Permit No. NCS000250PART IPERMITTED ACTIVITIESDuring the period beginning on the effective date of the permit and lasting until expiration,NCDOT is authorized to discharge NCDOT general roadway and railway drainage, non-roadwayfacility drainage, borrow pit wastewater and stormwater associated with industrial activities.Covered NCDOT activities include the following: Industrial Facilities with the following activities- Ferry terminals and maintenance activities- Vehicle and equipment maintenance- Pesticide and fertilizer storage- Salt and deicing chemical storage- Material Storage Areas- Asphalt and concrete plants- Rail maintenance activitiesOther Activities- Construction activities disturbing greater than one acre- Borrow pits/waste piles (including mines)- General roadway including weigh stations and railway drainage- Non-roadway facility drainage (i.e., office buildings and rest areas)Waste pile activities shall be covered under this permit unless the site requires a permit from theDivision of Waste Management. If a Division of Waste Management permit is required, thefacility also must file an application with Division of Water Quality (DWQ) for coverage under aseparate NPDES stormwater permit.All new general roadway including weigh stations and railway drainage, construction and borrowpit/waste pile activities, and non-roadway facility drainage will receive automatic coverage underthis permit. Location information for construction and borrow pit/waste pile activity will beprovided to DWQ upon request per Part II, Section D.3.New industrial facilities must request coverage under this permit (see Part II, Section E.4). Notethat for the purposes of this permit, industrial facilities shall mean all the covered NCDOTactivities listed above with the exception of general roadway drainage, construction activities,borrow pits/waste piles, and non-roadway facility drainage. A list of existing covered industrialfacilities is provided in Appendix B of the Fact Sheet for this permit.All discharges authorized herein shall be adequately treated and managed in accordance with theterms and conditions of this permit. Any other point source discharge to surface waters of thestate is prohibited unless it is an allowable non-stormwater discharge or is covered by anotherpermit, authorization or approval.Coverage of vehicle and equipment maintenance facilities and mining activities under this permitsupersedes the requirements to seek discharge authorization under the NCDENR general permitsNCG020000 (applicable to stormwater point source discharge outfalls associated with miningPart I Page 1 of 2

Permit No. NCS000250and quarrying of nonmetallic minerals (except fuels), land disturbance, and vehicle maintenance,mine dewatering discharge outfalls, wastewater discharge outfalls from sand and/or graveloperations, nondischarging closed loop recycle systems and process recycle wastewater dischargeoutfalls) and NCG080000 for owners or operators of stormwater point source dischargesassociated with activities that have Vehicle Maintenance Areas, unless specifically required bythe Director.This permit does not include water quality-based effluent limits; therefore, in the event thepermittee’s discharges are found by the NCDENR Division of Water Quality (DWQ) to cause orcontribute to a violation of in stream water quality standards, the DWQ may take enforcementaction or NCDOT and DWQ shall conduct an assessment and implement the permit requirementsnecessary to adequately address the permittee’s contribution to the water quality standardsviolation.This permit does not relieve the permittee from responsibility for compliance with any otherapplicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.Part I Page 2 of 2

PART IIMONITORING, CONTROLS, AND LIMITATIONS FORPERMITTED DISCHARGESSECTION A ILLICIT DISCHARGE DETECTION AND ELIMINATION PROGRAMa.Objectivesi.ii.b.Implement an Illicit Discharge Detection and Elimination Program toassure that the illicit discharges, spills and illegal dumping into theNCDOT transportation separate storm sewer system (TS4) are detectedand eliminated.NCDOT shall implement appropriate procedures and actions to reportillicit spills, discharges and illegal dumping for appropriate enforcement orother action by NCDENR.Management MeasuresThe NCDOT shall implement the following management measures to meet the objectivesof the Illicit Discharge Detection and Elimination Program and shall notify the DWQprior to modification of any goals.Management Measures(a) Provide illicit dischargeidentification training.(b) Perform illicit dischargeinspections.Measurable GoalsNCDOT shall provide annual training for appropriate staff andcontractors. Training shall include identification and reportingof illicit discharges and illegal dumping.NCDOT shall perform inspections for illicit discharges to thestormwater drainage system and illegal dumping activitieswhen performing other work on the NCDOT system.(c) Maintain a standard pointof contact.NCDOT shall maintain a standard reporting format andcontact for all complaints and reports of illicit discharges.(d) Report illicit discharges.NCDOT shall investigate all reports of illicit discharges orillegal dumping. NCDOT shall report verified illicitdischarges to the appropriate DWQ Regional Office within 30days of verification.(e) Maintain a trackingdatabase.NCDOT shall maintain a tracking database for reports of illicitdischarges.Part II Page 1 of 20

