There is an old saying, if you want to hidesomething from Black people, put it in abook. That saying has for many become aself-fulfilling prophecy. David Walker’sAppeal, published initially in 1829,addressed the wretchedness of the“coloured” people—expressly those of theUnited States of America—in consequenceto colonization, religion, slavery, andignorance. Approximately 187 years later,the “coloured” still deal with these issues,especially ignorance. Many of the peoplewho refer to themselves as Black/AfricanAmerican lack knowledge and fail to realizethat they:Taj Tarik Bey, a scholarand exceptional legalmind, tells us that it isknowledge that isneeded to bring thepeople out of theircurrent position. Hegoes on to say that theaboriginal people mustbecome aware of lawand history to decideintellectually how toparticipate in thisreality. In studying, theaboriginal must studyhistory, etymology,cosmology, and law,among other subjects.People, he continues,do not understand law,what law is, and whatlaw is not. The firstissue, according to Bey,is your status. Blacks/African Americans are not perishingfrom a lack of vision; they are perishingfrom a lack of knowledge. They are miseducated from birth. Woodson’s The MisEducation of the Negro was published.Woodson told us that the system ofeducation, even if it takes place inaboriginal (meaning so-called Black/AfricanAmerican) schools, must educate the mindsof aboriginals to “be convinced of theirinferiority” and “to handicap a student byteaching him that his black face is a curseand that his struggle to change his conditionis hopeless is the worst sort of lynching.” Hewent on to write, “when a negro hasfinished his education then, he has beenequipped to begin the life of anAmericanized or Europeanized white man”and as a result, most highly educatedaboriginal people become useless to or theyabandon the group altogether. Black and White are legal statuses, notsocial identities. United States PresidentBarack Obama allegedly said on the TomJoyner Morning Show, when he wasreferred to as the first black president, notto refer to him as that because black has nostanding at law (Bey, 2016). Christians(Caucasians), during the Inquisition andcolonization, branded the aboriginal withdifferent names (i.e., black, Negro, colored)to remove their status (Bey, 2016).aboriginal people continue sending theirchildren through the system and any systemthat educates you out of your community isnot a system to be trusted. This system has,in fact, educated the aboriginals not onlyout of their community, but out of theirright minds.Unfortunately aboriginal people, in general,are emotional people, many finding comfortin religious belief rather than in seekingknowledge. Taj Tarik Bey, a scholar andexceptional legal mind, tells us that it isknowledge that is needed to bring thepeople out of their current position. Hegoes on to say that the aboriginal peoplemust become aware of law and history todecide intellectually how to participate inthis reality. In studying, the aboriginal muststudy history, etymology, cosmology, andlaw, among other subjects. People, hecontinues, do not understand law, what lawis, and what law is not. The first issue,according to Bey, is your status. What isstatus? According to Black’s Law Dictionary,Second Edition:To further clarify status and nationality:Keep in mind that the social, political, andCivilization equation and synonym for‘Unity’ is called ‘Nationality.’ Nationality isthat quality or character which arises fromthe fact of a natural person belonging to anation or nation-state. Nationalitydetermines the political status of theindividual, especially with reference toallegiance.Status refers to the ‘standing,’ state, orcondition and the social position that onehas; thus the legal relation of the individualto the rest of the community. The rights, theduties, the capacities and incapacities whichdetermine the legal categorization of aperson to a given class. Status is a legalpersonal relationship, not temporary in itsnature, nor terminable at the mere will ofthe parties, with which third persons andthe state are concerned (quoted from RVBey Publication’s promotional materials).Status. The status of a person is his legal position orcondition.Here is another good question; if it is aboutstatus, then why do people speak aboutnationality and declaring nationality.According to Black’s Law Dictionary, SecondEdition:Nationality. That quality or character which arisesfrom the fact of a person’s belonging to a nation orstate. Nationality determines the political statusof the individual, especially with reference toallegiance; while domicile determines his civilstatus. Nationality arises either by birth or bynaturalization.People without a nationality or a name (i.e.,black, Negro, colored), are consideredstateless persons.3Motherland America Magazine 2016

A stateless person is someone who is "notconsidered as a national by any state underthe operation of its law;" he or she has nocitizenship or nationality. The UN RefugeeAgency further clarifies stateless people byadding that they may have difficultyaccessing basic rights such as education,healthcare, employment and freedom ofmovement. Without these things, they canface a lifetime of obstacles anddisappointment.Many people have no doubt seen this format some time in their lives, possibly filling itout with other paper work when beginningnew employment or at school. But what dothose racial categories actually mean?American Indian and Alaska Native is thecategory that aboriginal Americans shouldselect. However, the condition of whomaintains tribal affiliation or communityattachment makes it difficult to select thiscategory, though most aboriginals have thesame oral family history of having “Indian intheir families.” This definition may bewritten this way to keep the true aboriginalout of this category, yet ensures that themodern-day Native Americans on thereservations—who are mostly Asian/Asiandilute and Caucasian, with some darkskinned aboriginals—select this category.Also adding to the confusion with checkingthis box is the creation of blood quantum.Does this sound familiar?Standard Form-181How does the aboriginal begin resolving theissue of nationality and status? He canbegin with SF-181, Ethnicity and RaceIdentification. On this form are five racialcategories with definitions (see figure 2)created by the United States Department