BED BUG HEAT TREATMENT SERVICE AGREEMENT This Bed Bug Heat Treatment Service Agreement (the Agreement), entered into by and between (Client), (Occupant), and the Bastrop Housing Authority (BHA), provides for the treatment of bed bug(s) infestation by BHA under the terms and conditions set forth herein. Services Provided – BHA will conduct a visible inspection of the interior of the dwelling unit located at: (the Premises) – said Premises is owned by Client and is occupied by Occupant – for evidence of bed bug infestation and will provide a heat treatment service for the control of bed bugs (the Heat Treatment Protocol). It is recognized that both eliminating an infestation of bed bugs and preventing reintroduction of bed bugs can be difficult and additional protocols may be necessary. THIS HEAT TREATMENT PROTOCOL DOES NOT UTILIZE OTHER TREATMENT OPTIONS THAT ARE AVAILABLE SUCH APPLYING CHEMICALS OR OTHER PEST CONTROL PRODUCTS, OR USING STEAM, COLD, MONITOR TRAPS, CHEMICALS, OR DOGS, ETC., AND IS JUST A PORTION OF A COMPREHENSIVE PROGRAM. FOR OTHER TREATMENT PROTOCOLS OR RESIDUAL PRODUCTS, CLIENT MUST CONTRACT WITH A LICENSED PEST CONTROL COMPANY. BHA’s maintenance technicians will perform the Heat Treatment Protocol. BHA’s maintenance technicians do not have pest control applicator licenses and are not permitted to apply pest control products other than heat. Pest Species Covered – The Heat Treatment Protocol is designed to treat for an active or suspected infestation of bed bugs (Cimex lectularium Linnaeus) only. Limits of Liability – The Heat Treatment Protocol provided under this contract is intended to help reduce the population of bed bugs through heat treatment. BHA does not represent or guarantee that bed bugs will not be found at the Premises after the initial treatment or any re-treatments. BHA will perform the Heat Treatment Protocol in a workmanlike manner. BHA will exercise reasonable care while performing any work hereunder to try to avoid damaging any part of the Premises, plants, or animals. Under no circumstances or conditions shall BHA be responsible for damage caused by BHA at the time the work is performed except those damages resulting from gross negligence on the part of BHA. BHA agrees to provide Worker’s Compensation coverage for the BHA maintenance technicians while they are performing the Heat Treatment Protocol. Client agrees to provide liability and property insurance coverages for all other claims and the Client agrees to sign the HOLD HARMLESS AND INDEMNIFICATION AGREEMENT, which is incorporated into and made a part hereof, releasing BHA of responsibility resulting from all claims that could result from unintentional or accidental negligence during performance of the Heat Treatment Protocol. Although BHA will exercise reasonable care in performing services under this Agreement, BHA will not be liable for injuries or damage to persons, property, birds, animals, or vegetation, except those damages resulting from gross negligence by BHA. Further, under no circumstances will BHA be responsible for any injury, disease or illness caused, or allegedly caused, by bites, stings or contamination by bed bugs or any other insects, spiders, rodents or beetles, fungus or mold, termites and any other wood destroying insect or organisms. BHA’s representatives are not medically trained to diagnose bed bug borne illnesses or diseases. Please consult your physician for any medical diagnosis. To the fullest extent permitted by law, BHA will not be liable for personal injury, death, property damage, loss of use, loss of income or any other damages whatsoever, including consequential and incidental damages, arising from the service provided hereunder. 502 Farm Street P.O. Special Notice Regarding Nature of Bed Bugs - Bed bugs are secretive in nature, their eggs and nymphal stages are extremely difficult to spot in all locations, and they can be reintroduced at any time by “hitchhiking” on people and possessions from travels and also from local environments such as schools, stores, offices and theaters. Control efforts themselves must be done in a manner that does not threaten the health and well-being of persons who live in or visit the structure. Bed bug controls rely heavily upon the full cooperation of the Client and Occupant to make proper preparations for treatment and to take measures to avoid reintroduction of bed bugs. Additionally, bed bug resistant mattress and box spring covers are highly recommended to significantly reduce ability for bed bugs to infest or re-infest. Special Permission – Client and Occupant understand and permit BHA’s maintenance technicians to disassemble beds and furniture, remove mattresses, and remove bedding and dust covers from the base of the box springs to thoroughly inspect and treat for bed bugs. Client and Occupant understand and agree that it may be necessary for BHA’s maintenance technicians to move furniture and other items in the Premises, such as dressers, night stands, clothing, blankets, etc., to ensure that the heat is properly distributed