SECTION B1.POST-CONSTRUCTION CONTROLSStormwater System Inventory and Prioritization Programa.Objectivesi.ii.iii.b.Maintain the statewide NCDOT stormwater system inventory for thepurpose of supporting other permit programs.Maintain a stormwater system GIS to map and prioritize sensitive watercrossings.Maintain a field inventory procedure to be used for NCDOT/DWQidentified priority areas.Management MeasureThe NCDOT shall implement the following management measure to meet theobjectives of the Stormwater System Inventory and Prioritization Program andshall notify the DWQ prior to modification of any goals.Management Measure(a) Maintain a stormwatersystem inventory ofexisting stormwateroutfalls to sensitivewaters.Measurable GoalsNCDOT will maintain a GIS-based implicit stormwateroutfall inventory to include outfalls from primary andsecondary roadways.(b) Include in the inventoryoutfalls from newconstruction projects toall surface waters andwetlands.The stormwater outfall inventory shall be updated annuallyto include outfalls from new construction projects.(c) Include outfalls forNCDOT industrialfacilities in theinventory.(d) Field outfall inventoryprocedure for priorityareas.The stormwater outfall inventory shall be updated annuallyto include changes or additions to previously inventoriedNCDOT industrial facilities.The inventory shall be used to assist in the location ofretrofits, among other purposes.NCDOT will maintain the field outfall inventoryprocedure, work with DWQ to identify priority areas andreport annually on priority areas.Part II Page 2 of 20

2.BMP Retrofitsa.Objectivesiii.iii.b.Develop, implement and support the NCDOT program to beconsistent with NPDES post-construction control measures.Use retrofits to address pollutant loading from existing NCDOT activities.Retrofits should not be associated with meeting the requirements of anyother DWQ program, unless otherwise allowed.Management MeasuresThe NCDOT shall implement the following management measures to meet the objectivesof the BMP Retrofit Program and shall notify the DWQ prior to modification of anygoals.Management Measures(a) Identify appropriate retrofitsites.Measurable GoalsLocate a minimum of fourteen (14) sites per yearthat are appropriate for retrofit installation.Appropriate sites are those identified as having thepotential to contribute significant pollutant loadingto a receiving stream and possessing suitablecharacteristics for installation or implementationof an appropriate retrofit.(b) Implement /Install BMPRetrofits.Implement a minimum of five (5) retrofit projectsper year, with a total of seventy (70) retrofitsimplemented over the 5-year period of this permit.The retrofits will be appropriate for the identifiedpollutants of concern. Submit annual report on thenumber of retrofits identified, implemented, and inprogress.Part II Page 3 of 20

3.BMP Toolbox for Post-Construction Stormwater Programa.Objectivesi.ii.iii.b.Maintain and update as necessary a BMP Toolbox to aid in the siting,design, and construction of stormwater quality BMPs with guidance on thesuitability of each for NCDOT applications.Evaluate BMPs for applicability to a linear highway system.Implement new and innovative technology on an experimental basis and inkeeping with the current DWQ policy on new stormwater treatmenttechnologies (Permitting New Stormwater Treatment Technologies”,DEHRNR, November 24, 1997, or as amended), provided as an appendixto the Fact Sheet.Management MeasuresThe NCDOT shall implement the following management measures to meet the objectivesof the BMP Toolbox for Post-Construction Stormwater Program and shall notify theDWQ prior to modification of any goals.Management Measures(a) Maintain a BMPToolbox.(b) Evaluate designrelated BMPs.(c) Submit proposedBMP Toolboxrevisions to DWQ forapproval.Measurable GoalsMaintain a stormwater BMP Toolbox to provide internal guidanceon design of post-construction stormwater control measures. TheBMP Toolbox will include appropriate uses/anticipatedapplications, design criteria, materials specifications, and pollutantremoval potential. Innovative or proprietary BMPs will beevaluated in keeping with the DWQ policy for permittingnew/innovative technologies (“Permitting New StormwaterTreatment Technologies”, DEHNR, November 24, 1997, or asamended) provided as an appendix to the Fact Sheet.Investigate and document the impacts associated with addressingstormwater during the planning phase of a project by evaluatingdesign related BMPs such as reduced pavement widths, eliminatingcurb and gutter, providing diffuse flow, etc. The investigation mayconsist of pilot studies, monitoring, literature research, and otherappropriate resources. Documentation of the investigation shallinclude characterization of pollutant reduction for each measure andrecommendations on the feasibility of incorporating these measuresinto the NCDOT planning process. Documentation and progressreports shall be provided to DWQ in the annual reports.New guidance on proposed BMPs will be submitted for DWQapproval as they are developed and approved prior toimplementation.Part II Page 4 of 20

