RULES AND REGULATIONS FOR MEMORIALPARKS/CEMETERIESPursuant to Article IV Sections (c) of Executive Order No. 648the following rules are hereby promulgated by the Housing and LandUse Regulatory Board,The issuance of a Development Permit by the HLURB orcity/municipality concerned shall cover approval of the design asrequired by these rules.Initial/operational clearance by theDepartment of Health to establish a memorial park/cemetery asrequired by P.D. 856 (Sanitation Code) shall be sought byowner/developer before applying for preliminary approval andoperational clearance from DOH prior to actual operation of thecemetery/memorial park.RULE IAPPROVAL OF MEMORIAL PARK/CEMETERY PLANSECTION 1. Scope of Application.These Rules nsion/alteration of existing memorial parks/cemeteries and otherprivate burial grounds.SECTION 2.Application for Approval of MemorialPark/Cemetery Plan. Every registered owner or developer of aparcel of land who wishes to convert the same into a memorialpark/cemetery shall apply with the Board or city/municipalityconcerned for the approval of the memorial park/cemetery plan byfiling the following:I.Approval of the Preliminary Development PlanFor all projects located in cities or municipalities with or withouta Land Use Plan and/or Zoning Ordinance, a preliminaryapproval shall be required. Copies of the following shall besubmitted in duplicate to the city/municipality concerned.A.Site Development Plan/Scheme to be approved shouldbe accessible to Persons With Disabilities (PWDs) in

accordance with BP 344 otherwise known as theAccessibility Law and the Magna Carta for disabledpersons (RA 7277) reflecting therein the layout of streets,pathways, plots, parking areas, support facilities,signages and other features in relation to existing sitecondition using a scale ranging from 1:200 to 1:2,000duly signed and sealed by a licensed environmentalplanner.B.2 sets of the following documents duly signed and sealedby a licensed geodetic engineer:1. Vicinity map/location map at a scale of 1:10,000 with aradius of 500 meters from the project site indicatingexisting utilities such as main traffic arteries, drainagesystem and outfall, etc. and community facilities likechurch, school and housing areas among others.2. Topographic Plan to include existing conditions asfollows:a. Property boundary lines, bearing and distances;b. Streets and easements, right-of-way width andelevation on and adjacent to the project;c. Ground elevation/contour of the site; for ground thatslopes less than 2%, indicate spot elevations at allbreaks in grade, along all drainage channels and atselected points not more than 30 meters apart in alldirections; for ground that slopes more than 2%,indicate contours with an interval of not more than0.5 meter for more detailed preparation of plansand construction drawings.d. Other conditions on the land: water courses,marshes, rock outcrops, wooded areas, isolatedpreservable trees 0.30 meters or more in diameter,houses and other significant features;

e. Proposed public improvements: highways or othermajor improvements planned by public authoritiesfor future construction on or near the project.C.Zoning Certification issued by HLURB or city/municipalityconcerned.D.Certified true copy of Environmental ComplianceCertificate (ECC) or Certificate of Non-Coverage (CNC)duly issued by the Department of Environmental andNatural Resources (DENR).E.Certified True copy of conversion order or exemptionclearance from the Department of Agrarian Reform (DAR)F.Certified true copy of Title and Survey Plan.Approval of the preliminary memorial park/cemetery plan shall bevalid only for a period of 180 days from date of approval. Arevalidation can be availed of only once after said period.II.Approval of Final Memorial Park/Cemetery PlanAfter the preliminary approval of the Memorial Park/Cemeterythe owner or developer shall proceed with the preparation andsubmission to the city/municipality concerned in duplicate thefollowing:A.Final Memorial Park/Cemetery Plan consisting of the sitedevelopment plan at any of the following scales: 1:200 or1:1,000 or any scale not exceeding 1:2,000 indicating thefollowing duly signed and sealed by a licensedenvironmental planner:1.Layout of roads right-of-way width and gradient,easements and similar data for alleys, if any;2.Plot boundaries, numbers, total land area and blocknumbers; (verified survey returns of mother title,

