Judicial Retirement SystemFOREWORDTHE RETIREMENT SYSTEMThe New Jersey Judicial Retirement System (JRS)Member Guidebook provides a summary description ofthe benefits of the plan and outlines the rules and regulations governing the plan. The JRS Member Guidebook should provide you with all the information youneed about your JRS benefits. However, if there is aconflict with statutes governing the plan or regulationsimplementing the statutes, the statutes and regulationswill take precedence. Complete terms governing anyemployee benefit program are set forth in the New Jersey Statutes Annotated. Regulations, new or amended, are published in the New Jersey Register by theState Office of Administrative Law supplementing theNew Jersey Administrative Code. Judicial Retirement Systeming the operation and administration of the system maybe found in Title 17, Chapter 10 of the New Jersey Administrative Code.FundingThe funds used to pay benefits come from three sources: State contributions, employee contributions, andinvestment income from those contributions.Plan YearFor record-keeping purposes, the plan year is July 1through June 30.Service of Legal ProcessLegal process must be served on the Attorney Generalof New Jersey pursuant to New Jersey Court Rules, R.4:4-4(7).Employment Rights Not ImpliedMembership in the JRS does not give you the right tobe retained in service for the judiciary, nor does it giveyou a right of claim to any benefit you have not accruedunder terms of the system.Benefits and provisions of the JRS are subjectto changes by the legislature, courts, and otherofficials. While this guidebook outlines the benefit and contribution schedules of the JRS, it isnot a final statement. Enrollments

Judicial Retirement SystemOVERVIEWEligibility CriteriaIf you are a member of the State Judiciary, you are required to join the JRS as a condition of employment.The JRS covers the Chief Justice and Associate Justices of the State Supreme Court, as well as all judgesof the Appellate Court, Superior Court, and Tax Courtof the State of New Jersey.Enrollment/Certification of Payroll DeductionsBoth you and the AOC must complete the JRS Enrollment Application to enroll you in the retirement system.The AOC will send the completed application to theNJDPB for processing.When enrollment processing is complete, you and theAOC will receive a Certification of Payroll Deductionsshowing the date deductions will begin, your rate ofcontribution, and any back deductions that may be due.You may wish to keep the Certification of Payroll Deductions on file with your other important papers so thatyou have a record of your enrollment in the retirementsystem.Proof of AgeAll members of the JRS must provide documentationthat proves their age. If possible, you should provideyour proof of age to the NJDPB when you enroll; however, it does not delay the processing of your enrollment application if you do not. Proof of age will be required to be eligible to retire.Acceptable evidence of your age includes a photocopyof: Birth certificate — with visible seal; Passport or U.S. Passport Card; A current digital New Jersey driver’s license oridentification card (for non-drivers) issued by thePage 7N.J. Motor Vehicle Commission; A current digital Pennsylvania or New York driver’slicense; or Naturalization or immigration papers.Unacceptable documentation includes military recordsindicating your age, expired documentation, out-ofstate driver’s licenses except P.A. and N.Y., hospitalbirth certificates, marriage certificates, census records,baptismal records, or affidavits from older family members.Public Information and RestrictionsMost of the information maintained by the retirementsystem, including member salary and/or pension benefit information, is considered a public record underN.J.S.A. 47:1A-1 et seq., the Open Public Records Act(OPRA). However, certain personal information suchas a member’s address, telephone number, Social Security number, pension membership number, beneficiary information while the member is living, and medicalinformation is restricted from public access.Further restrictions to personal health information exist under the privacy provisions of the federal HealthInsurance Portability and Accountability Act (HIPAA).Members may be required to provide specific writtenauthorization for the release of medical information toa third party who is not a doctor, hospital, or businesspartner of the NJDPB or the health benefit programs.Information about HIPAA is available on the NJDPBwebsite.The NJDPB has implemented additional protection formembers in accordance with the New Jersey IdentityTheft Prevention Act, N.J.S.A. 56:11-28 et seq. Security Freeze procedures are available to restrict accessto the accounts of members who are, or have a seriousrisk of becoming, victims of identity theft. Additionalinformation is available in the Identity Theft and YourBenefits Fact Sheet.July 2021Member Contribution RateN.J.S.A. 18A:66-29, the Pension and Health BenefitReform Law, increased the JRS member contributionrate over seven years to bring the total contribution rateto 12 percent of base salary