4.BMP Inspection and Maintenance Programa.Objectivesi.ii.b.Maintain a BMP Inspection and Maintenance Program to aid in theinspection, operation and maintenance of BMPs.Maintain and update as necessary the BMP Inspection andMaintenance Manual.Management MeasuresThe NCDOT shall implement the following management measures to meet the objectivesof the BMP Inspection and Maintenance Program and shall notify the DWQ prior tomodification of any goals.Management Measures(a) Evaluate new BMPinspection andmaintenance needs.Measurable GoalsEvaluate new BMPs included in the BMP Toolbox for inspectionand maintenance needs. The evaluation will includeconsideration of the BMP type, siting conditions, and StateStormwater Program requirements.(b) Evaluate BMPInspection andMaintenanceManual.Evaluate written procedures outlining the inspection andmaintenance requirements for various types of stormwater BMPs.Written procedures will outline the regular inspection frequency,and include an inspection checklist, “how-to” instructions forregular maintenance, evaluation and reporting procedures for nonroutine maintenance, and an inspection and maintenance trackingmechanism. As modifications are needed, update the Manual toaddress needed changes to inspection and maintenancetechniques.(c) Implement a BMPInspection andMaintenanceProgram.Implement a BMP Inspection and Maintenance Program. Theprogram will include training for appropriate NCDOT staff, andcontractors.(d) BMP Inspection andMaintenanceinformation.Inspection and Maintenance information will be made availableupon request to DWQ.Part II Page 5 of 20

5. Post-Construction Stormwater Programa.ObjectivesIn cooperation with DENR, implement a post-construction stormwater program toregulate stormwater from new NCDOT development and redevelopment for newbuilt upon area (BUA) by requiring structural and non-structural best managementpractices to protect water quality, reduce pollutant loading, and minimize postconstruction impacts to water quality.b.Management MeasuresThe NCDOT shall implement the following management measures to meet the objectivesof the Post-Construction Runoff Stormwater Program and shall notify the DWQ prior tomodification of any goals.Management Measures(a) Post ConstructionStormwater ControlMeasuresMeasurable GoalsImplement post-construction stormwater control measures fordischarges in accordance with the Post-Construction StormwaterProgram.(b) Implement a PostConstructionStormwater Program.Implement a Post-Construction Stormwater Program (PCSP) tocontrol runoff from new NCDOT development and redevelopment .The PCSP shall define implementation of the approved NCDOTBMP Toolbox, define a training program for appropriate NCDOTstaff, and contractors to implement the Toolbox and incorporatewatershed quality strategies.(c) Submit revisions toNCDOT updates and/or revisions shall be submitted to the DWQ forthe Post-Construction approval prior to implementation. .Stormwater Programto DWQ forapproval.Part II Page 6 of 20

6.Vegetation Management Programa.Objectivesi.iib.Manage application of pesticides, fertilizers, and other vegetationmanagement materials to minimize pollutant potential of stormwaterrunoff.Use only approved vegetation management materials.Management MeasuresThe NCDOT shall implement the following management measures to meet the objectivesof the Vegetation Management Program and shall notify the DWQ prior to modificationof any goals.Management Measures(a) Implement appropriatepest control practices.Measurable GoalsContinue to consult with NCDA and NCSU in selecting appropriatepest control methods and implementation practices. NCDOT willmaintain and update the NCDOT Roadside Vegetation ManagementManual as new technology and procedures are developed.(b) Use appropriatevegetationmanagementmaterials.Restrict pesticide and fertilizer usage to those materials approved byEPA/NCDA. Pesticide and fertilizer shall be used in accordancewith label restrictions.(c) Provide training onvegetationmanagement.Provide annual training for vegetation management personnel andcontractors, or require equivalent training for contractors. Thetraining shall consist of appropriate uses and applications of pestcontrol methods used by NCDOT. This training shall be designedto increase awareness of proper mowing techniques, release ofbiological and chemical agents, appropriate spill response, thecorrect use and handling of products and the potential for waterquality impacts.Part II Page 7 of 20

