This Certificate of Insurance contains aclause which may limit the amount payable.Additionally, this Certificate of Insurancecontains a provision removing or restrictingthe right of the Insured Person to designatepersons to whom or for whose benefitinsurance money is payable.The coverage outlined in this Certificate ofInsurance is effective as of November 8, 2019, andis provided to eligible MBNA Choice Rewards WorldElite Mastercard Cardholders, and where specified,their eligible Spouses and Dependent Children byAmerican Bankers Insurance Company of Floridaand/or American Bankers Life Assurance Companyof Florida (hereinafter collectively referred toas the “Insurer”) under Group Policy numbersMBNA-WE1119 and MBNA-WEL1119 (hereinafterreferred to as the “Policy”) issued by the Insurer toMBNA, a division of The Toronto-Dominion Bank(hereinafter referred to as the “Policyholder”).The terms, conditions and provisions of the Policyare summarized in this Certificate of Insurance,which is incorporated into and forms part of thePolicy. All benefits are subject in every respect tothe Policy, which alone constitutes the agreementunder which benefits will be provided. To the extentthat any term, condition or provision of the Policyare deemed to be contrary to any applicable laws,the applicable laws shall govern with respect tosuch term, condition or provision of the Policy. Youor a person making a claim under this Certificateof Insurance may request a copy of the Policy and/or a copy of your application for this insurance (ifapplicable) by writing to the Insurer at the addressshown below.The Insurer’s Canadian head office is located at5000 Yonge Street, Suite 2000, Toronto, Ontario,M2N 7E9.In no event will a corporation, partnership orbusiness entity be eligible for the insuranceprovided by this Certificate of Insurance.Claims payment and administrative services underthis Policy are arranged by the Insurer.1

PURCHASE ASSURANCE ANDEXTENDED WARRANTYPurchase Assurance and Extended Warrantycoverage are underwritten by American BankersInsurance Company of Florida. For this benefit,Insured Person means the Cardholder.PURCHASE ASSURANCEBenefits are in effect when You charge the fullcost of the item(s) to Your Account or pay suchcost with points redeemed under the ChoiceRewards program.BenefitsPurchase Assurance benefits are availableautomatically, without registration, to protectmost new items of personal property purchasedby You with Your World Elite Mastercard Account,for 90 days from the date of purchase, againstall risk of direct physical loss, theft or damage,anywhere in the world, subject to Limitations andExclusions below.Limitations and ExclusionsPurchase Assurance benefits are only availableto the extent that the item in question is nototherwise protected or insured in whole or in part.Purchase Assurance benefits are not available inrespect of the following items:i)travellers cheques, cash (whether paperor coin), bullion, precious metals, tickets,documents, negotiable instruments or othernumismatic property;ii)animals or living plants, golf balls or othersports equipment lost or damaged during thecourse of normal use;iii) mail order, internet, telephone purchase orany purchase being shipped until deliveredand accepted by the Cardholder;iv) automobiles, motorboats, airplanes,motorcycles, motor- scooters, snowblowers,riding lawnmowers, golf carts, lawn tractors2or any other motorized vehicles (exceptfor miniature electrically powered vehiclesintended for recreational use by children) orany of their respective parts or accessories;v)perishables such as food and liquor and/orgoods consumed in use;vi) jewellery lost or stolen from baggage unlesssuch baggage is hand carried under thepersonal supervision of the Cardholder or theCardholder’s travelling companion with theCardholder’s knowledge;vii) used or previously owned or refurbisheditems, including antiques, collectibles andfine arts;viii) items purchased and/or used by or for abusiness or for commercial gain;ix) losses caused by or resulting from fraud, misuseor lack of care, improper installation, hostilitiesof any kind (including war, invasion, rebellionor insurrection), confiscation by authorities,risks of contraband, illegal activities, normalwear or tear, flood, earthquake, radioactivecontamination, Mysterious Disappearance, orinherent product defects; orx)bodily injury, property damage, consequentialdamages, punitive damages, exemplarydamages and legal fees.Limits of LiabilityThere is a maximum lifetime liability of 60,000per Account for the Purchase Assurance benefit.You will be entitled to receive no more than theoriginal purchase price of the protected item orthat portion of the original purchase price asrecorded on Your World Elite Mastercard salesreceipt. Where the protected item is a part ofa pair or set, You will receive no more than thevalue of the item lost or damaged regardless ofany special value that the item may have as partof an aggregate purchase price of such pair or set.The Insurer, at its sole option, may elect to:3