throughout the Premises. Client’s Obligations and Occupant’s Obligations - Client agrees to meet with Occupant to schedule the Heat Treatment Protocol and to obtain Occupant’s signature on the BED BUG PREPARATION SHEET FOR HEAT TREATMENT SERVICE and this Agreement. Client and Occupant agree to be responsible for ensuring they have each read and carefully followed the BED BUG PREPARATION SHEET FOR HEAT TREATMENT SERVICE, which is incorporated into and made a part hereof, and any additional recommendations made by BHA’s maintenance technicians prior to the scheduled date of treatment. Client and Occupant acknowledge by their signatures below that failure to follow the requested procedures in the BED BUG PREPARATION SHEET FOR HEAT TREATMENT SERVICE and the recommendations of BHA maintenance technicians may render the Heat Treatment Protocol less effective or ineffective and may even adversely affect the welfare of occupants, guests, and/or pets. Client and Occupant agree to maintain the Premises in a condition which does not promote infestations by bed bugs. Client and Occupant also agree to maintain the Premises in a clean and sanitary condition and to keep the Premises in such a state of repair to avoid providing access to bed bugs. Furthermore, should the Premises or any part thereof not be fully prepared, or complete access not be provided to the BHS maintenance technicians at the time of the scheduled service, BHA will not be obligated to wait for completion of preparations. Vacating Premises - Client and Occupant agree that Occupant must vacate the Premises, including removing all persons and pets/animals, from the Premises from the start time of the scheduled treatment visit, during the treatment, and for a minimum of four (4) hours after completion of the treatment. Occupant will be asked to provide the BHA maintenance technician with a phone number to be reached at once the treatment has been completed. Cost of Service – The Heat Treatment Protocol service charge will be billed at a rate of per hour, including the time required to set up the equipment and to remove the equipment after the treatment is completed. Warranty – Client agrees, that because BHA is providing the Heat Treatment Protocol at a reduced price, the cost of service stated above does not include re-treatment or warranty in the price. Default – Should Client and/or Occupant in any way fail to observe or comply with any provision of this Agreement and/or the BED BUG PREPARATION SHEET FOR HEAT TREATMENT SERVICE, BHA may, at its sole option, terminate this Agreement, declare any charges due and payable and initiate legal process to recover monies owed, and/or, pursue any other legal rights and remedies available to BHA. Exercise of any remedy available to BHA shall not constitute an election of remedies or a waiver of any additional remedies to which BHA may be entitled. Entire Agreement – This Agreement, together with the HOLD HARMLESS AND INDEMNIFICATION AGREEMENT and the BED BUG PREPARATION SHEET FOR HEAT TREATMENT SERVICE, and any other attachment(s), if any, page 2 of 3

signed by the parties, constitutes the entire Agreement between the parties and no other representation or statements, whether oral or written, will be binding upon the parties. Governing Law - This Agreement shall be deemed to be executed within the State of Texas and construed in accordance with and governed by laws of the State of Texas. Any action or proceeding arising out of this Agreement shall be filed and resolved in a court of competent jurisdiction located in Bastrop, Texas. Severability - If any part of this Agreement is held to be invalid or unenforceable for any reason, the remaining terms and conditions of this Agreement will remain in full force and effect. The undersigned acknowledge that he/she (i) has read and fully understands the content of this Bed Bug Heat Treatment Service Agreement; (ii) is aware that this is a contract between BHA and Client and BHA and Occupant; (iii) has had the opportunity to consult with his/her attorney, in his/her discretion; (iv) is fully aware of the legal consequences of signing this document; and (v) is the Client, Occupant, or his/her/its authorized signatory. Hold Harmless and Indemnification Agreement In consideration for the Bed Bug Heat Treatment Services (hereinafter, the “Services”) provided by the Bastrop Housing Authority to Client, who is the owner of the real property located at: (hereinafter, the “Premises”) and to the furthest extent allowed by law, Client, does hereby agree to indemnify, hold harmless and defend the Bastrop Housing Authority and each of its board members, employees, agents and authorized volunteers (hereinafter collectively referred to as “BHA”) from any and all loss, liability, penalties, costs, expense and damages (whether in contract, tort or strict liability, including but not limited to personal injury, death at any time and property damage) incurred by BHA, Client or any other person, and from any and all claims (actual or threatened), demands and actions in law or equity (including attorney’s fees and litigation expenses), arising or alleged to have arisen directly or indirectly out of BHA’s performance, purported performance, or non-performance of the Services at the Premises. Client’s obligations under the preceding sentence shall apply regardless of whether BHA or any of its board members, employees, agents and volunteers are negligent, but shall not apply to any loss, liability, penalties, costs, expense and damages caused solely by the gross negligence, or caused by the willful misconduct, of BHA or any of its board members, employees, agents and authorized volunteers. Client shall pay for and maintain in full force and effect all insurance, including liability insurance and property insurance, as required by the Bed Bug Treatment Service Agreement between BHA and Client, which is incorporated into and made a part of this Agreement. Client shall conduct all defense of BHA at Client’s sole cost. The fact that insurance is obtained by Client shall not be deemed to release or diminish the liability of Client, including, without limitation, liability assumed under this Agreement. The duty to indemnify shall apply to all claims regardless of whether any insurance policies are applicable. The duty to defend hereunder is wholly independent of and separate from the duty to indemnify and such duty to defend exists regardless of any ultimate liability of Client. The insurance policy limits do not act as a limitation upon the amount of defense and/or indemnification to be provided by Client. Approval or purchase of any insurance contracts or policies shall in no way relieve from liability nor limit the liability of Client, its officials, officers, employees, agents, or volunteers. BHA shall be reimbursed for all costs and attorney’s fees incurred by BHA in enforcing this Agreement. This Hold Harmless and Indemnification Agreement shall survive the expiration or termination of the Bed Bug Treatment Service Agreement between BHA and Client. Client and Occupant by his/her signatures below acknowledge and agree that they have each read and understand this Bed Bug Preparation Sheet for Heat Treatment Service, including the Heat Treatment Checklist, and will comply with each of the items listed below prior to the date of the scheduled heat treatment. Client and Occupant understand that, during the time required to heat the Premises, the potential for damages to furnishings and fixtures is practically non-existent. Heat Treatment Checklist: Client and Occupant agree to take all necessary precautions that include, but are not limited to, (place a check mark next to each item once completed): People, live plants and pets, including fish and/or tanks must be removed from the Premises prior to service. People should leave with only the clothes they are wearing. (Personal belongings such as purses, luggage or other items may contain bed bugs that could be brought back and re-infest the Premises.) Occupant agrees to remove any and all bullets, guns, pressurized cylinders, aerosol cans, paints, and flammable chemicals from the Premises prior to treatment. All medicines and vitamins shall be placed in the refrigerator or removed from the Premises Fresh fruits and vegetables, chocolates, wines/liquors, artificial sweeteners, soaps, candles, chocolate, cosmetics, bottled alcohols, cologne/perfume, should be placed in the refrigerator. Wax based or paraffin-based items (soaps, candles, wax figurines, crayons, cosmetics/make-up, lipstick) should be placed in the refrigerator. Occupant agrees that appliances, computers, and all other electronics shall be unplugged from the wall prior to treatment. (Electronics have a high potential for infestation in the source area. The equipment is usually rated for temperatures above 165 degrees.) Small items such as picture frames, paintings, or paperwork should be stored in such a manner to prevent them from being blown away or damaged by air circulation during the remediation process. Occupant agrees all clothing or other cloth items present during the heat treatment should not be removed from drawers unless to be hung on clothes hangers. Clothing, lines, laundry, etc., should not be piled on the floor or placed in laundry baskets. Clothing and other items may be manipulated during the treatment to allow the heat to penetrate. Occupant agrees that waterbeds must be drained or disassembled to allow the frame to reach the proper temperature and air mattresses must be partially deflated to avoid damage and any electric pumps must be unplugged from the outlets. 2. Client and Occupant agree that BHA will not be responsible for damage to any one-of-a-kind items such as heirlooms, antiques, oil paintings, vinyl, wax or plastic items, wooden or stringed musical instruments, etc. As a precaution, Occupant should remove these items from the Premises prior to treatment to prevent damage from heat. Occupant agrees to inspect each such item carefully for bed bugs so that they do not transport them out of the Premises or re-infest the unit after treatment is complete.

