OPWDD: Putting People FirstCMS GUIDANCESEPTEMBER 16, 2011CAREER PLANNING CORE SERVICE DEFINITIONCareer planning is a person‐centered, comprehensive employmentplanning and support service that provides assistance to obtaincompetitive employment. It is a focused, time limited service engaging aparticipant in identifying a career direction and developing a plan forcompetitive, integrated employment.PREVOCATIONAL SERVICES – CORE SERVICE DEFINITIONServices that provide learning and work experiences, includingvolunteer work, where the individual can develop general, non‐job‐task‐specific strengths and skills that contribute to employability in paidemployment. Services are expected to occur over a defined period oftime with specific outcomes.SUPPORTED EMPLOYMENT (SEMP) CORE SERVICEDEFINITIONThe outcome of this service is sustained paid employment at orabove the minimum wage in an integrated setting in the GENERALWORKFORCE in a job that meets personal and career goals.

This service wasdesigned for individuals who need to have communityexperiences before competitive employment is considered.COMMUNITY PREVOCATIONAL SERVICESAn opportunity for an individual to participate involunteer/vocational community experiences for an EXTENDEDPERIOD OF TIME to help provide the individual with experiencesthat prepare them for jobs that pay minimum wage in anintegrated setting.SUPPORTED EMPLOYMENT (SEMP)Services to support an individual in obtaining or maintainingcompetitive employment IN THE GENERAL WORKFORCE paying atleast minimum wage.

SEMP RedesignAmendments to 14 NYCRR Subparts 635-10, 635-12 & 635-99FINAL REGULATIONSEffective: July 1, 2015 Subdivision 635-10.4(d) is amended as follows:(d)Supported employment (SEMP) services prior to July 1, 2015. Supportedemployment under the HCBS waiver, is a service providing appropriate staffand/or material supports for a person obtaining or being maintained in acompensated employment setting in accordance with individual capabilities,choices and employment goals. (For SEMP provided on and after July 1, 2015,see subdivision 635-10.4(j) of this section.) A new subdivision 635-10.4(j) is added as follows:(j)Supported employment (SEMP) services on and after July 1, 2015. SEMP is aperson-centered employment planning and support service that providesassistance for an individual to obtain, maintain, or advance in self-employment orin competitive integrated employment in the general workforce, for which theindividual is compensated at or above the state or federal minimum wage(whichever is greater). The goal of this service is sustained self-employment orcompetitive integrated employment at or above the state or federal minimumwage (whichever is greater) in the general workforce, in a job that meets theindividual's personal and career goals.(1)SEMP consists of the following allowable activities provided to and/or onbehalf of an individual:(i)vocational assessment;(ii)person-centered employment planning;(iii)job-related discovery;(iv)job development, analysis, customization, and carving;(v)training and systematic instruction prior to employment;Note: New material is underlined and deleted material is in [brackets].-1-

Final Regulations: SEMP RedesignEffective Date: July 1, 2015(vi)job placement;(vii)job coaching, training, and planning within the work environment;(viii)development and review of a business plan (for individuals who arepursuing self-employment or are self-employed);(ix)transportation between activities;(x)travel training;(xi)development of soft skills and job retention strategies (e.g., socialinteraction, maintaining relationships with co-workers andsupervisory personnel);(xii)benefits support and asset development;(xiii)career advancement services;(xiv)other workplace support services including services that enable theindividual to be successfully integrated into the job setting (e.g.,development of natural supports in the work environment);(xv)negotiating potential jobs with prospective employers on behalf ofan individual;(xvi)communication with an existing employer to review the individual'sprogress in meeting workforce expectations and to discuss andaddress any challenges the individual may have in the workenvironment;(xvii) communication with family or other members of the individual'scircle of support to discuss and address employment-relatedissues, such as management of benefits or challenges theindividual may have in the work environment; and/or(xviii) meetings and communications with staff providing other OPWDDapproved services that impact an individual’s ability to successfullyachieve employment goals;(xix)documentation of the delivery of SEMP services; andNote: New material is underlined and deleted material is in [brackets].-2-