sections and blocks including number of lots perblock in each section and technical descriptions ofroad lots, open spaces, facilities, and blocks).3.B.C.Engineering plans duly signed and sealed by a licensedcivil engineer based on applicable Engineering Code andDesign Criteria in accordance with the following:1.Profile derived from existing topographic map dulysigned and sealed by a geodetic engineer showingthe vertical control, designed grade, curb elementsand all information needed for construction.2.Typical roadway sections showingrelativedimensions and slopes of pavement, gutters,sidewalks, shoulders, benching and others.3.Details of roadway showing the required thicknessof pavement, sub-grade treatment and sub-base onthe design analysis.Storm drainage duly signed and sealed by a licensedsanitary engineer of civil engineer.1.2.D.Site data, total land area, number of saleable plots,typical plot size, areas allocated for roads andpathways, and other facilities and amenities.Profile showing the hydraulic gradients andproperties of the main lines including structures inrelation with the road grade line.Details of drainage and miscellaneous structuressuch as various types of manholes, catch basins,inlets (curb, gutter, and drop), culverts and channellinings.Centralized or combined storm and sewer system dulysigned and sealed by a licensed sanitary engineer.

E.Site grading plan duly signed and sealed by a licensedcivil engineer.Plans with the finished contour lines superimposed on theexisting ground the limits of earthwork embankmentslopes, cut slopes, surface drainage, drainage outfallsand others.F.Electrical plan and specifications duly signed and sealedby a licensed professional electrical engineer and dulyapproved by the city/municipal electrical engineer.G.Landscaping plan indicating plant/tree species and othernatural/man-made landscaping features e.g. lagoon,garden, benches, etc. duly signed and sealed by alicensed landscape architect.H.Summary of Project Study indicating market, source/s offund, statement of income, cash flow and work program.1.Certified True Copy of Title or other evidence ofownership or intent to sell and authority to develop signedby the owner, Tax Declaration and current real estate taxreceipt.J.Clearances/Permits/Certifications from other agenciesapplicable to the Project:1.Clearances/Permits from National Water ResourcesBoard (NWRB)a.Clearancestating that thememorialpark/cemetery is not located on ground wherethe water table is not higher than 4.50 metersbelow the ground surface.b.Water permit whenever a well within theproject site shall be dug.c.Permit to operate the well.

2.Certified True Copy of Conversion Order orExemption Clearance from the Department ofAgrarian Reform (DAR) authorizing a change in usefrom agricultural to non-agricultural, whereapplicable.3.Permit from the Department of Public Works andHighways (DPWH) when necessary e.g. whenopening an access to a controlled traffic artery.4.Initial and operationalDepartment of Health.5.Certified True Copy of Environmental ComplianceCertificate (ECC) or Certificate of Non-Coverage(CNC) duly issued by the Department ofEnvironment and Natural Resources (DENR).clearancesfromtheK.Joint affidavit of owner/developer and licensedenvironmental planner that the memorial park/cemeteryplan conforms to the standards and requirements ofthese rules and that development thereof shall be madein accordance with the program submitted to the Board orcity/municipality concerned.L.List of names of duly licensed professional who signedthe plans and other similar documents in connection withapplication filed with HLURB or city/municipalityconcerned indicating the following information:1.Surname;2.First Name;3.Middle Name;4.In case of married women professional also theirmaiden name; and

