PART I: PURPOSE, OBJECTIVE, AND SCOPESection 1. Purpose(A) The purpose of this document is to provideuniform administrative procedures supporting thecreation and operation of a state-level compact thatneed not be approved by U.S. Congress under theU.S. Constitution and applicable decisions of theU.S. Supreme Court. Accordingly, these UniformAdministrative Procedures shall be interpreted inaccordance with the following principles:(1) These Uniform Administrative Proceduresshall not enhance state political power norencroach on federal supremacy.(2) These Uniform Administrative Proceduresshall not authorize the participating states toexercise any powers that they could notexercise in the absence of the InterstateCompact on Industrialized/ Modular Buildings.(3) These Uniform Administrative Proceduresshall not delegate any sovereign power to theCommission.(4) Each participating state retains completefreedom to adopt or reject these UniformAdministrative Procedures.(5) These Uniform Administrative Proceduresshall not provide to the Commission anyauthority to punish failures to comply with theseUniform Administrative Procedures; provided,however, the Commission may act on behalf ofthe participating states in certifying, withholding, or revoking certification of evaluationand i n s p e c t i o n a g e n c i e s andindustrialized/modular buildings andbuilding components.(6) These Uniform Administrative Proceduresshall not affect a participating state’sfreedom to certify, for that state's intrastatepurposes, evaluation and inspection agenciesoperating in that state andindustrialized/modular buildings andbuilding components for use in that state,where such evaluation or inspection agencyor industrialized/modular building orbuilding component has not been or is notcertified pursuant to the Interstate Compact onIndustrialized/Modular Buildings.(B) The further purpose of this document is toprovide uniform administrative procedures for aparticipating state to adopt by reference toeffectively implement the Interstate Compact onIndustrialized/Modular Buildings. The adoption ofthese Uniform Administrative Procedures by theparticipating state will create uniformity in thecompliance requirements of individual states;promote the use of new technologies, techniques,and materials; and increase the availability of safe,decent, and affordable housing and other buildingoccupancies.(C) It is further the purpose of this document toprovide uniform administrative procedures for theCommission to assure state and local officials, andother parties, in other states, of the substantialcompliance of industrialized/modular buildingconstruction with the construction standard orrequirements of such other states; to assess theadequacy of building systems; and to verify andassure the competency and performance ofevaluation and inspection agencies. Adherence towhich will be evidenced by the affixing of aCommission's certification label pursuant to theseUniform Administrative Procedures.Section 2. ObjectiveTo provide uniform administrative procedurespursuant to the findings and declarations of theInterstate Compact on Industrialized/ModularBuildings, as stated below:(A) The Commission finds that:(1) Industrialized/modular buildings andbuilding components are constructed infactories in the various states and are agrowing segment of the nation's affordablehousing and commercial building stock.(2) The regulation ofindustrialized/ modularbuildings and building components variesfrom state to state and locality to locality, whichcreates confusion and burdens state and localbuilding officials and the industrialized/modular buildings industry.(3) Regulation by multiple jurisdictionsimposes additional costs, which are ultimatelyborne by the owners and users ofindustrialized/modular buildings andbuilding components; restricts market access;and discourages the development andincorporation of new technologies.1Issued 8/1/2002

IBC Uniform Administrative ProceduresI–2(B)(B) It is the policy of the Commission to:(1) Provide the states which regulate thedesign and construction of industrialized/modular buildings and building componentswith a system to coordinate and uniformlyadminister their rules and regulations for suchbuildings, all in a manner to assure mutualacceptance of industrialized/modularbuildings and building components.(2) Provide to the U.S. Congress assurancesthat would preclude the need for a voluntarypreemptive Federal regulatory system forindustrialized/modular housing, as outlined inSection 572 of the Housing and CommunityDevelopment Act of 1987, includingdevelopment of model standards forindustrialized/modular housing construction, suchthat design and performance will insure quality,durability, and safety; will be in accordance withcost-effective energy conservation standards; allto promote the lowest total construction andoperating costs over the life of such housing.Section 3. ScopeThese Uniform Administrative Procedures govern themanner in which the Commission will assureparticipating states of the substantial compliance ofindustrialized/modular building construction withthe construction standard of the state in which suchconstruction will be erected; to assess the adequacyof building systems; and to verify and assurecompetency and performance of evaluation andinspection agencies.Industrialized/modularbuildings or building components certified pursuantto these Uniform Administrative Procedures may besold for, delivered to, or installed on building siteslocated in any such participating state.2Issued 8/1/2002

