Section A – Authority Interaction1.0GENERAL.1.1Purpose. The purpose of this section of the Maintenance Annex Guidance (MAG) is todefine the procedures and activities of the Federal Aviation Administration (FAA), theEuropean Union Aviation Safety Agency (EASA), and the Aviation Authorities (AA)required to implement the Agreement Between the United States of America and theEuropean Union on Cooperation in the Regulation of Civil Aviation Safety (theAgreement) as well as its Maintenance Annex (Annex 2). As described in Annex 2,Article 4.1, EASA, the FAA, and the AAs, where applicable, shall accept each other’sinspections and monitoring of repair stations/maintenance organizations for findings ofcompliance with their respective requirements as the basis for the issuance and continuedvalidity of certificates. Within Section A, repair stations certificated under Title 14 of theCode of Federal Regulations (14 CFR part 145) and maintenance organizationscertificated under Commission Regulation (EU) No 1321/2014 Annex II (EASA Part145) are referred to as maintenance organizations.1.1.1This MAG is subdivided into Sections A, B, C, D, and E. The MAG detailsEASA, FAA, and applicant actions required to be taken in order for anFAA-certificated 14 CFR part 145 repair station primarily located in the UnitedStates to be approved to EASA Part-145; and for an EASA Part-145 ApprovedMaintenance Organization (AMO) to be approved to 14 CFR part 145, inaccordance with the Agreement.1.1.2The United States (U.S.) requirements for maintenance at U.S.-based repairstations are contained in 14 CFR part 145 and 14 CFR part 43. Guidance material,policy, and procedures are contained in FAA orders, notices, policy memoranda,and advisory circulars.1.1.3The European Union (EU) requirements for maintenance are contained inRegulation (EU) 2018/1139 of the European Parliament and of the Council of 4July 2018, EASA Part-145, and associated EASA Acceptable Means ofCompliance (AMC) documents and guidance material.1.1.4The FAA and EASA have established the differences between EASA Part-145and 14 CFR part 145. These differences are listed as Special Conditions in Annex2 as agreed between the EU and the United States. As a result, a U.S.-based,FAA-certificated 14 CFR part 145 repair station, when in compliance withEASA-published maintenance Special Conditions, may apply for an EASAPart-145 approval. An EU-based, EASA Part-145 AMO, when in compliancewith published FAA maintenance Special Conditions, may apply for a 14 CFRpart 145 approval.1.1.5The Agreement permits reliance on each other’s surveillance systems to thegreatest extent possible. The FAA and EASA have agreed to conduct surveillanceU.S.-EU MAG, Section AMarch 19, 2021page 1

of each other’s compliance with the Special Conditions. For the FAA, thefrequency of surveillance is based on the current edition of FAA Order 8900.1,Flight Standards Information Management System (FSIMS). Specifically,Volume 10 provides the policy for developing and executing baseline risk-basedsurveillance activities. The Safety Assurance System (SAS) uses risk to modifythe work program using risk-based concepts that allow the aviation safetyinspector (ASI) to target specific areas of elevated risk. For EASA and the AAs,the frequency of surveillance is published in EASA Part-145, Sections B and C.1.2Communications and Changes to Maintenance Organization Approval OversightSystems (Annex 2, Article 4.10).1.2.1The FAA, EASA, and AA shall keep each other informed of significant changeswithin those systems, such as:a. Statutory responsibilities;b. Organizational structure (e.g., personnel, management structure, technicaltraining, office location); andc. Revisions to maintenance organization approval oversight systems standardsor procedures.1.2.2Revision by the FAA, EASA, or an AA to its regulations, acceptable means ofcompliance, guidance material, policies, procedures, or organizational structure,which may affect the basis and the scope of this guidance, shall be notified in amanner consistent with Annex 2, Article 4.10. Accordingly, upon notice of suchchanges by the FAA or EASA, either agency may request a meeting to review theneed for amendment to this MAG.NOTE: The FAA and EASA shall biennially identify regulatory changesaffecting the Agreement and/or the MAG. Regulatory comparison andsubsequent changes identified will be notated on a mutually shareddocument, such as a spreadsheet. Refer to Section A, Appendix 7,regarding the FAA and EASA class and rating comparisons.1.2.3Changes to the MAG shall be implemented, as applicable, within 120 days afterthe signature date of the change