i) repair, rebuild or replace the item lost ordamaged (whether wholly or in part); ori) used items;ii) pay You cash for the said item, not exceedingthe original purchase price, the replacementprice or the repair cost thereof, in the Insurer’sdiscretion, and subject to the terms, exclusionsand limits of liability set out in this Certificateof Insurance.ii) automobiles, motorboats, airplanes,motorcycles, motor scooters, snowblowers,riding lawnmowers, golf carts, lawn tractorsor any other motorized vehicles (exceptfor miniature electrically powered vehiclesintended for recreational use by children) orany of their respective parts or accessories;See General Provisions for Purchase Assuranceand Extended Warranty Insurance below.iii) items purchased and/or used by or for abusiness or for commercial gain; orEXTENDED WARRANTYiv) bodily injury, property damage, consequentialdamages, punitive damages, exemplarydamages and legal fees.Benefits are in effect when You charge the fullcost of covered new item(s) to Your Account orpay such cost with points redeemed under theChoice Rewards program.BenefitsExtended Warranty benefits provide You withdouble the period of repair services on eligibleitems to a maximum of two years and providethe same coverage afforded by the OriginalManufacturer’s Warranty.Benefits are available automatically and withoutregistration where the Original Manufacturer’sWarranty does not exceed five years. Wherethe Original Manufacturer’s Warranty exceedsfive years, the item must be registered withinfive years from the date of purchase. (Referto “Registration”).Extended Warranty benefits apply to any partsand/ or labour costs resulting from mechanicalbreakdown or failure of a covered item, or any otherobligations that were specifically covered underthe terms of the Original Manufacturer’s Warranty.RegistrationTo register item(s) with an Original Manufacturer’sWarranty of five years or more for the ExtendedWarranty benefit, You must send copies of thefollowing items within five years after the item ispurchased to the Administrator:i) a copy of the original vendor sales receipt;ii) the “customer copy” of the World EliteMastercard sales receipt;iii) serial number of the item; andExtended Warranty benefits are limited to thelesser of the cost to repair or replace or the originalpurchase price of the item.iv) the Original Manufacturer’s Warranty.Limitations and ExclusionsGENERAL PROVISIONS FOR PURCHASEASSURANCE AND EXTENDED WARRANTYThe Extended Warranty benefit endsautomatically upon the date when the originalmanufacturer ceases to carry on business for anyreason whatsoever.The Extended Warranty benefit does not cover thefollowing items:4Call (905) 305-4255 or 1-800-315-2051.GiftsEligible items that You give as gifts are covered. Inthe event of a claim, You, not the recipient of thegift, must make the claim for benefits.5

Other InsurancePurchase Assurance and Extended Warrantycoverage is in excess of all other applicable validwarranty, insurance, indemnity or protectionavailable to You in respect of the item(s) subjectto the claim. The Insurer will be liable only forthe amount of loss or damage over the amountcovered under such other insurance, indemnity,warranty or protection and for the amount ofany applicable deductible, only if all such othercoverage has been claimed under and exhaustedand subject to the terms, exclusions and limitsof liability set out in this Certificate of Insurance.This coverage will not apply as contributinginsurance, notwithstanding any provision in anyother insurance, indemnity or protection policiesor contracts.Claim Procedures for Purchase Assuranceand Extended WarrantyYou must keep original receipts and otherdocuments described herein to file a valid claim.You must notify the Administrator immediatelyafter learning of any loss or occurrence. Yourfailure to provide proof of loss within 90 days fromthe date of loss or damage may result in denial ofthe related claim.You may obtain Purchase Assurance and/or Extended Warranty claim forms by calling(905) 305-4255 or 1-800-315-2051.Prior to proceeding with replacement or repairs,You must obtain the Administrator’s approval inorder to ensure the eligibility for payment of Yourclaim. You must complete and sign a claim formwhich must contain the time, place, cause andamount of loss and include the following:i) the “customer copy” of the World EliteMastercard sales receipt;ii) Your copy of the Account statement showingthe charge;iii) the original vendor’s sales receipt;6iv) a copy of the Original Manufacturer’s Warranty,(for Extended Warranty claims); andv) a