East Moore Water District (Owner)5227 US 15/501, Carthage, NC 28327IFB 2021‐05, Morrison Bridge Road Water Main ReplacementADVERTISEMENT FOR BIDSSealed Bids for the construction of the Morrison Bridge Water Main Replacement will be received, atthe office of the East Moore Water District, 5227 US 15/501, Carthage, NC 28327, Attention: TerraVuncannon, until 4:00 pm local time on Thursday, December 17th, 2020 at which time the Bids receivedwill be publicly opened and read aloud.All questions must be submitted in writing to tvuncannon@moorecountync.gov no later than 10:00 amMonday, December 14th, 2020. No oral questions will be accepted.Due to the COVID 19 event all attendees MUST adhere to current County, State and CDC guidelines forprotective measures. Attendees must wear a face covering and maintain social distance protocol.The project includes the installation of approximately 7,800 feet of 8‐inch water line and appurtenancesin Moore County. Additionally, in Harnett County, the project includes approximately 300 feet of 4‐inchwater line installed by directional bore, and roughly 100 feet of 6‐inch water line and a new meter vault.The Issuing Office for the Bidding Documents is: LKC Engineering, PLLC, located at 140 Aqua Shed Court,Aberdeen, NC 28315, 910‐420‐1437. Prospective Bidders may obtain copies of the Bidding Documentsfrom the Issuing Office as described below.Bidding Documents also may be examined at Carolinas AGC (plans available at www.cagc.org onIBuild), FW Dodge/McGraw Hill Dodge, Minority Economic Development Center: Charlotte, HispanicContractors Association of the Carolinas: Charlotte; and the office of the Engineer, LKC Engineering,PLLC, located at 140 Aqua Shed Court, Aberdeen NC 28315, on Mondays through Fridays between thehours of 9:00 am and 3:30 pm.Bidding Documents may be obtained from the Issuing Office during the hours indicated above. BiddingDocuments are available as portable document format (PDF) files for a non‐refundable charge of 150.00. Alternatively, printed Bidding Documents may be obtained from the Issuing Office uponreceipt of payment for the Bidding Documents. The non‐refundable cost of printed Bidding Documentsis 150.00 per set, which includes shipping, payable to LKC Engineering. Upon Issuing Office’s receipt ofpayment, printed Bidding Documents will be sent via the prospective Bidder’s delivery method ofchoice; the shipping charge will depend on the shipping method chosen. The date that the BiddingDocuments are transmitted by the Issuing Office will be considered the prospective Bidder’s date ofreceipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from theIssuing Office. ARTICLE 1 – DEFINED TERMS1.01Terms used in these Instructions to Bidders have the meanings indicated in the GeneralConditions and Supplementary Conditions. Additional terms used in these Instructions toBidders have the meanings indicated below:A.Issuing Office – The office from which the Bidding Documents are to be issued.ARTICLE 2 – COPIES OF BIDDING DOCUMENTS2.01Complete sets of the Bidding Documents may be obtained from the Issuing Office in the numberand format stated in the advertisement or invitation to bid.2.02Complete sets of Bidding Documents shall be used in preparing Bids; neither Owner norEngineer assumes any responsibility for errors or misinterpretations resulting from the use ofincomplete sets of Bidding Documents.2.03Owner and Engineer, in making copies of Bidding Documents available on the above terms, doso only for the purpose of obtaining Bids for the Work and do not authorize or confer a licensefor any other use.ARTICLE 3 – QUALIFICATIONS OF BIDDERS3.01To demonstrate Bidder’s qualifications to perform the Work, after submitting its Bid and withinfive days of Owner’s request, Bidder shall submit (a) written evidence establishing itsqualifications such as financial data, previous experience, and present commitments, and (b) thefollowing additional information:A.Evidence of Bidder’s authority to do business in the state where the Project is located.B.Bidder’s state or other contractor license number.C.Subcontractor and Supplier qualification information; coordinate with provisions of Article12 of these Instructions, “Subcontractors, Suppliers, and Others.”D.EJCDC C-451 Qualifications Statement.3.02A Bidder’s failure to submit required qualification information within the times indicated maydisqualify Bidder from receiving an award of the Contract.3.03No requirement in this Article 3 to submit information will prejudice the right of Owner to seekadditional pertinent information regarding Bidder’s qualifications.3.04Bidder is advised to carefully review those portions of the Bid Form requiring Bidder’srepresentations and certifications.ARTICLE 4 – SITE AND OTHER AREAS; EXISTING SITE CONDITIONS; EXAMINATION OF SITE; OWNER’SSAFETY PROGRAM; OTHER WORK AT THE SITE4.01Site and Other AreasA.The Site is identified in the Bidding Documents. By definition, the Site includes rights-ofway, easements, and other lands furnished by Owner for the use of the Contractor. 