Eligibility and EnrollmentSection IUNIVERSITY OF CALIFORNIA ELIGIBILITY,ENROLLMENT, TERMINATION AND PLANADMINISTRATION PROVISIONSJanuary 1, 2019Section IIThe ARAG Legal Insurance PlanThe University establishes its own legal plan eligibility,enrollment and termination criteria based on the Universityof California Group Insurance Regulations and anycorresponding Administrative Supplements.The person must be an Insured when each service is furnished.A. Benefits Under The ARAG Legal Insurance PlanConsist of Three PartsPart I – Legal RepresentationA. EligibilityEmployeesFor eligibility and enrollment information, go to esFor eligibility and enrollment information, go to ey’s Fees for most covered (and not excluded)services are 100% paid-in-full when using a NetworkAttorney. Or use a non-network attorney and be reimbursedup to the non-network attorney benefit. For a detaileddescription of services and what the benefits are, seeSection III. There is a maximum reimbursement amount(see “List of Benefits”). Not all charges are eligible and somecharges are eligible only to a limited extent.There is also a Conversion Plan that may apply aftera person ceases to be covered under The ARAG LegalInsurance Plan (see conversion).Part II – Telephone Legal Advice and ConsultationB. EnrollmentEmployeesFor eligibility and enrollment information, go to esFor eligibility and enrollment information, go to ensation-andbenefits/eligibility/index.html.This part of the plan provides services to Insureds through aTelephone Network Attorney. There is no Network AttorneyFee for these services. The preventive legal servicesprovided by the Telephone Network Attorney are thosecontained in the List of Benefits that involve the Insured’slegal affairs, and are not services that involve a visit to anAttorney’s office or are otherwise not covered. The servicesdescribed will be provided to an Insured at the discretion ofthe Telephone Network Attorney. The Telephone NetworkAttorney will not charge an Insured for these services.Telephone Legal Advice and Consultation are not availablefor matters outside the jurisdiction of the United States.Part III ‑Additional BenefitsOnline Legal Tools and ResourcesThis part of the plan provides Insureds the opportunity toreceive services online. There is no additional fee for theseservices.Caregiving ServicesThis part of the benefit offers access to Network Attorneysand other professionals who can help find caregivingoptions for your parents or grandparents. Additional Benefits Assess your parent’s or grandparent’s eldercare needs(e.g. cooking, cleaning, medications, transportation, homehealth, assisted-living and nursing home facilities), answerquestions, provide information and resources, and helpdevelop care plans.Specialists assist you in canceling and reissuingpersonal documents such as credit cards, driver’slicense, Social Security cards, etc. - due to lost or stolenwallet or identity documents. Identity Theft Insurance: Should you become a victimof identity theft, Identity Theft Insurance providescoverage up to 1 million for expenses associated withrestoring your identity. (Eligibility, coverage, limitationsand exclusions are governed by a separate MasterPolicy. Please see the Identity Theft Plan Summary fordetails.) Send a personalized information guide with a list ofassisted living facilities, nursing home or healthcareagencies, including comparative quality-of-care ratingsand reports on thousands of facilities and agencies. Search for available assisted living facilities, nursinghomes, home healthcare agencies and adult day careproviders and their rates, then negotiate discounts forfacilities when available.In order to use the following services, you will need to log inand establish an online monitoring account.Your parents/grandparents will also have access to aNetwork Attorney for legal advice on elder law issues (e.g.,Medicare/Social Security benefits, estate planning, realestate). They can also meet with a Network Attorney once ayear for an annual legal check-up. Single-Bureau Credit Monitoring: Services designatedto track and inform you of any activities or changes toyour credit - including loan applications, credit cardactivations, delinquencies, etc.Tax ServicesThis part of the plan provides you with year-round access toexperienced tax specialists. You can call toll-free for a oneon-one consultation if you have questions or need adviceregarding your personal, non-business related tax matters.You’ll also benefit from discounted personal tax returnpreparation services. Internet Surveillance: Service that monitors thousandsof websites and millions of data points, alerting you ifyour personal information is found being bought or soldonline. Child Identity Monitoring: Service that monitors yourminor child’s personal information and Social Securitynumber for activity on the dark web. It also monitors aminor child’s Social Security number to identify creditinformation associated with his or her identity.Identity Theft ProtectionA service that gives you access to: Identity Theft Materials, including: Change of Address Monitoring: Alerts you if a change ofaddress request has been submitted to the U.S. PostalService for your address.-- An Identity Theft Prevention Kit to help protectyourself from becoming a victim.-- An Identity Theft Victim Action Kit to help speed yourrecovery should you become a victim of identity theft.