police, fire, insurance claim or loss reportor other third party report of the occurrenceof the loss sufficient for determination ofeligibility for the benefits hereunder.In order to support Your claim You may be requiredto send, at Your own expense, the damaged itemto the Administrator.Purchase Assurance and Extended WarrantyTermination of CoverageCoverage ends on the earliest of:i) the date Your World Elite MastercardAccount is cancelled, closed or ceases to be inGood Standing;ii) the date You cease to be eligible forcoverage; andiii) the date the Policy terminates.No coverage will be provided for items purchasedafter the Policy termination date.CAR RENTAL COLLISION/LOSSDAMAGE WAIVERThis coverage is underwritten by AmericanBankers Insurance Company of Florida. For thisbenefit, Insured Person means the Cardholder andany other person authorized to operate the rentalcar under the car rental agreement.This coverage is in effect when You charge thefull cost of the car rental to Your Account or paysuch cost with points redeemed under the ChoiceRewards program.EligibilityYou are eligible for World Elite MastercardCar Rental Collision Damage Waiver insurancecoverage when You rent most private passengervehicles on a daily or weekly basis for a periodNOT to exceed 31 consecutive days, provided that:7

i) You initiate the rental transaction by bookingor reserving the car rental with Your World EliteMastercard card and by providing Your WorldElite Mastercard card as payment guaranteeprior to the time You take possession of thecar; andii) You decline the rental agency’s CollisionDamage Waiver (CDW) or Loss Damage Waiver(LDW), or similar provision; andiii) You rent the car in Your name and charge thefull cost of the car rental to Your Account orpay such costs with points redeemed under theChoice Rewards program.BenefitsSubject to the terms, exclusions and limits ofliability set out in this Certificate of Insurance, Youare provided with protection against the amountfor which You are liable to the rental agency upto the actual cash value of the damaged or stolenrental vehicle as well as any valid and documentedloss of use, reasonable and customary towingcharges and administration charges resulting fromdamage or theft occurring while the rental vehicleis rented in Your name. Benefits are limited to onevehicle rental during any one period.In some jurisdictions the law requires the rentalagencies to include CDW/LDW in the price ofthe vehicle rental. In these locations, CDW/LDWbenefits under this Policy will only provide coveragefor any deductible that may apply, provided allthe requirements outlined in this Certificate ofInsurance have been met and You have waivedthe rental agency’s Deductible Waiver. No CDW/LDW premiums charged by the rental agencies willbe reimbursed under this Policy. Rental vehicleswhich are part of pre-paid travel packages areeligible for benefits if the total for Your Trip wascharged to Your Account or You pay such costwith points redeemed under the Choice Rewardsprogram and all other requirements are met.‘Free Rentals’ are also eligible for benefits whenreceived as the result of a promotion conditioned8on Your making previous rentals, if each suchprevious rental met the eligibility requirements ofthis Certificate of Insurance.This coverage is available on a 24-hour basisanywhere in the world, except where prohibitedby law, or where the coverage is in violation ofthe terms of the rental contract in the jurisdictionin which it was formed. (See the section “Knowbefore you go” for tips on how to avoid havinguse of this coverage challenged.)This coverage does not provide any form ofthird-party automobile property damage orpersonal injury liability insurance.Important: Check with Your personal insurer andthe rental agency to ensure that You and all otherdrivers have adequate personal property, personalinjury and third-party liability coverages. This Policyonly covers loss or damage to a rental vehicle, asstipulated herein.Know before you goi) While Car Rental Collision Damage Waiverbenefits provide coverage on a worldwidebasis (except where prohibited by law), andthe coverage is well received by car rentalmerchants, there is no guarantee that thiscoverage will be accepted at every car rentalfacility. Some rental agencies may resist Yourdeclining their CDW/LDW coverage. They maytry to encourage You to take their coverage.If You refuse, they may insist You provide adeposit. Before booking a car, confirm that therental agency will accept World Elite MastercardCar Rental Collision Damage Waiver withoutrequiring a deposit. If they won’t, find onethat will, and try to get written confirmation.If booking Your trip through a travel agency,let them know You want to take advantage ofCar Rental Collision Damage Waiver benefitsand have them confirm the rental agency’swillingness to accept this coverage. You willnot be compensated for any payment You9

