MINUTES: Dr. Hall made a motion to approve the April 27-28, 2017 minutes with correction to a name. Second was given by Ms. Warner with correction. Motion carried. Dr. Hall made a motion to approve the Anesthesia Taskforce minutes from June 2, 2017. Second was given by Ms. Warner. Motion carried. Dr. Hall made a motion to approve the Summary Suspension minutes from June 21, 2017. Second was given by Ms. Pucket. Motion carried. APPLICATION / APPLICANT INTERVIEWS / REQUESTS: Birdwell, Trina – Ms. Birdwell was referred to the board due to her criminal history. She was arrested twice in 2011. After a brief discussion, Dr. Hall motioned to grant Ms. Birdwell her license. Dr. Henson seconded the motion. Ghadri, Najib – was referred to the board by the consultant. Dr. Ghadri missed the meeting; his application was tabled until the October board meeting. Haji, Menira – Ms. Haji was invited to the board due to not practicing since 2013. After a brief discussion, the board agreed to approve Ms. Haji’s application after completing competency testing from Remington or TSU. Ms. Warner made a motion to approve Ms. Haji’s application, and Dr. Henson seconded the motion. Harris, Ashley – Ms. Harris was referred to the board due to her criminal history. Ms. Harris’ probation ended in June 2017. After a brief discussion, the board agreed to approve Ms. Harris’ Page 1

application with her current probation. Ms. Warner made a motion to approve Ms. Harris' license concurrent with her probation, and Ms. Puckett seconded the motion. Kaufman, Stephen – Dr. Kaufman was referred to the board due to his Tennessee dental license being revoked in April 2015 pursuant to Final Order 17.12-128422A. After a brief discussion, the board suggested that Dr. Kaufman withdraw his application because he did not attend the monitoring program that was recommended by the board. Dr. Kaufman withdrew his application. Krogos, Brittanie - Ms. Krogos was referred to the board due to criminal history. Ms. Krogos’ probation ended in June 2018. After a brief discussion, the board agreed to approve Ms. Krogos’ application with her current probation. Dr. Hall made a motion to approve Ms. Krogos’ license concurrent with her probation, and Ms. Warner seconded the motion. Palk, Ashley - Ms. Palk was referred to the board due to criminal history. Ms. Palk’s probation ends in June 2019. After a brief discussion, the board agreed to approve Ms. Palk’s application with her current probation. Dr. Henson made a motion to approve Ms. Palk’s license concurrent with her probation, and Dr. Hall seconded the motion. Wilson, Rebecca – Ms. Wilson was referred to the board meeting due to not practicing since 2009. After a brief discussion, the board agreed to approve Ms. Wilson’s application after completing competency testing from Roane State, Hiawassee, or ETSU. Dr. Hall made a motion to approve Ms. Wilson’s application, and Dr. Henson seconded the motion. APPLICATION RATIFICATION: Dr. Hall made a motion to approve the attached list of new licenses, reinstatements/reactivations, and retirement applications for dentists, hygienists and assistants from April 27, 2017 through July 13, 2017. Second was given by Ms. Warner. Motion carried. Dr. Hall made a motion to approve certifications and permits for dentists, dental hygienists and registered dental assistants from April 27, 2017 through July 13, 2017. Second was given by Dr. Henson. Motion carried. Dr. Hall made a motion to approve administrative revocations for dentists, dental hygienists and registered dental assistants form April 27, 2017 through July 13, 2017. All other correspondence was reviewed by the board but no action was taken. 63rd Southern Conference of Dental Deans & Examiners – The Conference will take place at UT Memphis from January 26-28, 2018 and the Board of Dentistry is co-hosting the conference. Ms. Warner made a motion to send the entire board. The motion was seconded by Ms. Puckett. Motion carried. 2017 FARB Regulatory Law Seminar – The conference will take place in Savannah, Georgia from October 5-8, 2017. Dr. Prince made a motion to send Ms. Putnam. Ms. Warner seconded the motion. The motion carried. AADB Annual Meeting – The conference will take place in Atlanta, Georgia from October 17-18, 2017. Ms. Puckett made a motion to send Ms. Smith, Dr. Hall, Dr. Bateman, and Ms. Warner to the conference. Dr. Bateman seconded the motion. The motion carried. AADA Annual Meeting – The conference will take place in Atlanta, Georgia from October 15-16, 2017. Ms. Puckett made to motion to send Ms. Smith to the conference. Dr. Bateman seconded the motion. Motion carried. The Board will pay for the board to pay for the AADB membership fees for Dr. Travis, Dr. Henson, Ms. Puckett, Dr. Williams, Dr. Hall, Dr. Bateman, Ms. Warner, and Ms. Martin. Dr. Akins and Dr. Sawyer resigned from the Anesthesia committee. After a brief discussion, the Board agreed to appoint Dr. Brian West and Dr. Stephen Maroda. A motion was made by Ms. Warner to appoint Dr. West. The motion was seconded by Dr. Hall. Motion carried. Ms. Warner made a motion to appoint Dr. Maroda. The motion was seconded by Ms. Pucket. Motion carried. REPORTS Executive Director’s Report – Ms. Smith stated that from January 1, 2017-June 30, 2017, there were 184 Dentists, 180 Hygienists, and 705 Assistants that applied for licensure. There were 37 Dentists, 252 Hygienists, and 1,116 Assistants who received permits. There were 516 Dentists who renewed their license online giving a 60% renewal rate; there were 688 hygienists who renewed their license online giving a 67% renewal rate, and there were1,197 assistants who renewed their license online giving a 67% renewal rate. During this time period, there were 32 dentists, 61 hygienists, and 514 assistants whose license expired. During this time period, there were 70 dentists, 44 hygienists, and 53 assistants who retired their license. As of June 30, 2017, there were 3,944 dentists, 4,886 hygienists, and 9,614 assistants, giving a total of 18,444 who held active licenses. Page 5