Intensive SEMP services include intensive jobdevelopment and/or intensive job coaching services provided to asingle individual or small group of individuals.(a)Intensive job development services include activities thatassist an individual in obtaining a job or establishing selfemployment.(b)Intensive job coaching services include initial supports thatassist an individual to adjust to and maintain a job, oncehired or self-employed.(c)Intensive SEMP may be provided as:(d)(ii)(1)Intensive - 1, which is Intensive SEMP provided to oneindividual; or(2)Intensive - 2, which is Intensive SEMP provided to agroup of 2-8 individuals.Intensive SEMP can only be provided for a time-limitedperiod in accordance with section 635-10.5 of this Subpart.Extended SEMP. Extended SEMP services include ongoing jobcoaching and career development services provided to a singleindividual or small group of individuals who may have received up to365 days of intensive supported employment services and who arecurrently employed.(a)Ongoing job coaching services include activities to assist anindividual to maintain employment.(b)Career development services include services to assist anemployed individual in obtaining a new job or a second job orin changing his or her career path.(c)Extended SEMP may be provided as:Note: New material is underlined and deleted material is in [brackets].-3-

Final Regulations: SEMP RedesignEffective Date: July 1, 2015(d)(3)(4)(5)(1)Extended - 1, which is Extended SEMP provided toone individual; or(2)Extended - 2, which is Extended SEMP provided to agroup of 2-8 individuals.Extended SEMP can only be provided for a limited number ofhours in accordance with section 635-10.5 of this Subpart.Self Employment. SEMP may include services and support to assist anindividual to achieve self-employment, including home-based selfemployment. Wages earned in self-employment may be below the state orfederal minimum wage. Assistance for self-employment may include:(i)assistance to identify potential business opportunities;(ii)assistance to develop a business plan, including identification ofpotential sources of business financing, and other assistance indeveloping and launching a business;(iii)identification of the supports the individual needs to operate thebusiness; and(iv)ongoing assistance, counseling, and guidance once the businesshas been launched.All staff providing SEMP services must:(i)have at least a high school equivalency diploma or one year of workexperience providing vocational or pre-vocational services toindividuals with disabilities; and(ii)complete an OPWDD approved vocational rehabilitation orsupported employment training program.Supported Employment Service Delivery Plan.(i)The service provider must develop a supported employmentservice delivery plan that guides the delivery of the service for eachindividual receiving SEMP services.Note: New material is underlined and deleted material is in [brackets].-4-

Final Regulations: SEMP RedesignEffective Date: July 1, 2015(6)(ii)The plan must identify the responsibilities of the individual and theservice provider necessary for delivery of the service and theachievement of the individual’s employment goals.(iii)The plan must be documented, reviewed, and updated inaccordance with section 635-99.1 of this Part.Self-Directed Services. Intensive and Extended SEMP may be provided asself-directed services to an individual who hires his or her own SEMPsupport staff. Section 635-10.5(d) is amended as follows:(d)Supported employment (SEMP) services prior to July 1, 2015. (For SEMPprovided on and after July 1, 2015, see subdivision 635-10.5(af) of this section.) A new subdivision 635-10.5(af) is added as follows:(af)Reimbursement for supported employment services provided on and after July 1,2015.(1)General provisions.(i)SEMP may be delivered in two phases and provided to a singleindividual or small group of individuals as follows:(a)(b)Intensive SEMP.(1)Intensive - 1, which is Intensive SEMP provided to oneindividual; or(2)Intensive - 2, which is Intensive SEMP provided to agroup of 2-8 individuals.Extended SEMP.(1)Extended - 1, which is Extended SEMP provided toone individual; or(2)Extended - 2, which is Extended SEMP provided to agroup of 2-8 individuals.Note: New material is underlined and deleted material is in [brackets].-5-

Final Regulations: SEMP RedesignEffective Date: July 1, 2015(2)(ii)Reimbursement is not permitted for delivery of Intensive andExtended SEMP on the same date of service.(iii)Reimbursement is contingent on prior approval from OPWDD forindividuals who enroll in SEMP on or after July 1, 2015.(iv)Prior approval from OPWDD is contingent on an individual'seligibility for Intensive or Extended SEMP, in accordance withparagraphs (2) and (3) of this subdivision, at the time of enrollment.(v)Prior approval from OPWDD is not required for an individual whowas enrolled in SEMP prior to July 1, 2015 and remainedcontinuously enrolled in SEMP on and after July 1, 2015.Intensive SEMP.(i)Reimbursement for Intensive SEMP is contingent on an individual'seligibility for services based on the following eligibility criteria:(a)the individual has expressed an interest in competitiveemployment, and competitive employment is identified as agoal in the individual’s individualized service plan (ISP);(b)the individual is not employed or has been employed for lessthan 365 days; and(c)the individual needs Intensive SEMP in order to obtainemployment, become stabilized in employment, or achieveemployment goals identified in the ISP.(ii)Limits on hours of service and the term of service delivery forreimbursement of Intensive SEMP. Unless OPWDD authorizes anextension of the number of hours or length of the term of service, nomore than 250 hours of service across 365 days can be reimbursedfor an individual receiving Intensive SEMP. These limits applywhether such services are delivered to an individual (Intensive -1)or a group (Intensive - 2) or a combination of both (Intensive -1 andIntensive -2).(iii)An individual may move between individual and group employmentas needed.Note: New material is underlined and deleted material is in [brackets].-6-