may have to make to obtain the rental agency’sCDW/LDW.ii) Check the rental car carefully for scratches,dents and windshield chips, and point out anydamage to the agency representative beforeYou take possession of the car. Have them notethe damage on the rental agreement (and takea copy with You) or ask for another vehicle.iii) If the vehicle sustains damage of any kind,immediately phone the Administrator at oneof the numbers provided. Advise the rentalagent that You have reported the claim andprovide the Administrator’s address and phonenumber. If loss appears to exceed 1,000 Youmust also advise the police and request a policereport. Do not sign a blank sales draft to coverthe damage and loss of use charges.Coverage PeriodInsurance coverage begins as soon as the InsuredPerson takes control of the vehicle, and ends atthe earliest of:ii) are not to be used for hire by others.Pickup trucks are covered provided they:i) do not exceed a “half-ton” rating (e.g. 150or 1500 series not including “heavy-duty”models); andii) are used exclusively for personal use onmaintained roads; andiii) are not used to transport cargo, push ortow anything.Any damage to the pickup truck caused by movingor transporting goods or cargo is not covered.Types of vehicles NOT coveredVehicles which belong to the following categoriesare NOT covered: any vehicle with a Manufacturer’s SuggestedRetail Price (MSRP), excluding taxes, over 65,000 at the time and place of loss; vans (except as defined above); trucks (except as defined above);i) the time when the rental agency assumescontrol of the rental car, whether it be at itsplace of business or elsewhere; campers or trailers;ii) the date on which Your Account ceases tobe in Good Standing and/or Your Accountprivileges are suspended, revoked orotherwise terminated; expensive or exotic vehicles;iii) the date You cease to be eligible forcoverage; andiv) the date the Policy terminates.Types of vehicles coveredThe types of rental vehicles covered include:Cars, sport utility vehicles, pickup trucks (asdefined below) and minivans (as defined below).Minivans are covered provided they:i) are for private passenger use with seating forno more than eight occupants including thedriver; and10 off-road vehicles; motorcycles, mopeds or motorbikes; customized vehicles; antique vehicles; recreational vehicles; and leased vehicles.An antique vehicle is one which is over 20 yearsold or its model has not been manufactured for10 years or more.Limousines that have been stretched or alteredfrom the original factory design are excluded.However, standard production models of thesevehicles that are not used as limousines arenot excluded.11

Limitations and ExclusionsCar Rental Collision Damage Waiver benefits donot cover any loss caused or contributed to by: operation of the vehicle in violation of the lawor any terms of the car rental agreement; operation of the vehicle by any driver notauthorized on the rental agreement at thetime the rental is initiated; operation of the vehicle by any driver not inpossession of a driver’s license that is valid inthe rental jurisdiction; operation of the vehicle on other thanregularly maintained roads; alcohol intoxication and/or use of narcotics bythe driver; nuclear reaction, radiation or radioactivecontamination; damage to tires unless in conjunction with aninsured cause; wear and tear, gradual deterioration,mechanical breakdown of vehicle; any damage caused by moving ortransporting cargo; insects or vermin, inherent vice or damage; hostile or warlike action, insurrection,rebellion, revolution or civil war; seizure or destruction under quarantine orcustoms regulations or confiscation by anygovernment or public authority; transporting contraband or illegal trade; or transportation of property or passengers forhire or any dishonest, fraudulent or criminalact committed by the Cardholder and or anyauthorized driver.Benefits DO NOT include coverage for: vehicles rented for a period that exceeds 31consecutive days, whether or not under oneor more consecutive rental agreements; a replacement vehicle for which Your personalautomobile insurance, car dealer, repair shop,or other party is covering all or part of therental cost;12 loss or theft of personal belongings inthe vehicle; cellular telephones, portable computers andcommunication devices; any amount payable by Your employer oremployer’s insurance coverage, if the rentalcar was for business purposes; expenses assumed, waived or paid or payableby the rental agency or its insurer; or third party liability (injury to anyone oranything inside or outside the vehicle).In the Event of Accident or TheftYou must report a claim to the Administratoras soon as possible, and in all events certainlywithin 48 hours of the damage or