as of July 1, 2017.Increases in the member contribution rate also increasethe minimum repayment amount for pension loans orfor the cost of a purchase of service credit, if certifiedafter the effective date of the rate change.Federal Pensionable Maximum — Since the JRS isa qualified pension plan under the provisions of theInternal Revenue Code (IRC), Section 401(a)(17), thecurrent federal ceiling on pensionable compensationapplies to the base salaries of JRS members.Tax Deferral — Since January 1987, all mandatorypension contributions to the JRS have been federallytax deferred. Under the 414(h) provisions of the IRCthis reduces your gross wages subject to federal income tax. Purchases of service credit are voluntaryand are not tax deferred unless funded by a rolloverfrom another tax-deferred plan. See the “Rollover forPurchase Payment” section.BENEFITS FROM OTHER SYSTEMSMembership in the JRS requires that you cease membership in any other New Jersey State-administeredretirement system prior to JRS enrollment; you cannotjoin any other retirement system while a member ofthe JRS. If you are a member of another New JerseyState-administered retirement system at the time youbecome a judge, you can: Withdraw all your contributions to the prior retirement system; Transfer your membership by depositing all contributions from the prior retirement system into theJRS, provided the prior account has not expired,by filing an Application for Interfund Transfer; orJRS Member Guidebook

Judicial Retirement System If eligible to either receive or defer retirement benefits in another retirement system, you can enrollin the JRS and receive a portion of the benefits,when due and payable, based upon your own contributions to the other retirement system. However,if you later elect to receive benefits from the JRS,you forfeit your right to all other retirement benefitsfrom the prior system. (You are entitled to a refundof your contributions you made to the prior system,reduced by the value of any benefit you have already received.)If at the time you become a judge you are already receiving a retirement allowance or pension from anotherretirement system, you must either: Enroll in the JRS and waive retirement benefitsfrom the other retirement system (you are entitledto a refund of your contributions you made to theprior system, reduced by the value of any benefityou have already received); or Waive enrollment in the JRS and continue to receive the full benefit from the other retirement system. If you waive enrollment in the JRS, you cannotbe enrolled in the JRS at a later date. You must filea written notification indicating your irrevocable intention not to enroll in the JRS. Such waivers mustbe filed with the JRS within 90 days from the dateof your appointment.Information regarding these options will be explainedin writing at the time of your enrollment in the JRS toassist you in making the decision that best meets yourneeds.JRS Member GuidebookSERVICE CREDITSince retirement benefits are based in part on accumulated service credit, it is important that you receivethe correct amount of credit for the amount of time youwork. Your service and contributions are reported biweekly. You receive judicial service credit equal to one biweekly pay period for each pay period a full pension contribution is made. You receive non-judicial service credit for any service (other than prior judicial service) which youare able to transfer from another State-administered, defined benefit retirement system into theJRS at the time of enrollment.When an employee returns from uniformed militaryservice to JRS-covered employment, the employershould notify the NJDPB no later than 30 days afterthe employee’s return by submitting a Request forUSERRA-Eligible Service form. Once notified, the NJDPB will provide the employee with a quotation for thecost of the service.There is a time-sensitive element to the USERRA purchase which differs from other purchase provisionsavailable to JRS members. For additional information,see the USERRA — Military Service After EnrollmentFact Sheet.You may also be eligible to purchase prior service. Seethe “Purchasing Service Credit” section.Credit for Military ServiceAfter EnrollmentThe federal Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA) providesthat a member who leaves employment to serve on active duty is entitled to certain pension rights upon returnto employment with the same employer. If the membermakes the pension contributions that would have beennormally required upon return and within the specific time frames specified under USERRA, the militaryservice will count for vesting, retirement eligibility, thecalculation of the retirement benefit, and, if applicable,health benefits eligibility, as though the employee hadnot left.July 2021Page 8

PurchasingService Credit

