usedin intrastate commerce. Non-articulated farm vehicle drivers operating withina 150-mile radius of the farm. Farm custom operations (Custom Harvesters). Covered Farm Vehicles displaying farm plates/CFVdesignation (straight trucks and articulated vehicles).If more than 26,001 pounds, the driver may operatewithin home state, and if crossing state lines, within a150-mile radius of owner or operator’s farm or ranch.If 26,001 pounds or less, the driver may operate anywhere in the U.S.NOTE: Even though you may not actually be crossingstate lines, you are still deemed an interstatedriver if any part of your load originated or isterminating outside of North Dakota.To assist you in determining if you need to send a copyof your medical certificate to our office, see the Category Chart. Private motor carrier of passengers (nonbusiness).For example, organizations exempt from the InternalRevenue Code that provide transportation for theirmembers.CATEGORY CHARTAll Class A, B, or C (CDL) License holders and thoseapplying for a Class A, B, or C permit that fall underCategory 1 must send a copy of their medical certificate to the Drivers License Division in Bismarck. Emergency delivery of propane winter heating fueland pipeline response. Drivers of migrant workers (must meet minimummedical standards only; 49 CFR 398.3).Category 1: Interstate and subject to 49 CFR part391. A copy of the Medical Certificate must be mailed,faxed, or emailed to the North Dakota Drivers LicenseDivision.Category 3: Intrastate and subject to State driverqualification requirements. Medical Certificate mustbe carried by the driver. Do not send it to our office. All Class A, B, and C drivers who do NOT fall underany of the other categories. North Dakota drivers granted a State Waiver for vision and insulin controlled diabetes (Restriction K;CDL is valid for Intrastate only). All Class A, B, and C drivers granted a federal visionor diabetes exemption; or federal SPE-limb impairment Skill Performance Evaluation. In-state drivers of vehicles over 26,000 pounds,placarded hazardous material, vehicles designed totransport 16 or more persons including the driver,school vehicles designed to seat 10 or more passengers, and school bus drivers who do not cross statelines (Restriction K; CDL is valid for Intrastate only).Category 2: Interstate, but operating exclusivelyin transportation or operations excepted under 49CFR 390.3(f), 390.5, 391.2, 391.68, or 398.3. Medical monitoring may be required by the North DakotaDrivers License Division pending certain medicalconditions.Category 4: Intrastate, but operating exclusively intransportation or operations excepted from all orpart of the State driver qualification requirements.No medical certificate required. Medical monitoringmay be required by the North Dakota Drivers LicenseDivision pending certain medical conditions. School bus operations crossing state lines. MedicalCertificate must be carried by the school bus driver.Do not send it to our office. Transportation performed by the federal government,a state, or any political subdivision of a state. Bonafide farmer operating articulated farm vehicleswithin a 150-mile radius of the farm and does NOTcross state lines (Restriction K; CDL is valid for Intrastate only). Occasional transportation of personal property byindividuals not for compensation, nor in the furtherance of a commercial enterprise. Farmer or rancher operating a covered farm vehicledisplaying farm plates/CFV designation (straighttrucks and articulated) within North Dakota only. (Restriction K; CDL is valid for Intrastate only). The transportation of human corpses or sick and injured persons. The operation of fire trucks and rescue vehicles whileinvolved in emergency and related operations. Business vehicles 10,001 to 26,000 pounds GVWRthat do NOT cross state lines, do NOT transport A 9 to 15 passenger van, including the driver, weigh-2

hazardous material that requires placarding, andare NOT designed to transport 16 or more persons,including the driver. (Restriction K; CDL is valid forIntrastate only).Farm Exemption (NDCC 39-06.2-06; 39-06.2-09)A Class D license holder age 15 may operate a farmtruck within 150 miles of the driver’s farm, having agross weight of not more than 50,000 pounds, whentransporting agricultural products or farm supplies.NORTH DAKOTA DRIVER LICENSECLASSESA Class D license holder age 16 and older may operate a two-axle, tandem axle, or triple-axle truck towinga trailer (but not double or triple trailers) and if age 18and older may operate a truck-tractor towing a trailer(but not double or triple trailers) transporting agricultural products, farm machines, or farm supplies to orfrom a farm within 150 miles of the person’s farm.CLASS AAny combination of vehicles with a gross combinationweight rating or gross vehicle weight of 26,001 poundsor more whichever is greater, provided the vehicle being towed has a gross vehicle weight rating or grossvehicle weight of 10,001 pounds or more, whichever isgreater. (May also operate Class B, C, and D vehiclegroups, but not a Class M unless endorsed.)A Class D license holder may operate a farm vehicle ifthe vehicle is controlled and operated by a farmer andused to transport hazardous materials in the form offarm supplies within 150 miles of the farm and is notused in the operations of a common or contract carrier.CLASS BAny single vehicle with a gross weight rating or grossvehicle weight of 26,001 pounds or more, whicheveris greater. May tow a vehicle not in excess of 10,000pounds. (May also operate Class C and D vehiclegroups, but not a Class M unless endorsed.Covered Farm Vehicle Exemption (49 CFR 390.5)A Class D license holder may operate a covered farmvehicle defined in 49 CFR 390.5. This is a vehicle operated by an owner or operator of a farm or ranch, orby