Office of Investigations Report - Ms. Luther stated there were 143 complaints with Investigations. There were 49 active complaints, and there were currently 111 people being monitored. OGC Report – Ms. Putnam stated that Teledentistry Rules were in the internal review process. Wellness Committee –The Wellness Committee is committed to confidently assist all members of the dental family who have become functionally and professionally impaired due to drug dependencies, mental, physical or aging problems. Dr. McElhiney and Dr. Sain met with several Dentists and Hygienists during this quarter. They discovered they needed to update their recordkeeping as well. Legislative Update – Ms. Blair stated that there were seven public chapters that went into effect that would affect the board. Public Chapter 40 - This sunset provision extends the board of dentistry until June 30, 2021. Public Chapter 404 - Requires public water systems which have a monthly fluoride test confirmed by quarterly laboratory analysis to exceed 1.5 mg/L to have each monthly test analyzed by a laboratory until fluoride levels are below 1.5 mg/L for three consecutive months. The water system must also notify its customers that a water sample exceeded 1.5 mg/L. This act took effect on May 18, 2017. Public Chapter 350 - Allows healthcare providers to satisfy one hour of continuing education requirements through the performance of one hour of voluntary provision of healthcare services. The maximum amount of annual hours of continuing education that a provider can receive through providing volunteer healthcare services is the lesser of 8 hours or 20% of the provider’s annual continuing education requirement. The legislation allows for rulemaking by the division of health related boards in order to administer this section. This took effect on May 12, 2017. Public Chapter 215 - Requires state governmental entities that establish or adopt guides to practice to do so through the promulgation of rules, rather than policy. The rules so promulgated must specify all provisions included in and relating to the guide to practice. Any changes to guides to practice made after the guides are adopted must also be promulgated by rule in order to be effective. For purposes of this part, guides to practice includes codes of ethics and other quality standards, but does not include tests, examinations, building codes, safety codes, or drug standards. This legislation took effect on April 28, 2017. Public Chapter 240 - Insures the integrity of licensure examinations by making examination questions, answer sheets, scoring keys, and other examination data confidential and closed to public inspection. Allow the issuance of limited licenses to applicants who have been out of clinical practice or inactive, or who are engaged in administrative practice. Limited licenses may be of restricted scope, restricted duration, and have additional conditions placed upon them in order to obtain full licensure. Clarify that other documents prepared by or on behalf of the Department with regard to an investigation are confidential until such time as formal disciplinary charges are filed against the provider. Eliminate the “locality rule” for administrative law. Require the chief administrative official for each health care facility to report within 60 days any disciplinary action taken against an employee for matters related to ethics, incompetence or negligence, moral turpitude, or substance abuse, to the employee’s respective licensing board. All records pertaining to the disciplinary action shall be made available for examination to the licensing board. This act became effective on May 2, 2017. Public Chapter 481 - Creates a new violation of a healthcare practitioner’s practice act if that practitioner refuses to submit to or tests positive for any drug the practitioner does not have a Page 6

lawful prescription for or a valid medical reason for using the drug. It is the duty of the employer to report any violation to the Department of Health. If the practitioner fails a drug test, the practitioner has 3 business days to either produce the requisite prescription or medical reason, or report to their board approved peer assistance program. If the practitioner does not comply with any of these measures, it is the duty of the employer to report this violation of the practice act to the employee’s licensing board for investigation and action. If the practitioner reports to the peer assistance program and obtains and maintains advocacy of the program, the employer is not required to notify the board. As long as a practitioner obtains, maintains and complies with the terms of a peer assistance program, the board shall not take action