14NEWSPAPERS ARE GOOD BUSINESS IN WEST VIRGINIALegal Advertising in West VirginiaIn more than 400 circumstances,actions by state or local government,private companies, institutions orindividuals require the publication of aLegal Advertisement.The basic state law covering LegalAdvertisements is found in Chapter 59,Article 3 of the Code of West Virginia.Requirements for publication of aspecific Legal Advertisement usuallyare found in the statutes governinga particular action, circumstance orgovernmental agency.General terms, rates and rulesn Only daily or weekly newspaperswhich meet the requirements set forthin Chapter 59, Article 3 are “qualified”to publish Legal Advertisements underthe scope of the Code. Advertisers areadvised to make sure a newspaper is“qualified” before placing required legaladvertisements in that publication.A “writ of mandamus” procedureis set forth in Chapter 59, Article 3 inwhich governmental agencies andothers can be compelled by courtorder to publish a required LegalAdvertisement which has not beenpublished.nn Rates which qualified newspapersmay charge for Legal Advertisementsare set by the state Legislature. Theserates are based on the paid circulationtime are charged on the basis of 100%for first publication and 75% for eachsubsequent publication.DeadlinesLegal Ads, particularly longerones, require additional timefor typesetting and proofreading.