3. Client and Occupant agree that a BHA staff member or technician will inspect the Premises prior to the scheduled treatment to confirm the Premises has been properly prepared. However, it shall be the Client’s and Occupant’s responsibility to take all necessary precautions to protect their belongings. BHA will not inspect every item in the Premises and will not be held liable for damage to items the Occupant missed or failed to properly prepare. BHA reserves the right to refuse service when it is obvious that areas of the Premises were not properly prepared in advance. 4. Occupant agrees that each person in the Premises household must select one set of clothing to wear the day of the treatment. The clothing must be placed in the dryer for one hour on high heat, then placed in a sealed bag and left outside of the Premises prior to the scheduled treatment. Occupant agrees that each person in the Premises household will change into these clothes prior to re-entering the Premises and agrees to immediately launder any clothing worn from the Premises to prevent re-infestation. 5. Occupant agrees not to remove bed linens, including bed skirts, sheets, pillows and bed coverings prior to treatment. Such items will be removed and placed on top of the bed during the heat treatment to allow heat to penetrate. 6. Occupant agrees that mattresses, bed frames, cushions and other furniture will be manipulated during the treatment to allow heat to penetrate. Occupant agrees to leave as much personal belongings in the Premises as possible since success requires treatment of all possible items. 7. Client and Occupant agree to comply with any additional preparation instructions that may be given at the time service is scheduled. 8. After treatment, Occupants agrees to use a vacuum cleaner (preferably HEPA-filtered) to remove any bed bugs and their cast skins from all observed and suspected harborage sites upon return to the Premises and at least once a week thereafter. The vacuum bag should be removed immediately afterward, sealed tightly in a plastic bag and taken immediately from the Premises to an outside trash can. 9. Client and Occupant agree to provide BHA staff or technicians access to the Premises for follow up inspections and/or treatment because this is necessary as part of the treatment process. 10. Client and Occupant agree that this heat treatment service is not guaranteed and may need to be repeated as necessary. Bed bugs are brought in from an outside source and can spread and re-infest if the source is not discovered. Full cooperation and disclosure of the source of bed bugs is crucial to prevent re-infestation. 11. Client and Occupant agree that in the event it is determined that the heat treatment has not been successful treating items with an infestation, such as mattresses, box springs or other furniture, and re-infestation continues to occur, BHA may discuss the need to dispose of such items to prevent future re-infestation. 12. Occupant agrees that he/she may be contacted at (phone number) once heat treatment is completed and it is safe to return home. Day-to-Day Prevention Bed bugs are excellent hitchhikers, so be extra careful when traveling (see tips below). Change and wash bedding regularly. Do not bring second-hand furniture into your home unless you have thoroughly inspected and cleaned the items first. Reduce clutter. Traveling Tips Inspect mattress and headboard with flashlight. Keep bags, luggage, and backpacks off the bed. Inspect and then use a luggage rack. Never place clothes, or jackets, on bed or couch. Do not store clothes in dresser. If you are concerned about exposure, after travel, seal all items in plastic bags until time for washing or treatment. Unpack clothes directly into washer / dryer. Inspect luggage closely with flashlight and magnifying glass for bed bugs upon returning home. Bites and Disease Bed bugs are not known to transmit disease. Bites are often painless and occur at night while you are sleeping. Some people suffer allergic reactions and develop painful swelling. The important thing is to act fast — before they have time to multiply. Pesticide Safety First! Read the Label. EPA does not register and check for effectiveness of these products. These products do not have EPA registration numbers on the label. Never use outdoor pesticides indoors. Some pesticides and total release foggers are highly flammable. Improper use may cause a fire. Never overuse pesticides. More is not better! Read, understand, and follow the label-use directions. It is challenging, but not impossible, to prevent, detect and control bed bugs due to their small size and ability to squeeze into cracks and crevices, where they are often unnoticed. Pesticides alone generally will not eliminate bed bugs. Effective bed bug control requires Integrated Pest Management (IPM). IPM is an environmentally sensitive approach to pest management that relies on knowledge of the pest, plus common sense practices, such as inspection, monitoring, reducing clutter, the use of physical barriers, and the judicious use of pesticides. Inspect carefully You may have red, itchy welts or rashes from bites; however, bite marks are not a reliable indication of a bed bug infestation. Bed bugs are no one’s fault. If you live in an apartment or other multi-family dwelling, and you see a bed bug, contact your landlord immediately. 2. Non-chemical Controls Items that cannot be washed or dried may be steamed, heated or frozen using specialized equipment. Raising the indoor temperature with a thermostat or space heaters will not work, nor will placing items in the home freezer. Contact a bed bug management professional for advice. 3.