a family member or employee of the owner or operator used to transport agricultural commodities, livestock, machinery, or supplies to or from a farm or aranch, is not used in for-hire motor carrier operations,and is not transporting hazardous materials that require placarding. The vehicle must have a licenseplate or other designation specified by the statethat clearly identifies it as a farm vehicle.CLASS CAny single vehicle with a gross vehicle weight rating of26,000 pounds or less that is designed to transport 16or more passengers, including the driver or is transporting hazardous materials under 49 CFR part 172(placarded materials) and 42 CFR part 73. May towa vehicle not in excess of 10,000 pounds. (May alsooperate a Class D vehicle but not a Class M unlessendorsed.)A covered farm vehicle and its operator are exemptfrom the following federal regulations:CLASS D (NONCOMMERCIAL DRIVER LICENSE) Part 382 (Controlled Substances and Alcohol Useand Testing)Any single vehicle less than 26,001 pounds gross vehicle weight rating may tow trailers not over 10,000pounds gross vehicle weight rating. Note: Must be18 years of age or older if combined weight exceeds26,000 pounds. Trucks towing trailers over 10,000pounds provided the combined weight does not exceed 26,000 gross combination weight rating. (Holdersof a Class D license may not operate a Class M vehicleunless endorsed.) Part 383 (Commercial Driver’s License Standard;Requirements and Penalties) Part 391 (Subpart E- Physical Qualifications and Examinations) Part 395 (Hours of Service of Drivers) Part 396 (Inspection, Repair, and Maintenance)A covered farm vehicle with a Gross Vehicle Weight(GVW) or Gross Vehicle Weight Rating (GVWR),whichever is greater, of 26,001 pounds or less may beoperated anywhere in the United States. An operator with a Class D license may operate afarm tractor towing another vehicle having a grossweight in excess of 10,000 pounds. A Class D license holder may operate a house car orvehicle towing a house trailer or mobile home usedsolely for personal rather than commercial purposes.A covered farm vehicle with a GVW or GVWR, whichever is greater, of more than 26,001 pounds may beoperated within the state where it is registered, or iftravelling outside of the state, within 150 air miles ofthe owner or operator’s farm or ranch. A Class D license holder may operate a fire truck orother emergency vehicle, vehicles during declaredemergency snow and ice removal, and vehiclesdriven by active duty members for military purposes.CLASS MAny two- or three-wheeled motorcycle.3

A commercial motor vehicle transporting an empty storage container tank, not designedfor transportation, with a rated capacity of 1,000gallons or more that is temporarily attached to aflatbed trailer is not considered a tank vehicle. Insummary, if you are hauling multiple tanks eachrated more than 119 gallons AND the combinedvolume of those tanks is 1,000 gallons or more,you need an N endorsement. If you are only hauling one tank and that one tank is 1,000 gallon capacity or more, you need an N endorsement. (Requires a knowledge test.)ENDORSEMENT/RESTRICTION DESCRIPTIONSAll persons who operate a Class A, B, or C vehicle ofa type or size having the following specialized equipment, or vehicle transportation needs, must pass additional knowledge and skill tests.All applicants for a Hazardous Materials endorsement must provide proof of citizenship or immigrationstatus as specified in Table 1 to 49 CFR 383.71 andare subject to a Transportation Security Administrationsecurity screening process that includes fingerprintand background record checks (USA Patriot Act). Seepage 11 for more information.StatusU.S. CitizenProof of Status Valid, unexpired U.S. Passport Consular Report of BirthAbroad (CRBA) issued by theU.S. Department of State.Passenger Bus Certificate of Naturalizationissued by the U.S.Department of HomelandSecurity (DHS).P - A passenger bus endorsement is required to operate a passenger bus designed to transport 16or more persons, including the driver. (Requires aknowledge test and road test in a representativevehicle.) Certificate of Citizenshipissued by DHS.Doubles or TriplesT - A doubles/triples endorsement is required to operate a commercial vehicle towing two or three trailers. (Requires a knowledge test.)School BusENDORSEMENTSS - A school bus endorsement is required to operatea school bus designed to transport 16 or more passengers, including the driver, and is used to transport pre-primary, primary, or secondary school students from home to school, from school to home,or to and from school-related events. School busdoes not include a bus used as a common carrier. (Requires a knowledge test and road test ina representative school bus that is equipped withflashing red lights for loading and unloading schoolchildren.)Hazardous MaterialAdditional Endorsement InformationH - A hazardous material endorsement is requiredto operate a commercial motor vehicle transporting hazardous material that requires placardingby federal regulation or any quantity of a materiallisted as a select agent or toxin in 42 CFR part73. The federal background check and written testmust be passed each time you renew your commercial drivers license if you wish to retain this endorsement. (Requires a knowledge test.)The H and T endorsements are not allowed on Commercial Learner’s Permits. The P and S endorsementsare allowed on Commercial Learner’s Permits however no passengers, other than the supervising driveror driver examiner, are allowed. The N endorsement isallowed on Commercial Learner’s Permits, however itis restricted to “empty tanks only.” If you pass the roadtest in a bus less than 26,001 gross vehicle weight rating, your license will be restricted to “No Class A or Bbuses.” If you pass the road test in