-- A tracking document to help you keep track of phonecalls, e-mails and letters for attorneys.-- An Identity Theft Affidavit to help you report youridentity theft to necessary parties. Identity Theft Case Specialists who will help youdetermine appropriate steps to begin recovery andmonitor the progress. Full-Service Identity Restoration: Identity TheftRestoration Specialists provide full-service identityrestoration services, including specialized limitedpower of attorney to work on your behalf to restoreyour identity. Lost Wallet Services: Identity Theft Restoration 2018 ARAG North America, Inc.Reduced Fee Benefit for Non-Covered MattersThis part of the plan offers reduced fees of at least 25% offthe Network Attorney’s normal hourly rate, for services notcovered and not excluded.Reduced Contingency FeeThis part of the plan provides caps on the percentage of anysettlement arrangements on contingency fee cases. Feesfor Network Attorney fees are capped at 25% for initial trial/settlement and 30% for subsequent appeal proceedings.B. Pre-Existing ConditionsAny legal matter that occurs or is initiated prior to theeffective date of an Insured will be considered excluded andno benefits will apply. Schedule of Benefitsby this policy whose initiation date will be considered theearlier of the date (a) written notice of a legal dispute is sentor filed by you or received by you; or (b) a ticket or citation isissued; or (c) an attorney is hired.C. Freedom of Choice of an AttorneyAn Insured may choose any Attorney to provide LegalRepresentation. Except for the provisions of the Benefitsand the requirement of information for claim processing,neither ARAG nor the University of California will interferewith the Insured’s Attorney. The Attorney’s obligation willbe only with and to the Insured. If an Insured chooses touse a Non-Network Attorney the Non-Network Attorneyindemnity benefit schedule will apply.D. ConfidentialityAn Insured is assured full confidentiality with respect tocalls and problems discussed with any Service Provideror Attorney with respect to claims submitted for LegalRepresentation under The ARAG Legal Insurance Plan.G. Extension of BenefitsIf coverage for you or one of your covered dependents isterminated, your legal services coverage (except TelephoneLegal Advice and Consultation) will be extended to coverlegal services in progress prior to the date the coverageterminated until the services are completed.H. Reimbursement of Legal FeesComplete and sign the Enrollment Form, (and a blankvoided check or required savings account information ifchoosing the bank draft option), and mail to: ARAG, ATTN:Eligibility, 500 Grand Avenue, Suite 100, Des Moines, IA50309 or fax to 515-246-8816.The Benefit amount payable for legal services furnished to anInsured is the amount of the eligible charges for those legalservices, but not more than these limits.ARAG must receive these materials – which includearrangements for premium payment within 90 days of thedisqualifying event. For Legal Representation by a Network Attorney, see thelimits determined from the Schedule of Benefits list oflegal services in Section III. For Legal Representation by a Non-Network Attorney,see the indemnity reimbursement amounts shown inthe Schedule of Benefits in Section III. Only one Benefit shall be payable for all legal servicesarising out of a single cause of action or event resultingin the need for the legal services. ARAG will decidewhich Benefit shall be payable.If a court awards Attorney fees to an Insured in connectionwith covered Benefits, ARAG may require the Insured toassign all rights of recovery of the legal fees to the extentof the payment that was made by them. If an assignment issought, an Insured must cooperate with ARAG.F. Eligible ChargesA charge is an eligible charge if all these conditions are met: It is for a covered legal service furnished to an Insuredwhile the plan is in effect; The service involves an Insured’s personal legal mattersand is contained in the List of Benefits; and The person is an Insured when the service is furnished. 2018 ARAG North America, Inc.Section IIISchedule of BenefitsNote: You must have family participation in order for youreligible dependents to utilize the Schedule of Benefits.A. BenefitsThe Schedule of Benefits applies to an Insured when theSchedule of Benefits specifically states that Benefit. Itincludes only Benefits included in the list. However, if thelaw of jurisdiction where the Benefit is furnished uses legalterms that differ from those in the list provided, ARAG willdetermine the equivalent Benefit from the list provided.The benefit year is a 12-month period based on a calendaryear. A Benefit may be furnished for more than one insuredin a Family Unit with respect to the same event or cause ofaction resulting in the need for that Benefit. In that case,only one Benefit will be considered to have been furnished.If a Non-Network Attorney is used, the amounts payableunder that Benefit may be up to the limits on the followingschedule.Page 6 of 39Rev 5/18 200162
Simply call an attorney for an appointment. When you call, identify yourself as a member of your group'slegal plan. If you have a Case Confirmation Number, you should provide it to the Network Attorney. If not,the Network Attorney may call us to confirm your coverage and then proceed to provide services.