5.Professional license number, date of issue andexpiration of its validity;6.Professional tax receipt and date of issueIf the application for the project is physically feasible and theplan complies with the zoning ordinance of the city or municipalitywhere it is situated and with these rules, the project shall be issued adevelopment permit issued by the Board or city/municipalityconcerned upon payment of the prescribed processing fee and undersuch conditions as may be imposed by the Board or city/municipalityconcerned. A final approval/development permit shall be valid for aperiod of 2 years from date of issue, however, if physicaldevelopment such as clearing and grubbing, road excavation, fillingand compaction, etc. is not commenced within said period, thegrantee of the permit may apply for its revalidation within the nextsucceeding year.If development permit expires, no development shall beallowed unless a new application for approval is filed.RULE IIREGISTRATION AND LICENSING OF MEMORIALPARK/CEMETERY PROJECTSSECTION 3.Submission of Survey Returns.Theowner/developer shall submit to the Board an authenticated copy ofthe verified survey returns of mother title, sections, and blocksincluding number of tots per block in each section together with thetechnical descriptions of road lots, open spaces, facilities and blocksas surveyed by the owner's/developer's licensed geodetic engineer.The technical description shall form part of the certificate oflease/deed of sale issued to each lessee/buyer.SECTION 4.Application for Registration.When theproponent has at least accomplished 20% of the total developmentand is interested in the perpetual lease/sale of plots in a memorialpark/cemetery project he shall register the project with the Board by

filing in duplicate a sworn registration statement containing thefollowing information:a.Name of the owner or dealer;b.Name, location and area of the project;c.The location of the dealer's and owner's principal businessoffice and if the owner is a non-resident Filipino, the name andaddress of his agent or representative in the Philippinesauthorized to receive notice;d.The names and addresses of all directors and officers of thebusiness firm if the owner and/or dealer is a corporation,association, trust or other entity, and all the partners, if it is apartnership;e.The general character of the business actually transacted bythe owner; andf.A statement of the capitalization of the owner, including theauthorized and outstanding amount of its capital stock and theproportion thereof which is paid up.The following documents shall be attached to the registrationstatements:1.A copy of the Transfer Certificate of Title in the name of theapplicant if none was submitted in the application for planapproval;2.Article of Incorporation or Articles of Partnership of Association,as the case may be, with all the amendments thereof andexisting by-laws or instruments corresponding thereto and acopy of latest annual corporate report to the Securities andExchange Commission, including a copy of the latest financialstatement showing the amount and general character of itsassets and liabilities certified by a certified public accountant;

3.Affidavit of the owner that the property is free from liens andencumbrances, except legal easement and restrictions.Provided, however, that in the case the project or portionthereof is mortgaged, to release the mortgage on any plot assoon as the full purchase/lease price for the same is paid bythe buyer/lessee;4.A copy of contract form to be used in the lease/sale of plots;5.A copy of the contract of management or development, if themanagement and/or development will be undertaken by aperson other than the owner; and6.A copy of any circular, prospectus, brochure, advertisement,letter of communication to be used for the public offering of thememorial park/cemetery plots.SECTION 5. Certificate of Registration. Upon finding thatthe project may be registered in accordance with the provision ofthese Rules, the Board shall cause to be published at the expense ofthe applicant a notice of the filing of the registration statement in 2newspapers of general circulation; one published in English andanother in Pilipino, once a week for 2 consecutive weeks, recitingthat a registration statement for the lease/sale of the plots has beenfiled with the Board and that the aforesaid registration statement aswell as papers attached thereto, are open to inspection duringbusiness hours by interested parties.After 2 weeks from the completion of the publication and uponsubmission of the affidavit of publications, the Board shall in theabsence of any impediment, issue a certificate of registration uponpayment of the prescribed fees.SECTION 6. License to Lease/Sell. No owner or dealer shalllease/sell any disposable plot in the registered project without alicense to lease/sell issued by the Board.Upon proper application therefore, submission of the requiredwork program, performance bond and payment of the prescribedlicense fee by the owner or dealer, the Board shall issue to him a