Judicial Retirement SystemOVERVIEWSince your retirement allowance is based in part on theamount of service credit posted to your account at thetime of retirement, it may help you to purchase additional service credit if you are eligible to do so.Only active members of the retirement systems arepermitted to purchase service credit. An active memberis one who has not retired or withdrawn, and who hasmade a contribution to the retirement system within twoconsecutive years of the purchase request. In no casecan you receive more than one year of service creditfor any calendar or fiscal year. “Service” means publicservice rendered for which pension credit is allowed onthe basis of contributions made by the State.TYPES OF SERVICE ELIGIBLE FOR PURCHASEThe following types of service may be eligible for purchase: Former Membership in a New Jersey State-administered, defined benefit retirement system maybe purchased at any time during your membershipin the JRS. Previous Service rendered in an office, position,or employment of the State of New Jersey, or of acounty, municipality, board of education, or publicagency of the State of New Jersey. Military Service After Enrollment rendered afterOctober 13, 1994, may be purchased under therequirements of USERRA at full cost. However,under N.J.A.C. 17:1-3.10, USERRA-eligible service will only be used toward vesting, retirementeligibility, the calculation of the retirement benefit,and, if applicable, health benefits eligibility, if theemployee pays the required pension contributionsthat would have been required if the employee hadnot left.JRS Member GuidebookNote: There is a time-sensitive element to this purchase. Ifyou make a partial purchase, you may purchase anyremaining eligible service at a later date. The cost ofany later purchase will be based upon your age and theannual salary or highest fiscal year salary at the time ofyour subsequent request to purchase.Estimating the Cost of a PurchaseTo estimate the cost of a purchase, multiply the higher of your current annual salary or highest fiscal yearsalary times the purchase factor corresponding to yournearest age; see the “JRS Purchase Rate Chart.” Theresult is the cost of one year of service. Multiply thiscost by the appropriate number of years being purchased.July NG TO PURCHASE SERVICE CREDITYou may obtain a quotation of the cost of purchasingadditional service credit by writing to the New JerseyDivision of Pensions & Benefits, Judicial RetirementSystem, P.O. Box 295, Trenton, NJ 08625-0295. Inyour correspondence be sure to include the dates ofthe service you are requesting to purchase, the formeremployer’s name and address, the name of the retirement system, and the job title you held.Upon receipt of your request and all required supporting documentation, a quotation of cost will be calculated if all purchase eligibility criteria are met. Judicial Retirement Systemtimes vary and a request cannot be completed until theNJDPB receives all required verification of eligibility.After the NJDPB verifies employment, you will receivea Purchase Cost Quotation Letter indicating the cost ofany service approved for purchase. You must respondto the quotation letter within the specified time period.When you agree to purchase a certain amount of service credit, the NJDPB assumes that you will completethe purchase and credits your account with the entireamount of service, even if you are paying the costthrough payroll deductions. Any estimates of retirementallowance you receive are based on the full amount ofcredit you agreed to purchase.You may pay the cost of purchasing service credit: In one lump-sum payment; By having extra payroll deductions withheld fromyour pay. The minimum deduction is equal to onehalf of your normal rate of contribution to the retirement system over a maximum period of 10 years,and includes interest at the assumed rate of returnof the retirement system; By paying a single down payment and having theremainder paid through payroll deductions; or With a direct rollover or trustee-to-trustee transferof tax-deferred funds from a qualified retirementplan (see the “Rollover for Purchase Payment”section).lump-sum payments, partial payments, or installmentpayments. The member will receive prorated servicecredit for the service purchased to the date installmentpayments cease.If you have an outstanding arrears obligation for thepurchase of additional service credit, interest may beassessed if there is a lapse of two years or more inpayments toward the purchase.Note: The NJDPB cannot accept rollovers from a RothIRA or a Coverdell Education Savings Account (formerly known as an Education IRA).Additional information on requesting a transfer or rollover of tax-deferred funds for the purchase of servicecredit is included in the Purchase Cost Quotation Letteryou receive upon the NJDPB’s determination of youreligibility to purchase service.Rollover for Purchase PaymentMembers may pay for all or part of a purchase by transferring or rolling over tax-deferred funds from an eligibleor qualified retirement savings plan. The types of plansfrom which a transfer or rollover can be made are: 401(a) qualified plan (including 401(k) plan) and403(a) qualified annuity; 403(b) - Tax-Sheltered Annuity Plan; 457(b) - State and Local Government DeferredCompensation Plan; or IRA - With tax-deferred funds:–Traditional IRA;–SIMPLE IRA (must have been open for two ormore years);–Simplified Employee Pension (SEP) Plan;–Conduit IRA; or–Rollover IRA.If you retire before completing a purchase, you maychoose to receive prorated credit for the amount of service you have paid for, or you can pay the balance atthe time of retirement to receive full service credit. Seethe “Unsatisfied Balances” section.A member who authorizes a purchase of service credit through payroll deductions may cancel those deductions at any time. Loans