The definition shall not include products,such as structural, electrical, and plumbing fixturesand equipment which are tested, listed, labeled, andcertified by a nationally recognized testing laboratory."ACT" means the laws of the participating stategoverning industrialized/modular construction asamended and supplemented by the enablinglegislation of the Interstate Compact onIndustrialized/Modular Buildings."CODE" means the codes, standards, specifications,and requirements adopted pursuant to PART III,Section 1 of the Model Rules and Regulations."COMMISSION" meansBuildings Commission."APPROVED" means approved by theIndustrialized Buildings Commission, aparticipatingstate, or a designated evaluation/ ANCEDOCUMENTS" means approved building systemdocuments, an approved compliance assurancemanual, and approved on-site installationinstructions."BUILDING COMPONENT" means any subsystem, subassembly, or other system of closedconstruction designed for use in or as part of astructure, which may include structural, electrical,mechanical, plumbing, and fire protection systemsand other systems affecting health and safety."COMPLIANCE ASSURANCE PROGRAM"means the policies and procedures which assure thatindustrialized/modular buildings and buildingcomponents, including their manufacture, storage,delivery, assembly, handling, and installation,conform with these Uniform AdministrativeProcedures."BUILDING SYSTEM" means the method ofconstructing a type of industrialized/modularbuilding or building component described byplans, specifications, and other documentation whichtogether establish a set of limits meeting the buildingcodes, standards, and other requirements of theseregulations for that type of industrialized/modularbuilding or building component, which mayinclude structural, electrical, mechanical, plumbing,and fire protection systems and other systemsaffecting health and safety."DESIGNATED" means selected by theCommission to perform one (1) or more of theinspection and/or evaluation functions described underthese Uniform Administrative Procedures."EVALUATION AGENCY" means a designatedperson or organization, private or public, determinedby the Commission to be qualified by reason offacilities, personnel, experience, and demonstratedreliability and independence of judgment, toinvestigate and evaluate industrialized/modularbuildings, building components, building systems,or compliance assurance programs."CERTIFICATION" means the process by whichparticipating states and local building inspectionagencies are assured that elements of closedconstruction, not practical to inspect at the buildingsite, conform to the building codes."CERTIFICATION LABEL" means anapproved insignia or seal evidencing certificationin accordance with these Uniform AdministrativeProcedures."INDEPENDENCE OF JUDGMENT" means notbeing affiliated with or influenced or controlled bybuilding manufacturers or by producers, suppliers, orvendors of products or equipment used inindustrialized/modular buildings and buildingcomponents, in any manner which is likely to affectcapacity to render reports and findings objectively andwithout bias."CLOSED CONSTRUCTION" means anybuilding, building component, assembly, or systemmanufactured in such a manner that concealed partsor processes of manufacture cannot be inspected at3Issued 8/1/2002

IBC Uniform Administrative UILDING" means any building of closedconstruction; i.e., constructed in such a manner thatconcealed parts or processes of manufacture cannotbe inspected at the site, without disassembly,damage, or destruction, and which is made orassembled in manufacturing facilities, off the buildingsite, for installation, or assembly and installation,on the building site. "Industrialized/modular building"includes, but is not limited to, modular housing whichis factory-built single-family and multi-family housing(including closed wall panelized housing) and othermodular, nonresidential buildings. "Industrialized/modular building" does not include any structuresubject to the requirements of the NationalManufactured Home Construction and SafetyStandards Act of 1974."NONCONFORMANCE" means the failure toadhere to the requirements of an approved buildingsystem, or where the building system is not specific,to the code."PARTICIPATING STATE" means anycompacting state or any non-compacting state actingunder the purview of an interim reciprocalagreement."INSPECTION AGENCY" means a designatedperson or organization, private or public, who isdetermined by the Commission to be qualified byreason of facilities, personnel, experience, anddemonstrated reliability and independence ofjudgment, to monitor compliance assuranceprograms."INSTALLATION" means the process ofaffixing, or assembling and affixing,industrialized/modular buildings or buildingcomponents on the building site."INTERIM RECIPROCAL AGREEMENT"means a formal reciprocity agreement as defined inthe enabling legislation of the Interstate Compact onIndustrialized/Modular Buildings."LOCAL ENFORCEMENT AGENCY" meansthe agency or agencies of the participating statesor local government with authority to inspectbuildings and enforce the law, ordinances, andregulations which establish standards andrequirements applicable to the construction,installation, alteration, repair, or relocation ofbuildings."MODULE" means a closed wall structure orsubstantial part of a closed wall structureincorporating one or more rooms used as habitable,occupiable, or mechanical/equipment space.4Issued 8/1/2002

PART III. STANDARDSSection 1. Standards, Specifications, andRequirements AdoptedThe codes of the participating states are herebyincorporated by reference and shall constitute theconstruction standards which govern the design,manufacture, handling, storage, delivery, andinstallation of industrialized/modular buildingsand building components manufactured pursuant tothese Uniform Administrative Procedures.evaluation agency with respect thereto, followingsuch 180 calendar day period, may be certified if themodifications conform to the existing approvedbuilding system. Where imminent danger to lifesafety is involved, the participating state mayrequire that immediate effect be given toamendments to the codes, standards, specifications,and requirements adopted herein. For purposes ofthis Section, an industrialized/modular building orbuilding component is deemed to be manufacturedat such time as the certification label is attached toit in accordance with the approved complianceassurance program, or if the industrialized/modular building or building component isrelocated, it is deemed to be in accordance withthese Uniform Administrative Procedures per PartIV, Section 4(A)(7).Each participating state shall maintain appropriateinformation, indicating those areas of theparticipating state which it has established ashaving special environmental conditions such assnow, wind loads, seismic conditions, temperature,humidity, and soil conditions requiring special ordifferent building standards. Such information shallbe provided to the Commission and shall beavailable for public inspection.Section 3. Formal Technical Opinions(A) Scope . The Commission shall issue a FormalTechnical Opinion whenever it determines that it isnecessary to ensure uniformity in the interpretationand/or enforcement of the partici-pating state’sstandards, specifications, and requirements.Section 2. AmendmentsA participating state may propose amendments toits adopted codes, standards, specifications, andrequirements. Each proposed amendment shallinclude a proposed date for the amendment to takeeffect. All public hearings concerning suchamendments shall be held pursuant to the laws ofthat participating state. Written notice of all suchproposals and any subsequent adoptions shall beprovided to the Commission.(B) Limitations. The Commission will issue aFormal Technical Opinion only if a code section isadopted by more than one participating state andonly when interpretations and/or enforcement ofsuch code sections are inconsistent.