license to lease/sell the plots in the project or portion thereof coveredby the performance bond, his business is financially stable, and theproposed lease/sell of the plots to the public is not fraudulent.SECTION 7. Performance Bond. The performance bondrequired may be in any of the following forms:a.A surety bond amounting to 20% of the cost of the outstandingremaining or the unfinished portion of the approved plan issuedby a duly accredited bonding company and acceptable to theBoard. It shall contain a clause stating among others that itshall remain in full force and effect within 1 year from posting ofperformance bond unless it is ordered cancelled or released bythe Board; or,b.Real Estate Mortgage to be executed by the applicant asmortgagor in favor of the Republic of the Philippines asmortgagee, the letter as represented by and acting through theHLURB, over a property other than that subject of application,free from any liens and encumbrance and provided, that thevalue of the property, computed on the basis of the zonalvaluation schedule of the Bureau of Internal Revenue, shall beat least 20% of the outstanding remaining or the unfinishedportion of the approved plan;c.A cash bond equivalent to 50% of the development cost whichmay be in the form of:1.Fiduciary deposit made with the cashier and/or disbursingofficer of the Board;2.A certificate of guaranty deposit issued by any bank orfinancing institution of good standing in favor of theBoard;3.A letter from any bank of recognized standing certifyingthat so much has been set aside from the bank accountof the applicant in favor of the Board which may bewithdrawn by the Chief Executive Officer to the Board orby his duly authorized representative, at any time the

principal fails or refuses to comply with his duties andobligations under the bond contract;4.Any irrevocable credit line to be utilized in thedevelopment of the project from any bank of recognizedstanding and a refinancing restructuring programindicating sources of funding from duly accredited fundinginstitutions.For pre-existing projects any of the forms of performance bondenumerated above may be availed of.SECTION 8. Existing Memorial Parks/Cemeteries. Theowner of an existing memorial park/cemetery shall register theproject with the Board within 1 year from the effectivity of these Rulesby filing a sworn registration statement in duplicate containinginformation prescribed in Rule II, Section 3 and the following:1.Memorial park/cemetery plan;2.Fact sheet containing the material information on theoperations of the project to include number of plots leased/sold;not yet fully paid; accounts receivable; extent/status of landdevelopment; and cost of complete development, where projectis not yet completed.If the application for registration is found to be in order the Boardshall register the project and issue a Certificate of Registration to theowner or dealer upon the payment of the registration fee.RULE IIISECTION 9.Design Standards and Guidelines forMemorial Parks/Cemeteries. Cemeteries or memorial parks shallconform with the land use plan or zoning ordinance of the localityhaving jurisdiction over the project site, the pertinent provisions of theSanitation Code, Water Code, National Building Code of thePhilippines and its referral codes, like the Accessibility Law,

Plumbing Code, Electrical Code, etc. and other applicable laws andrules affecting related services and the following design standards:1.GENERAL PROVISIONSA.Site Criteria - Cemeteries or memorial parks shall belocated on the periphery of the town center or in areassparsely inhabited and where little hazard to human life orhealth could result.Undue proliferation of memorial parks/cemeteries in anymunicipality/city shall not be allowed. The number ofcemeteries/memorial parks to be allowed within eachmunicipality/city shall be based on the needs or deathrate in the municipality and future catchment areas aswell.A.1LocationA.1.1 In municipalities/citieswithapprovedcomprehensive land use plan or zoningordinanceA.1.1.1Memorial parks/cemeteries shallbe located in areas zoned forcemetery purposesA.1.1.2Wheretheapprovedcomprehensive land use plan orzoningordinancedoesnotstipulate any zone for cemeteryuse, the memorial park/cemeteryshall only be allowed in:a.Areas zoned as open space:Provided, however, that suchuseisnotspecificallyrestricted in the district orzone: Provided, further that itshall be compatible with the