Judicial Retirement SystemOVERVIEWIf you are an active contributing member of the JRS,you may be eligible to borrow from your pension account.Loans are governed by the following conditions: Service Credit — You must have three years ofpension service credit posted to your retirementsystem account. Pension contributions are postedto your account on a quarterly basis. It normallytakes 45 days after the end of a quarter for yourcontributions to be posted to your account. For example, if you enrolled in the retirement system onFebruary 1, 2015, you would not have three yearsposted to your account until May of 2018, when weupdate the quarter in which you will attain threeyears. Number of Loans Per Year — You may borrowtwice in any calendar year. This is determined bythe date of the check, not the date of the request.For example, if you make a request for a loan onDecember 28th but the check is dated January6th, the loan is considered your first for the newyear. Loan Amount — The minimum amount you mayborrow is 50, and loan amounts then increase inincrements of 10.The maximum you may borrow is one-half of yourcontributions that are posted to your account, upto a maximum loan balance of 50,000, whicheveris less, when added to the highest balance of anyloan in the last 12 months. Interest Rate — Interest is charged on the declining balance of the loan at a commercially reasonable rate set annually by the New Jersey StateTreasurer. The current interest rate is posted onthe NJDPB website.Page 13When you borrow, you will have the same interest rate for the life of your loan unless you borrowagain in a different calendar year, after the interest rate has changed. Every time you borrow, theentire outstanding balance is re-certified at thecurrent year’s interest rate. The new loan must berepaid within five years of the original loan date.The interest rate is determined using the PrimeRate as of December 1st of the previous year plus2.5 percent. Administrative Fee — An administrative processing fee applies to all pension loans. The administrative processing fee is set annually and is basedon the actual costs associated with administeringthe pension loan program. The current administrative processing fee is posted on the NJDPB website. Loan Repayment — Loans must be repaid withinfive years. The minimum deduction toward the repayment of a loan is equal to the JRS contributionrate (see the “Member Contribution Rate” section).The maximum allowable deduction toward the repayment of your loan is 25 percent of your basesalary. Provided that the minimum loan repaymentamount will repay the loan balance within fiveyears, the minimum repayment amount of a loanwill be similar whether you borrow 500 or 5,000;however, the repayment of a larger loan will continue for a longer period of time than for a smallerloan.Loan repayments will increase to more than theminimum deduction if the entire loan balance cannot be paid within the five year requirement, or ifyou have an outstanding loan and take anotherloan.If you have an outstanding loan balance and takeanother loan, the new combined loan balanceJuly 2021must be repaid within five years of the date of thefirst loan. This means that the repayment amountmay be substantially higher to ensure full repayment of the total loan balance within five years ofthe issuance of the original loan. Furthermore, therequested loan amount may be reduced, or theloan request may be rejected, if the payroll deductions required to repay the loan within this five-yearperiod would exceed the 25 percent of salary restriction in State law (see the “Internal RevenueService (IRS) Requirements” section).APPLYING FOR A LOANYou may apply for a loan by submitting a JRS LoanApplication to the NJDPB. To obtain an application, seethe Human Resources Office at the AOC, or you mayprint an application from the NJDPB website.Note: If you are applying for a loan within six months ofreturning from a leave of absence, or within six monthsof transferring to a new employer or between differentretirement systems, your employer must complete thecertification at the bottom of the JRS Loan Applicationto verify your salary and/or certify that you are activelyemployed.Canceling a LoanIf you are not satisfied with a loan amount or the repayment schedule when you receive your loan check,you may cancel the loan by returning the original, uncashed and unmarked loan check. When a loan checkis returned, the funds are deposited back into your retirement system account and will be available after thenext quarterly posting.Note: By cashing the loan check, you are agreeing tothe loan amount and the terms and conditions of therepayment schedule.JRS Memb