4.02Existing Site ConditionsA.Subsurface and Physical Conditions; Hazardous Environmental Conditions1.The Supplementary Conditions identify:a.those reports known to Owner of explorations and tests of subsurface conditionsat or adjacent to the Site.b.those drawings known to Owner of physical conditions relating to existing surfaceor subsurface structures at the Site (except Underground Facilities).c.reports and drawings known to Owner relating to Hazardous EnvironmentalConditions that have been identified at or adjacent to the Site.d.Technical Data contained in such reports and drawings.e.There is no subsurface report for this project.2.Owner will make copies of reports and drawings referenced above available to anyBidder on request. These reports and drawings are not part of the ContractDocuments, but the Technical Data contained therein upon whose accuracy Bidder isentitled to rely, as provided in the General Conditions, has been identified andestablished in the Supplementary Conditions. Bidder is responsible for anyinterpretation or conclusion Bidder draws from any Technical Data or any other data,interpretations, opinions, or information contained in such reports or shown orindicated in such drawings.3.If the Supplementary Conditions do not identify Technical Data, the default definitionof Technical Data set forth in Article 1 of the General Conditions will apply.4.Geotechnical Baseline Report: The Bidding Documents contain a Geotechnical BaselineReport (GBR). The GBR describes certain select subsurface conditions that areanticipated to be encountered by Contractor during construction in specified locations(“Baseline Conditions”). The GBR is a Contract Document.The Baseline Conditions in the GBR are intended to reduce uncertainty and the degreeof contingency in submitted Bids. However, Bidders cannot rely solely on the BaselineConditions. Bids should be based on a comprehensive approach that includes anindependent review and analysis of the GBR, all other Contract Documents, TechnicalData, other available information, and observable surface conditions. Not all potentialsubsurface conditions are baselined.Nothing in the GBR is intended to relieve Bidders of the responsibility to make theirown determinations regarding construction costs, bidding strategies, and Bid prices,nor of the responsibility to select and be responsible for the means, methods,techniques, sequences, and procedures of construction, and for safety precautionsand programs incident thereto.B.Underground Facilities: Information and data shown or indicated in the Bidding Documentswith respect to existing Underground Facilities at or contiguous to the Site are set forth inthe Contract Documents and are based upon information and data furnished to Owner andEngineer by owners of such Underground Facilities, including Owner, or others.C.Adequacy of Data: Provisions concerning responsibilities for the adequacy of data furnishedto prospective Bidders with respect to subsurface conditions, other physical conditions, andUnderground Facilities, and possible changes in the Bidding Documents due to differing orunanticipated subsurface or physical conditions appear in Paragraphs 5.03, 5.04, and 5.05EJCDC C-200, Suggested Instructions to Bidders for Construction Contracts.Copyright 2013 National Society of Professional Engineers, American Council of Engineering Companies,and American Society of Civil Engineers. of the General Conditions. Provisions concerning responsibilities for the adequacy of datafurnished to prospective Bidders with respect to a Hazardous Environmental Condition atthe Site, if any, and possible changes in the Contract Documents due to any HazardousEnvironmental Condition uncovered or revealed at the Site which was not shown orindicated in the Drawings or Specifications or identified in the Contract Documents to bewithin the scope of the Work, appear in Paragraph 5.06 of the General Conditions.4.034.04Site Visit and Testing by BiddersA.Bidder shall conduct the required Site visit during normal working hours, and shall