proposed use in the zone andthat the proposed project elopment Zones (SAFDZ)as certified by the Departmentof Agriculture (DA).b.Areas zoned as agricultural:Provided, however, that thesite is not tenanted and notcovered by operation landtransfer and not located inareascoveredbytheComprehensiveAgrarianReform Program (CARP) ascertified by the Department ofAgrarian Reform (DAR); notprime agricultural land ascertified by the Department ofAgriculture (DA); and notirrigated as certified by theNational Irrigation Administration (NIA).A.1.2 In cities/municipalities without an approvedcomprehensive land use plan or zoningordinance, the memorial park/cemetery shallbe allowed in:A.1.2.1 An area adjacent to an existingcemetery/memorial park: Provided,however, that the restrictions ofA.1.1.2.a and A.1.1.2.b are met.A.1.2.2 An area where the dominant landuse within one hundred (100)meters from the periphery of theproposed memorial park/ cemeteryis neither residential, commercial,

industrial or institutional:Provided,however, that the restrictions ofA.1.1.2.b are met.A. 1.2.3 An area deemed by the Board asappropriate and in accordance with theprinciples of Planned Unit Development(PUD). PUD is defined as one conceptof real estate development and/or landdevelopment scheme which aims tooptimize the use of the land throughadaptive/innovativesitelay-out,provision of generous open space andcomplementarity of uses/ activities.A.2A.3Physical SuitabilityA.2.1The memorial park/cemetery shall not beallowed in environmentally critical areas asdefined in Proclamation No. 2146.A.2.2It must be located on ground where thewater table is not higher than four and4.50 meters below the ground surface ascertified by the National Water ResourcesBoard (NWRB).AccessibilityThe site must be served by a road with a minimumwidth or right-of-way of not less that 8.00 meters.(The right-of-way of major roads shall be increasedas project size increases).All relevant provisions of Batas Pambansa Blg. 344,e.g. dropped curves, curb cut-outs, etc. shall beobserved.

B.C.Design and Planning ConsiderationsB.1Cemetery/Memorial Parks must achieve flexibility indesign and orderly lay-out to respond to the variousspatial requirements of burial and at the same timefor economic land use and environmental control.B.2Land shall be judiciously allocated for the variousrequirements and amenities.B.3Suitable areas shall be allocated for the planting oftrees, shrubs, plants and for other functional anddecorative elements such asmonuments,sculptures, fountains and benches.Land AllocationThere shall be no fixed ratio for saleable area: Provided,however, that the owner/developer shall reserve therequired areas for roads, pathways, parking and otherfacilities and amenities: And, provided, further, that forMemorial Parks, at least 50 % of the saleable area shallbe utilized for underground interment in order to retainpark-like character of the project.2.DESIGN PARAMETERS AND ROAD SPECIFICATIONSA.Burial Plot SizesA.1Ground IntermentA.1.1. Minimum size shall be 1.00 meter by 2.44meters (inside dimensions).A.1.2 Minimum depth of excavation shall be atleast 1.5 meter-deep and filled well andfirmly.

A.1.3 No remains shall be buried where watertable is less than 4.50 meter-deep from thenatural ground surface.A. 1.4 For plots fronting roads, a minimum setbackfrom the right-of- way of 1.00 meter shall berequired where no above ground structuremay be constructed.A.1.5 Maximum height of structure above groundshall be 40 centimeters.A.2Above Ground IntermentA.2.1 Tomb (for cemeteries only)A.2.1.1 Minimum burial plot size shall be 1.6meters by 3.00 meters insidedimensions.A.2.1.2Minimum setback for front andsides of the plot shall be 30centimeters where no structure orpart of it may be constructed.A.2.1.3For plots fronting roads, aminimum setback of 1.00 metershall be required.A.2.2 MausoleumA.2.2.1Minimum plot size of 4.00 metersby 5.00 meters.A.2.2.2Minimumsetbackofcentimeters shall be required.A.2.2.31.00 meter setback for plotsfronting roads shall be required.50

A mortuary refrigerator/freezer shall be provided for safe storage untilfinal disposition and temporary holding peakactivity or emergency situations.A.3.2 The cremation room shall be separated with atransparent glass and concrete wall from thewaiting and/or viewing room. It shall beprovided with sufficient fire fighting equipmentas approved by the local fire department.

