State of CaliforniaAIR RESOURCES BOARDEXECUTIVE ORDER D-476-8Relating to Exemptions Under Section 27156of the California Vehicle CodeInjen TechnologyCyborg Intake SystemsPursuant to the authority vested in the Air Resources Board by Section 27156 of theVehicle Code; andPursuant to the authority vested in the undersigned by Section 39515 and Section39516 of the Health and Safety Code and Executive Order G-14-012;IT IS ORDERED AND RESOLVED: That the installation of the Cyborg Intake Systems,produced and marketed by Injen Technology of 244 Pioneer Place, Pomona, California91768, has been found not to reduce the effectiveness of the applicable vehiclepollution control systems and, therefore, is exempt from the prohibitions of Section27156 of the Vehicle Code for the vehicles listed in the attached Exhibit A.The Cyborg Intake Systems include the following main components: open-elementreusable air filter, intake system tubing, assorted brackets, and hardware.This Executive Order is valid provided that the installation instructions for the CyborgIntake Systems will not recommend tuning the vehicle to specifications different fromthose of the vehicle manufacturer.Changes made to the design or operating conditions of the Cyborg Intake Systems, asexempt by the Air Resources Board, which adversely affect the performance of thevehicle's pollution control system shall invalidate this Executive Order.This Executive Order shall not apply to any Cyborg Intake Systems advertised, offeredfor sale, sold with, or installed on a new motor vehicle prior to or concurrent with transferto an ultimate purchaser.Marketing of the Cyborg Intake Systems using any identification other than that shownIn this Executive Order or marketing of the Cyborg Intake Systems for an applicationother than those listed in this Executive Order shall be prohibited unless prior approvalis obtained from the Air Resources Board.This Executive Order does not constitute any opinion as to the effect the use of theCyborg Intake Systems may have on any warranty either expressed or implied by thevehicle manufacturer.
-2-This Executive Order is granted based on emission test results in the modifiedconfiguration using the Cold-Start CVS-75 Federal Test Procedure, SupplementalFederal Test Procedure (US06), and an examination of the On-Board Diagnostic IIOBD II) systems. A 2013 Fiat 500 equipped with a 1.4 liter engine (DCRXV01.44PO,LEV-II LEV) and 2014 Subaru BRZ equipped with a 2.0 liter engine (EFJXV02.0AJM,LEV-II LEV) were used for the evaluation of the Cyborg Intake Systems. Results fromemissions testing conducted at the Specialty Equipment Manufacturers Association,SEMA Garage, are shown below (in grams per mile):Fiat 500US06NMHC NOxEmission Level 0.04960.14STDCO4.368.0Subaru BRZNMHC NOxEmission Level 0.0736COUS06STD0.141.678.0The emission test results in the modified configuration were below the applicablecertification standards. Examination of the OBD II system showed the Cyborg IntakeSystems do not affect OBD II operation. Therefore, based on the test results, the staffconcludes that the Cyborg Intake Systems meet the criteria for exempting generalcriteria parts.The ARB reserves the right in the future to review this Executive Order and theexemption provided herein to assure that the exempted add-on or modified partcontinues to meet the standards and procedures of Title 13, California Code ofRegulations, Section 2222, et seq.