Final Regulations: SEMP RedesignEffective Date: July 1, 2015(3)Extended SEMP.(i)(4)Reimbursement for Extended SEMP is contingent on an individual'seligibility for services based on the following criteria:(a)the individual has expressed an interest in competitiveemployment, and competitive employment is identified as agoal in the individual’s individualized service plan (ISP);(b)the individual is currently employed in an integratedworkplace and earning at least the state or federal minimumwage (whichever is greater) or is self-employed; and(c)the individual needs Extended SEMP in order to maintainemployment and achieve employment goals identified in theISP.(ii)Limits on hours of service and term of service delivery for ExtendedSEMP. Unless OPWDD authorizes an extension of the number ofhours of service, no more than 200 hours of service across a 365day time period can be reimbursed for an individual receivingExtended SEMP. These limits apply whether such services aredelivered to an individual (Extended -1) or a group (Extended - 2) ora combination of both (Extended -1 and Extended - 2).(iii)An individual may move between individual and group employmentas needed in Extended SEMP.Extension of SEMP. Intensive or Extended SEMP services may beextended with prior authorization from OPWDD.(i)If the service provider considers that an individual needs more than365 days of Intensive SEMP and/or additional hours of Intensive orExtended SEMP, the service provider may submit a written requestto OPWDD, in the form and format specified by OPWDD, for suchextension of services.(ii)OPWDD’s decision on the extension request will be based on thefollowing:(a)For Intensive SEMP:Note: New material is underlined and deleted material is in [brackets].-7-

Final Regulations: SEMP RedesignEffective Date: July 1, 2015(b)(1)whether the individual has recently become employedand needs an extension of Intensive SEMP servicesor has potential to be hired within 60 days of thescheduled completion of the Intensive SEMP phase;(2)whether there is (or will be) a break in the provision ofthe SEMP service due to an individual’s extendedmedical absence or personal hardship;(3)whether unforeseen circumstances prevent (or willprevent) the service provider from maintainingcontinuous delivery of the SEMP service; or(4)whether the extension is in the best interests of theindividual.For Extended SEMP:(1)whether changes in the individual's job responsibilitieswarrant additional hours of job coaching, training, andplanning within the work environment;(2)whether changes in the individual's workplacesupports warrant additional hours to develop newsupports in the work environment; or(3)whether the extension is in the best interests of theindividual.(5)Unit of service. The unit of service for Intensive and Extended SEMP isone hour, which equals 60 minutes, and is reimbursed in 15-minuteincrements. When there is a break in the service delivery during a singleday, the service provider must combine the durations of the continuousperiods/sessions of each specific type of service provision for billingpurposes (e.g., the durations of each Intensive -1session provided withinone day must be combined, but Intensive -1 and Intensive - 2 sessionsprovided within one day must not be combined).(6)Billable service time. Final Regulations: SEMP RedesignEffective Date: July 1, 2015(7)(8)(i)time when the service provider is providing SEMP as specified inthis subpart in accordance with the individual's supportedemployment service delivery plan; and(ii)time when service provider is developing the supportedemployment service delivery plan.Restrictions on billable service time.(i)Time spent receiving another Medicaid service must not be countedtoward SEMP service time in instances when the Medicaid serviceis received simultaneously with one or more allowable SEMPactivities (see subdivision 635-10.4(j) of this subpart) provideddirectly to the individual. An exception is the provision of MedicaidService Coordination, which may be received simultaneously withall allowable SEMP activities.(ii)If an individual is in the Intensive phase of SEMP, the individual isnot eligible to receive the Pathway to Employment service becauseallowable activities in Intensive SEMP and the Pathway toEmployment service are the same.Documentation.(i)For an individual who was enrolled in SEMP prior to July 1, 2015and remained continuously enrolled in SEMP on and after July 1,2015, "monthly" SEMP identified in the individual's ISP is deemedto be "hourly" SEMP effective July 1, 2015. The service providermust identify the unit of service change in the ISP on the date of thenext ISP review, or December 31, 2015, whichever is sooner.(ii)The service provider must maintain documentation to show that anindividual received SEMP services in accordance with his or herISP and supported employment service delivery plan.(iii)For each continuous SEMP service session, the service providermust document date of service, the service start and stop times, theratio of individuals to staff at the time of the SEMP serviceprovision; and the allowable activities delivered during the SEMPservices session.Note: New material is underlined and deleted material is in [brackets].-9-

