Circular 0044/2019To: The Managerial Authorities of Recognised Primary SchoolsRECRUITMENT/PROMOTION AND LEADERSHIP FOR REGISTEREDTEACHERS IN RECOGNISED PRIMARY SCHOOLSThe Minister for Education and Skills, pursuant to the power contained in Section 24 of theEducation Act (as amended), directs employers to implement the regulations and proceduresas set out in this circular from 1st September, 2019. All posts advertised before this date willcontinue under the previous relevant circular.This circular sets out a leadership and management framework for posts in recognised primaryschools and recruitment and appointments procedures for registered Teachers, AssistantPrincipals, Deputy Principals and Principals. This circular supersedes all previous circulars,memoranda, rules and regulations in relation to recruitment and promotions includingAppendix D and E of The Governance Manual for Primary Schools 2015 - 2019, Chapter 1 ofedition 2 of Terms & Conditions of Employment for Registered Teachers in RecognisedPrimary & Post Primary Schools, Circulars 70/2018, 0031/2011 and 0015/2016.Please ensure that the contents of this circular are brought to the attention of all members ofthe Board of Management/Education and Training Board (ETB) and all teachers in youremployment in Primary Schools including those on leave of absence and on secondment.This circular can be accessed on the Department’s website under www.education.ie.All queries should initially be brought to the attention of the school management who may wishto consult with their representative organisation. DefinitionsFor the purposes of this circular the following terms shall have the meanings assigned to themhere unless the context indicates otherwise:Appropriately Qualified:Means the teacher has qualifications suitable to the post and isregistered with the Teaching Council for the sector for whichhe/she is to be employed.AppropriatelyRegistered:Means a teacher whose name is entered on the TeachingCouncil’s register for the sector for which he/she is to beemployed.Means the body of persons or person appointed by the PatronBoard/Board ofManagement/Manager(s): to manage the school.CE:Chief Executive of an ETB with responsibility for executivefunctions, including recruitment and employment of staff.CID:Means a contract of indefinite duration.Days:Means calendar days; unless otherwise specified.DEASP:Means the Department of Employment Affairs and SocialProtection.Department:Means the Department of Education and Skills.Employer:Means an Education and Training Board (ETB) for vocationalschools/community colleges, community national schools anda Board of Management/Manager in the case of primary(excluding community national schools) voluntary secondary,community and comprehensive schools. The ETB or Board ofManagement/Manager may delegate as appropriateresponsibility for matters set out in this circular.ETB:Refers to an Education and Training Board.Fixed-Term Contract:Means a contract of employment paid by monies from theOireachtas, whether full-time or part-time where the end of thecontract of employment concerned is determined by anobjective condition such as arriving at a specific date,completing a specific task or the occurrence of a specificevent. In this circular, the phrase ‘fixed-term contract’ is takento also include fixed-purpose and/or specific purposecontracts.Fixed Term Teacher:Means a teacher employed on a fixed term contract.4

Internal Panel:Means a list created by an Interview Board of applicants itdeems suitable for appointment, ranked in order of meritfollowing a recruitment campaign which may be used to fillfuture vacancies, if specified in the job advertisement.Minister:Refers to the Minister for Education and Skills.Paymaster:Means the Department of Education and Skills in the case ofprimary teachers.Personal BasisAllowance:An allowance for a leadership and management post which isretained by a teacher while they remain teaching in the school(e.g. where a teacher was acting in excess of five consecutiveschool years and retains the allowance on a personal basis) orare compulsorily transferred to another school.Post:Refers to a teaching post, whether full time or part time, whichis funded out of monies provided by the Oireachtas.Privileged Assistant:Former Principal of one of the amalgamating schools/closedschool who is not Principal of the new school (term onlyapplies in the case of principals and not other post holders, seepersonal basis allowance above for other post holders).Recognised School:Means a school recognised by the Minister in accordance withSection 10 of the Education Act, 1998.Registered Teacher:Means a teacher whose name is entered on the TeachingCouncil’s register.Retired Teacher:Means a registered teacher who is in receipt of a pension inrespect of service given by him or her as a teacher under apublic service pension scheme.School Year:1st of September to 31st of August of the following calendaryear is the official school year for contract purposes.Teaching Council:Means the Council established under Section 5 of theTeaching Council Act 2001-2016.Teaching Council Act:Means the Teaching Council Act 2001-2016 under which theTeaching Council was established and carries out itsfunctions.Teaching servicerecognised by DES:Means teaching service which the Department of Educationand Skills/ Education and Training Board (ETB) hasrecognised for incremental credit purposes.Week:Means calendar week, unless otherwise specified.5

CHAPTER 1REQUIREMENT TO REGISTER WITH THETEACHING COUNCIL1.The Teaching Council Act 2001-20161.1The Teaching Council was established under the Teaching Council Act,2001-2016.1.2Section 30 of the Teaching Council Act commenced with effect from 28January 2014 under S.I. No. 419/2013 – Teaching Council Act 2001(Commencement) Order 2013.1.3Other than the limited exceptions permitted under MinisterialRegulations, Section 30 prohibits payment from monies provided by theOireachtas to people employed as teachers in recognised schools unlessthey are registered with the Teaching Council.