ofEducation (IPEDS).Figure 2. The Asian and Native Hawaiian or OtherPacific Islander categories are fairly correct.The White category states origin in peoplesof Europe, the Middle East, or North Africa.The Middle East and North Africahistorically are hot climates where darkpeople originated, and archeology tells usthat the aboriginal European people weredark-skinned people. Thusly, modern-daysciences inform us that the Caucasian couldnot possibly have these origins; and this iswhat informs us that White is a status andnot a true racial class. Using the informationin the SF-181, Raven Simone can make thecase that she is “dark white” and WhoopiGoldberg and Oprah can make the case thatyes, they are “American.”1857 Dred Scott DecisionIn addition, race and ethnicity tie people tonations. There is no country called White.There is no country called Black. There is nocountry called Africa America. Africans,when they come to this country, sociallyidentify with their country of origin, not theentire continent of Africa. They are NigerianAmericans, Ghanaian Americans, and so on.However, they are also White.The most common wording from thisDecision is that a Negro or person of Africandescent “had no rights which the white manwas bound to respect.” Each time that youdeclare yourself as Black/African American,this is just one aspect of this reality that youagree to; this is why the police are able tobrutalize and execute aboriginal Americanpeople with impunity. Also note that thisDecision does not apply to any other racialcategory. The Decision definitely does notapply to the White racial category, and notethat White (Free White Person2) is notsynonymous with Caucasian.The 1857 Dred Scott Supreme CourtDecision is still relevant. The Decision isrelevant for persons referring to themselvesas Black/African American. According toBlack’s Law Dictionary, Sixth Edition:Dred Scott Case. The case in which the UnitedStates Supreme Court held that descendants ofAfricans who were imported into this country, andsold as slaves, were not included nor intended to beincluded under the word “Citizens” in theConstitution, whether emancipated or not, andremained without rights or privileges except such asthose which the government might grant them.Dred Scott v. Sanford, 60 U.S. (19 How.) 393, 15L.Ed. 691.Have you ever wondered how so manyforeigners come to the United States ofAmerica and succeed where the aboriginalfails? The reason is that most foreignerswho come here are advised of and affordedthe choice to identify politically as White.Being White in the United States comeswith privileges, while being Black comeswith restrictions such as those found in theDred Scott Decision.The Right to Self-DeterminationIf you don’t do anything else, declare yournationality.– Noble Drew Ali5Motherland America Magazine 2016

Self-determination is the right of the peopleof a particular place to choose the form ofgovernment they will have; the freedom tomake your own choices; it also meansdetermination by the people of a territorialunit of their future political status. You havethe right to self-determination. You havethe right to declare your nationality andchange your political status.According to the United Nations Declarationon the Rights of Indigenous Peoples(UNDRIP)—a United States-supportedinitiative, though initially, the United Statesvoted against adopting UNDRIP—youaboriginal, indigenous American have theright to self-determination. The UNDRIPincludes the following:Acknowledging that the Charter of theUnited Nations, the International Covenanton Economic, Social and Cultural Rights andthe International Covenant on Civil andPolitical Rights, as well as the ViennaDeclaration and Programme of Action,affirm the fundamental importance of theright to self-determination of all peoples,by virtue of which they freely determinetheir political status and freely pursue theireconomic, social and cultural development How do you change your status and yournationality?RemediesAmong aboriginal American people, variousremedies for changing status andnationality do exist. But if not, I will leave again.What else is possible (Brown, 2016)?ConclusionIn Australia:Without anywhere that is home, Indigenouspeople have been without a physical spaceto reinvent themselves and their culture inmodern Australia.Since colonisation, Aboriginal people havebeen internally displaced from their country.The doctrine of terra nullius—a land withoutpeople—was established under Britishcolonial government (and persisted inAustralian law until 1992). It served toreinforce the concept that Indigenous landwas “empty”; it belonged to no one and socould rightly be claimed for Westernexploitation or settlement. This doctrinearguably still persists in the collectiveAustralian psyche, evidenced by socialpolicies and government interventionswhich impact harmfully on Indigenouspeople and their connection to their land(Shannon, 2016).In America:The issue of legal status is an issue foraborigines all over the world; and because itis a problem all over the world, it is surelynot an accident. Without anywhere that ishome, indigenous Americans have beenwithout a physical space to reinventthemselves and their culture in modernAmerica.The problem is that by identifyingthemselves as Black/African American, thetrue aboriginals of the land have nostanding at law and no protections. On theirown homeland, the Black/AfricanAmericans are stateless persons. All aroundthem, other ethnic groups know thisinformation, but keep the sordid secret.Nationality and status are important. Youonly need turn on your television,computer, tablet, or smartphone to realizethe severity of the problems aboriginalAmericans face; lynching, public beatings,executions, mass poisonings, organharvesting, racism/oppression, and cruelty.As a people, the aboriginals of America—and of the world—must take responsibilityfor their future by making changes today.In Africa:Tedros Abraha, an Eritrean refugee whobecame a refugee because he refused toenter the military, went from Israel, toRwanda, to Uganda in search of a home. Inhis words:I’ve been in Kampala (Uganda) now forsome months. I like it here. It’s quiet, andpeople respect one another. Ugandans seeme eating injera, our sour Eritreanflatbread, and they ask, what is that? Theyhear me speak my language, Tigrinya, andthey want to know what I am saying.8Motherland America Magazine 2016