Final Regulations: SEMP RedesignEffective Date: July 1, 2015(iv)(9)The service provider must maintain documentation that there is nofunding available for the individual’s SEMP services from the NYSACCES-VR (Adult Career and Continuing Education ServicesVocational Rehabilitation).Fee setting. The fees for SEMP services are in 10 NYCRRsubpart 86-13. Subdivision 635-12.3(f) is amended as follows:(f)The provider shall inquire whether an individual applying for services is already[receiving or also applying for] enrolled in supported employment servicesor applying for or enrolled in respite services. If the individual is[receiving] enrolled in supported employment services or [also] applying for orenrolled in [either or both of those] respite services, the provider shall complywith its obligations as specified in section 635-12.12(c) and/or (d) of this Subpart,as applicable. Section 635-12.12 is amended as follows:Prior to July 1, 2015, the limited exception provisions in this section wereapplicable to individuals applying for supported employment services who metspecified criteria. The limited exception is no longer permitted for individualsenrolling in supported employment services on and after July 1, 2015.(a)The provisions of sections 635-12.2--635-12.10 of this Subpart are not applicablein the [following] circumstances in either paragraph (1) or paragraph (2) of thissubdivision:[(1)The individual is applying for or receiving supported employment servicesand the individual is not receiving any of the following services: Medicaidservice coordination, day treatment services, the following HCBS waiverservices: residential habilitation services (community (in a communityresidence), IRA, or family care community rehabilitation services, dayhabilitation services, prevocational services, or respite services; blendedservices or comprehensive services. In addition, at no time on or afterMarch 15, 2010 may the individual have full Medicaid coverage and beenrolled in the HCBS waiver.](1)Supported employment services. The individual is enrolled in supportedemployment services and all of the following conditions are met:Note: New material is underlined and deleted material is in [brackets].-10-

Final Regulations: SEMP RedesignEffective Date: July 1, 2015(i)(ii)Either:(a)the individual was enrolled in supported employmentservices prior to July 1, 2015, and was continuously enrolledin supported employment services with the same provider onand after July 1, 2015; or(b)the individual was enrolled in supported employmentservices prior to July 1, 2015, and on or after July 1, 2015the provider downsized or eliminated the provision ofsupported employment services, causing the individual todis-enroll in that provider’s supported employment servicesand re-enroll in supported employment services from thesame or a different provider.The individual is not enrolled in any of the following services:(a)Medicaid Service Coordination;(b)day treatment services;(c)residential habilitation provided in an individualizedresidential alternative (IRA), community residence (CR), orfamily care home;(d)hourly community habilitation;(e)day habilitation services;(f)site based prevocational services;(g)community prevocational services;(h)respite services.Note: This list of services previously included at-home residentialhabilitation, community habilitation phase II, and blendedand comprehensive services, which have been discontinued.(iii)The individual was not enrolled in the HCBS Waiver at any time onor after March 15, 2010.Note: New material is underlined and deleted material is in [brackets].-11-

Final Regulations: SEMP RedesignEffective Date: July 1, 2015[(2)The individual is applying for or receiving respite services and theindividual is not receiving any of the following services: Medicaid servicecoordination, day treatment services, the following HCBS waiver services:residential habilitation services (community (in a community residence),IRA, or family care community rehabilitation services, day habilitationservices, prevocational services, or supported employment services; orblended services or comprehensive services. In addition, at no time on orafter March 15, 2010 may the individual have full Medicaid coverage andbe enrolled in the HCBS waiver.](2)Respite services.