theft havingoccurred. Call 1-800-315-2051 from Canada andthe United States, or (905) 305-4255 collect fromelsewhere in the world. Failure to report a claimwithin 48 hours may result in denial of the claimor reduction of Your benefit. A customer servicerepresentative will take preliminary informationand forward You a claim form. You will be requiredto submit a completed claim form including thefollowing documentation: a copy of the driver’s license of the person whowas driving the vehicle at time of the accident; a copy of the loss/damage report Youcompleted with the rental agency; a copy of a police report required whenthe loss results in damage or theft claimedover 1,000; a copy of Your World Elite Mastercard salesdraft, and Your statement of Account showingthe rental charge; the front and back of the original opened andclosed out rental agreement; a copy of the itemized repair estimate, finalitemized repair bill and parts invoices; original receipt(s) for any repairs for whichYou may have paid; and13

if loss of use is charged, a copy of the rentalagency’s complete daily utilization log fromthe date the car was not available for rental,to the date the car became available to rent.Valid claims submitted with incomplete orinsufficient documentation may not be paid.CAR RENTAL ACCIDENTAL DEATHAND DISMEMBERMENTThis benefit is underwritten by American BankersLife Assurance Company of Florida. For thisbenefit, Insured Person means the Cardholder andhis or her Spouse, Dependent Child(ren), parent,parent-in-law, and sister or brother who sustainsan Accidental Bodily Injury while Occupying thecovered rental car. BeneficiaryUnless otherwise specified by the insuredCardholder, any amount due for Loss of Life:i) at the death of the insured Cardholder, will bepaid to the Spouse of the insured Cardholder,if living, otherwise equally to the insuredCardholder’s then living children, includingstepchildren and adopted children, if any,otherwise equally to the insured Cardholder’sthen living parents or parent, otherwise to theestate of the insured Cardholder; andii) at the death of any other Insured Person, willbe paid to the insured Cardholder in whosename the Account is maintained, if then living,otherwise as though it were a sum payableunder i) above.The beneficiaries herein designated may bechanged in accordance with the Change ofBeneficiary provision.PERSONAL EFFECTSThis coverage is underwritten by AmericanBankers Insurance Company of Florida. For thisbenefit, Insured Person means the Cardholder andhis or her Spouse, Dependent Child(ren), parent,parent-in-law, and sister or brother while travellingwith Cardholder.Benefits are in effect when You charge the fullcost of the car rental to Your Account or pay suchcost with points redeemed under the ChoiceRewards program.Personal Effects benefits are provided for loss,theft or damage to personal effects while suchpersonal effects are in transit or in any hotel orother building en route during a trip with thecovered rental car, for the duration of the carrental period. Personal Effects do not includemoney (whether paper or coin), bullion, banknotes, securities, tickets, documents, memorabilia,collectibles, medals or other numismatic property.16Maximum coverage during the rental period is 1,000 for each Insured Person, per occurrence.Total benefits for all Insured Persons duringeach car rental period are limited to 2,000 perAccount. Benefits are not paid if loss results fromMysterious Disappearance.In the event of a claim, contact the Administratorat 1-800-315-2051 from Canada and theUnited States, or (905) 305-4255 collect fromelsewhere in the world.Other InsurancePersonal Effects coverage is in excess of all otherapplicable valid insurance, indemnity or protectionavailable to the Cardholder in respect of the itemssubject to the claim. The Insurer will be liableonly for the amount of the loss or damage overthe amount covered under such other insurance,indemnity or protection and for the amountof any applicable deductible, only if all otherinsurance has been claimed under and exhaustedand subject to the terms, exclusions and limitsof liability set out in this Certificate of Insurance.This coverage will not apply as contributinginsurance, notwithstanding any provision in anyother insurance, indemnity or protection policiesor contracts.COMMON CARRIER ACCIDENTALDEATH AND DISMEMBERMENTThis coverage is underwritten by AmericanBankers Life Assurance Company of Florida. Forthis benefit, Insured Person means the Cardholder.Benefits are in effect when You charge the fullcost of Common Carrier travel to Your Accountor pay such cost with points redeemed under theChoice Rewards program.BenefitsAs an Insured Person, You will be protectedagainst an Accidental Bodily Injury sustained whileOccupying a Common Carrier as a fare paying17

passenger.