notdisturb any ongoing operations at the Site.B.Bidder is not required to conduct any subsurface testing, or exhaustive investigations ofSite conditions.C.On request, and to the extent Owner has control over the Site, and schedule permitting,the Owner will provide Bidder access to the Site to conduct such additional examinations,investigations, explorations, tests, and studies as Bidder deems necessary for preparing andsubmitting a successful Bid. Owner will not have any obligation to grant such access if doingso is not practical because of existing operations, security or safety concerns, or restraintson Owner’s authority regarding the Site.D.Bidder shall comply with all applicable Laws and Regulations regarding excavation andlocation of utilities, obtain all permits, and comply with all terms and conditions establishedby Owner or by property owners or other entities controlling the Site with respect toschedule, access, existing operations, security, liability insurance, and applicable safetyprograms.E.Bidder shall fill all holes and clean up and restore the Site to its former condition uponcompletion of such explorations, investigations, tests, and studies.Owner’s Safety ProgramA.4.05Site visits and work at the Site may be governed by an Owner safety program. As theGeneral Conditions indicate, if an Owner safety program exists, it will be noted in theSupplementary Conditions.Other Work at the SiteA.Reference is made to Article 8 of the Supplementary Conditions for the identification of thegeneral nature of other work of which Owner is aware (if any) that is to be performed atthe Site by Owner or others (such as utilities and other prime contractors) and relates tothe Work contemplated by these Bidding Documents. If Owner is party to a writtencontract for such other work, then on request, Owner will provide to each Bidder access toexamine such contracts (other than portions thereof related to price and other confidentialmatters), if any.ARTICLE 5 – BIDDER’S REPRESENTATIONS5.01It is the responsibility of each Bidder before submitting a Bid to:A.examine and carefully study the Bidding Documents, and any data and reference itemsidentified in the Bidding Documents;B.visit the Site (other than the MANDATORY Site Visit), conduct a thorough, alert visualexamination of the Site and adjacent areas, and become familiar with and satisfy itself as toEJCDC C-200, Suggested Instructions to Bidders for Construction Contracts.Copyright 2013 National Society of Professional Engineers, American Council of Engineering Companies,and American Society of Civil Engineers. the general, local, and Site conditions that may affect cost, progress, and performance ofthe Work;C.become familiar with and satisfy itself as to all Laws and Regulations that may affect cost,progress, and performance of the Work;D.carefully study all: (1) reports of explorations and tests of subsurface conditions at oradjacent to the Site and all drawings of physical conditions relating to existing surface orsubsurface structures at the Site that have been identified in the SupplementaryConditions, especially with respect to Technical Data in such reports and drawings, and (2)reports and drawings relating to Hazardous Environmental Conditions, if any, at or adjacentto the Site that have been identified in the Supplementary Conditions, especially withrespect to Technical Data in such reports and drawings;E.consider the information known to Bidder itself; information commonly known tocontractors doing business in the locality of the Site; information and observationsobtained from visits to the Site; the Bidding Documents; and the Site-related reports anddrawings identified in the Bidding Documents, with respect to the effect of suchinformation, observations, and documents on (1) the cost, progress, and performance ofthe Work; (2) the means, methods, techniques, sequences, and procedures of constructionto be employed by Bidder; and (3) Bidder’s safety precautions and programs;F.agree, based on the information and observations referred to in the preceding paragraph,that at the time of submitting its Bid no further examinations, investigations, explorations,tests, studies, or data are necessary for the determination of its Bid for performance of theWork at the price bid and within the times required, and in accordance with the otherterms and conditions of the Bidding Documents;G.become aware of the general nature of the work to be performed by Owner and others atthe Site that relates to the Work as indicated in the Bidding Documents;H.promptl
