Notwithstanding the provisions of subdivision "d" of t h i s section, a person appointed t othe t i t l e of professor, associate professor o r a s s i s t a n t professor a f t e r p r i o r service i n aposition on t h e instructional s t a f f may be granted tenure by the Board i n i t s d i s c r e t i o n ,undzr these bylaws, a f t e r not l e s s than one nor more than f i v e years of continuous full-times a t i s f a c t o r y service on an annual salary basis.[dl f. A distinguished person of proven record appointed i n i t i a l l y t o the t i t l e of professor,who had tenure i n another recognized i n s t i t u t i o n of higher learning, may be appointed withimmedjate tenure by the Board i n i t s d i s c r e t i o n .[el 9. A person who has a t t a i n e d tenure i n an educational u n i t under the j u r i s d i c t i o n of theBoard of Higher Education and who i s subsequently appointed t o a comparable position on anannual salary basis i n another educational u n i t under t h e , j u r i s d i c t i o n of t h e Board shallr e t a i n his tenure.[ f ] h. Where the service of a member of the instructional s t a f f , in a t i t l e on the permanentinstructional s t a f f i s interrupted by reason of absence on a maternity leave duly granted t oher by the Board, the period of c r e d i t a b l e service immediately preceding such absence s h a l lbe counted in computing the years of service required by t h i s [action.] section.L.[g]The decision of t h e Board t o reappoint with tenure s h a l l be communicated t o the personaffected not l a t e r than May f i r s t preceding the expiration of the f i f t h f u l l year of service.Where an appointee begins h i s service prior to September f i r s t , t h e tenure period shall notbegin u n t i l the succeeding September f i r s t ; and when an appointment i s made during the monthof September, the appointment s h a l l date as of September f i r s t f o r t h e purposes of tenure.Section 6 . 3 of the Bylaws of t h e Board of Higher Education i s hereby amended t o read'asfollows:SECTION 6.3 APPOINTMENTS WITHOUT TENURE:Nothing contained i n t h i s a r t i c l e s h a l l be construed as conferring o r permitting tenure, o rservice c r e d i t toward the achievement of tenure i n t h e positions of chancel l o r , president,vice-chancellor, provost, vice-president, university dean, dean, associate dean, a s s i s t a n tdean, department chairman, chief 1i b r a r i a n , p r i n c i p a l , supervisor, higher education o f f i c e r ,higher education a s s o c i a t e , higher education a s s i s t a n t , a s s i s t a n t t o higher educationo f f i c e r , research a s s o c i a t e , research a s s i s t a n t , l e c t u r e r , i n s t r u c t o r appointed a f t e r[June 16, 19681 September 30, 1968, business manager, [ f i s c a l o f f i c e r , ] a s s i s t a n tbusiness manager, [ a s s i s t a n t f i s c a l o f f i c e r . a s s i s t a n tt o business manager, [ a s s i s t a n t t o f i s c a l o f i c e r , ] a l l positions i n the Early ChildhoodCenter Programs, o r any o t h e r instructional position not included on the permanent instructional s t a f f . Appointment t o any such position, o r removal therefrom, however, shall notdeprive the person so appointed o r removed of tenure i n the highest position on the s t a f fheld w i t h tenure p r i o r t o his appointment t o such o f f i c e , or conjointly with such o f f i c e ,nor s h a l l such appointment o r removal deprive any person of service c r e d i t toward theachievement of tenure under t h e provisions of t h i s a r t i c l e .