on the licensee for the sole reason of a failed or refused drug test. If a practitioner fails to obtain or maintain advocacy from the peer assistance program, the program is required to report that information to the appropriate licensing board. The board SHALL suspend the license of a practitioner who fails to comply with the terms of the program. Employer drug testing must be compliant with the Drugfree Workplace requirements. This legislation allows a quality improvement committee to share information regarding substance abuse by a practitioner with other quality improvement committees. Additionally, this legislation specifies that the Department of Health is not required to obtain prior approval from the Attorney General in order to take any emergency action on a licensee. This legislation took effect on July 1, 2017. Public Chapter 230 - Authorizes commissioners or supervising officials of departments to evaluate certain actions by a regulatory board to determine whether the action may constitute a potentially unreasonable restraint of trade. Supervising officials must ensure that the actions of regulatory boards that displace competition are consistent with a clearly articulated state policy. If a board action constitutes a potentially unreasonable restraint of free trade, the supervising official must conduct a further review of the action and either approve, remand or veto the action. The supervising official may not be licensed by, participate in, or have a financial interest in the occupation, business or trade regulated by the board who is subject to further review, nor be a voting or ex officio member of the board. The supervising official must provide written notice of any vetoed actions to the senate and house government operations committees. Prior to filing a regulatory board's rule with the secretary of state, the commissioner or chief executive officer of the administrative department under which a regulatory board operates or to which a regulatory board is administratively attached, or a designee to the extent a conflict of interest may exist with respect to the commissioner or chief executive officer, must remand a rule that may constitute a potentially unreasonable restraint of trade to the regulatory board for additional information, further proceedings, or modification, if the rule is not consistent with a clearly articulated state policy or law established by the general assembly with respect to the regulatory board. This act took effect on April 24, 2017. Update from School of Dentistry – Dean Hottel was placed on indefinite suspension. There are discussions to increase the size of the classes for the restorative and prosthetic functions certification courses and improve the way waiting list is handled. Dr. Holifield may attend the October board meeting with Dr. Robbins to provide more information. Update on SRTA – Annual meeting will take place in August. Dr. Jubran explained the committee and Board of Directors will need a board member to serve on the ADEX committee. SRTA has discussed rejoining ADEX. Dr. Givens’ license was reprimanded; assessed 900 in civil penalties, plus costs not to exceed 1,000.Motion to approve by Dr. Henson and seconded by Dr. Hall. Motion Carried. Gravelle, Joshua, DDS – Dr. Gravelle was found guilty of unprofessional, dishonorable or unethical conduct, to wit: pre-signing blank prescription forms or using pre-printed or rubber stamped prescription forms containing the dentist’s signature or the name of any Schedule II, III, IV, and V controlled substances; failing to exercise reasonable diligence to prevent partners, associates, and employees from engaging in conduct which could violate any provisions of the Tennessee Dental Act or any rule, regulation, or order of the Board; and prescribing drugs for other than legitimate dental purposes. Dr. Gravelle’s license was placed on probation for no less than three years; assessed 3,500 in civil penalties, plus costs not to exceed 3,000. McRae, Joseph, DDS – Dr. McRae failed to adhere to rules and/or statute, to wit: maintain current certification in ACLS/PALS; equipment and drugs on a list available from the Board and currently indicated for the treatment of specified emergency conditions must be present and readily available for use. Olson, Jessica, RDA – Ms. Olson failed to properly maintain sufficient continuing education credits. Ms. Olson’s license was with terms; assessed a 150 civil penalty, plus costs not to exceed 1,000. Motion to approve by Ms. Martin and seconded by Dr. Prince. Motion Carried. Paiz, Wendy, RDA – Ms. Paiz failed to properly maintain sufficient continuing education credits. Ms. Paiz’s license was reprimanded with terms; assessed a 150 civil penalty, plus costs not to exceed 1,000. Motion to approve by Ms. Warner and seconded by Ms. Puckett. Motion Carried. Patterson, Brian, DDS – Case No. 201605489 –On or about July 12, 2017, the Board of Dentistry was notified that the Respondent was currently in compliance with their conditions to obtain advocacy and would monitor him during the term of the contract sighed on June 22, 2017. The Respondent is hereby placed on Probation for five years effective from the date the Respondent’s dental license is reinstated. Respondent shall not practice in any setting where he has access to nitrous oxide and must remain from all mood-altering substances.