identified in Section E. Changes to the MAG areexpected to be reflected in EASA, FAA Flight Standards Office (FSO), and AAprocedures and policies, as applicable, in order to ensure a consistent andharmonized approach at all levels.1.2.4The list of organizations responsible for the various technical aspects of Annex 2,including communication of urgent issues, is located in Section A, Appendix 1.1.2.5In case of an external audit by a U.S. or EU official body (e.g., the Office ofInspector General), the FAA and EASA shall coordinate the audit activities. points of contact to coordinate these activities will be the Aircraft MaintenanceDivision (AFS-300) and the EASA Standarisation Department.1.3Training. In order to comply with the MAG and the requirements of Annex 2, FAA ASIswith assigned repair stations holding an EASA approval, EASA/AA and FAA inspectorsin charge of Sampling Inspection System (SIS) visits, and AA inspectors with assignedAMOs holding FAA approval shall receive initial training upon oversight assignment andrecurrent training every 2 years thereafter.1.3.1The initial training and recurrent training will cover the Agreement, its applicableannexes, the MAG (including applicable Special Conditions), and the certificationprocedures contained in the MAG. All training provided (initial and recurrent)should be appropriately recorded in the individual training records of the affectedstaff.1.3.2Recurrent training should be implemented before the 2-year training requirementif there are changes or revisions to the MAG prior to the recurrent trainingtimeline. The methods used for training are defined by the Technical Agents andthe AAs.1.4Technical Consultations. The FAA and EASA Directors of Flight Standards, ordesignees, shall consult annually to review progress on implementation and proposechanges as needed. This will include discussions on technical issues and resolution oftechnical disagreements.1.5Aircraft Repair Station Security. On January 13, 2014, the Transportation SecurityAdministration’s (TSA) final repair station security rule was published (Title 49 of theUnited States Code § 44924). The rule became effective on February 27, 2014. After thiseffective date, the FAA resumed the application process of foreign repair stationspursuing certification under 14 CFR part 145. The FAA shall notify the TSA when anFAA 14 CFR part 145 certification has concluded and an Air Agency Certificate isissued.1.6Interpretations and Resolution of Issues between the FAA and EASA.1.6.1The FAA and EASA shall address interpretations and resolve issues throughconsultation or any other mutually agreed-upon means. Every effort will be madeto resolve the issues at the lowest possible level.1.6.2To address interpretations and resolve issues, the FAA and EASA shall use thefollowing processes, as applicable. (If an AA is involved, EASA shall ensureadequate coordination.)1.6.2.1Facilities.a. For facilities located in the United States, the first point of contactfor the FAA is the appropriate FAA Coordinator (AFS-300) whoshall coordinate issues with the EASA FS-designated Focal Point.U.S.-EU MAG, Section AMarch 19, 2021page 3

b. For facilities located in Europe, the first point of contact is the AA,who shall coordinate issues with the FAA Coordinator (AFS-54) andshall copy the EASA FS-designated Focal Point.1.6.2.2Resolution of Issues. If resolution cannot be reached, the issue must beexpeditiously raised to:a. The FAA National Coordinator (AFS-300), who shall consult withthe EASA FS-designated Focal Point.b. The EASA FS-designated Focal Point, shall consult with the FAANational Coordinator (AFS-300).1.6.2.3Elevating Issues. If resolution cannot be reached, the issue must beexpeditiously raised to:a. The FAA Executive Director of Flight Standards, who may consultwith the EASA Director of Flight Standards.b. The EASA Director of Flight Standards, who may consult with theFAA Executive Director of Flight Standards.1.71.6.3Issues that cannot be satisfactorily resolved between the FAA and the EASADirectors of Flight Standards on an ad hoc basis will be added to the agenda forthe next formal Joint Maintenance Coordination Board (JMCB) meeting forfurther consideration.1.6.4Issues that cannot be resolved by the JMCB must be forwarded to the BilateralOversight Board (BOB) for resolution. (The BOB is a joint executive-level groupresponsible for ensuring the effective functioning of the Agreement.)Joint Maintenance Coordination Board Meetings. The JMCB under the leadership ofthe FAA and EASA Directors of Flight Standards shall meet at least annually to reviewprogress and propose changes to this MAG.