A.3.3 The gas room/storage shall be constructedwith concrete or impervious material andlocated below the ground 5 meters away fromthe cremation and waiting/viewing rooms.A.3.4 An inlet measuring 75 cm. x 75 cm. at thecremation room shall be provided if a singlecrematorium equipment is installed for propercombustion and cooling of the equipment.The inlet may be louvered and screened andshall be located near the rear of the unit.A.3.5 The crematorium oven shall have atemperature of 800 c to 1200 c with adetention time of 5 to 6 hours.A.3.6 The design of the smoke stack shall be inaccordance with the standards of theDepartment of Environment and NaturalResources (DENR).A.3.7 Cremated remains must be reduced to thesize of a fine sand or ashes and packed in acremains container before they are turnedover to the relatives of the deceased.Cremains container must have a minimumcapacity of 0.0049 cubic meter and made ofpolyethylene provided withliner bag(preformed 5-mil plastic) with locking tie andidentification label.A.3.8 Public and private cemeteries or private burialgrounds shall be made as place for thedisposal of cremated remains.However,where the relatives of the deceased sowished, the cremated remains shall beallowed to be brought home only in acremains container. The disposal of whichshall be in accordance with the provisions ofChapter XVIII - "Refuse Disposal" of the Code

on Sanitation of the Philippines (P.D. 856)and its implementing rules and regulations.A.3.9 Public and private cemeteries or other placesshall be designated as special areas for thepermanent repository of cremated remainseither below the ground or above the groundniches. Such designated areas are thosewithin the 25-meter zones measured from theproperty line.B.Access to PlotsNo plot shall be more than 60 meters from a roadway normore than 30 meters from a pathway.C.CircuCirculation SystemA network of vehicular roads and pedestrian pathwaysshall form the circulation system inside the memorialpark/cemetery.C.1Major and Minor RoadsMajor roads shall have a minimum right-of-way ofeight 8 meters; 6 meters thereof shall becarriageway. The remaining 2 meters shall bedeveloped as sidewalk or as easement of 1 meteron either side.Minor roads shall have a minimum right-of-way of6.5 meters, 4.5 meters thereof shall be thecarriageway while the rest shall be devoted to eithersidewalk or easement where no burial shall beallowed.C.2Dead-end StreetsDead-end streets shall be provided at the closedend with a cul-de-sac or other appropriate turn

around space. Cul-de-sac shall have a minimumdiameter of 15 meters.C.3Paving of Roads and PathwaysRoad pavement for major and minor roads shalleither be concrete or asphalt. Pathways shall havea minimum width of 1 meter and shall be paved witheither flagstones, concrete slabs or other firm,stable and non-slip material.C.4OthersOther planning/design consideration which wouldcontribute to the safety and convenience in the useof the road system in a memorial park shall beobserved in preparing the development plan.D.Service UtilitiesD.1xxx Consumption:Provided, however, thatadequate supply based on projected requirementsshall be ensured especially for irrigation purposesor the proper maintenance of the greenery.The water supply be adequate and potable whetherfrom a public or from a private water supply system.The quality of water used shall be in accordancewith the Philippine National Standards for DrinkingWater.D.1.1 All water sources shall have a certificate ofpotability of drinking water issued by thelocal health officer.D.1.2 A minimum supply of 40 liters per capita perday shall be maintained.

D.2xxx Areas. Other pertinent provisions of the WaterCode on drainage shall be complied with.D.3Sewer Systemxxx Conforming to the Sanitation Code shall beprovided.D.3.1 Sewage from the burial ground plumbingsystem shall be connected to a publicsewerage system, or in the absence thereof,to an imhoff or septic tank or otherwastewater treatment facility and subsurfaceabsorption field.