SECTION C1.PROGRAM FOR ENCROACHMENTObjectivesAssist DENR to ensure all discharges to NCDOT’s roadway drainage are properlypermitted under applicable laws and rules.2.Management MeasuresThe NCDOT shall implement the following management measures to meet the objectivesof this section and shall notify the DWQ prior to modification of any goals.Management Measures(a) Require certificationof stormwaterprogram coverageand compliance.Measurable GoalsNCDOT shall require that all facilities requesting to connect toNCDOT roadway drainage submit a certification of appropriateNPDES and State Stormwater Program coverage and arecompliance at the time of the request.Part II Page 8 of 20

SECTION D1.CONSTRUCTIONSediment and Erosion Control Programa.Objectivesi.ii.iii.iv.b.Continue to control development activities disturbing one or more acres ofland surface including activities by NCDOT contractors.Require construction site operators to implement appropriate erosion andsediment control practices,Require site inspection and enforcement of control measures.Establish requirements for construction site operators to control waste thatmay cause adverse impacts to water quality such as discarded buildingmaterials, concrete truck washout, chemicals, litter, and sanitary waste atthe construction site.Management Measuresi.Implementation of the NCDENR Division of Land Resources Erosion andSediment Control Program delegated to NCDOT by the SedimentationControl Commission in February, 1991, and as may be subsequentlyamended, for NCDOT construction projects and implementation of theGeneral Permit NCG010000 effectively meets the objectives above bypermitting and controlling development activities disturbing one or moreacres of land surface and those activities less than one acre that are part ofa larger common plan of development. This program is authorized underthe Sediment Pollution Control Act of 1973 and Chapter 4 of Title 15A ofthe North Carolina Administrative Code. This program includesprocedures for public input, sanctions to ensure compliance, requirementsfor construction site operators to implement appropriate erosion andsediment control practices, review of site plans which incorporatesconsideration of potential water quality impacts, and procedures for siteinspection and enforcement of control measures. This program has beendelegated to and implemented by NCDOT.ii.NCDOT shall incorporate the requirements of NCG010000, the NorthCarolina General Permit to Discharge Stormwater under the NationalPollutant Discharge Elimination System associated with constructionactivities issued October 1, 2001 and as may be subsequently amended,into its delegated Erosion and Sediment Control Program, pursuant to“Guidance on Complying with the Applicable Requirements of NCG01”in the memorandum dated September 9, 2009 or as updated.Part II Page 9 of 20

2.Borrow Pit and Waste Pile Activitiesa.ObjectiveContinue to implement sediment and erosion control measures and reclamation plans onall borrow pit and waste pile projects, including activities at Ferry Terminals associatedwith dredging activities and contractor owned or leased borrow pits associated withNCDOT projects in keeping with the sediment and erosion control program establishedby the North Carolina Sediment Control Commission.b.Management MeasuresThe NCDOT shall implement the following management measures to meet the objectivesof the Borrow Pit/Waste Pile Program and shall notify the DWQ prior to modification ofany goals.Management Measures(a) Implement erosion andsediment controlmeasures on all noncommercial borrowpits/waste piles.Measurable GoalsNCDOT shall implement erosion and sediment control measureson all non-commercial borrow pit and waste pile projects. Themeasures utilized shall be in keeping with the erosion andsediment control program established by the North CarolinaSedimentation Control Commission.(b) Implement approvedreclamation plans onall borrow pits/wastepiles.NCDOT shall implement the approved reclamation plan on allborrow pit/waste pile projects. The reclamation measures utilizedshall be in keeping with the reclamation program established bythe North Carolina Mining Commission.(c) Borrow Pit DischargeManagement ProgramNCDOT in coordination with DWQ will implement the Borrow PitDischarge Management Program. This process will consist of thefollowing tasks:Implement appropriate management measures to treat borrowpit wastewater for given conditions.Implement an inspection and maintenance program.Maintain training material and instruct field personneloverseeing borrow pit operations.Evaluate and implement appropriate new/innovativetechnologies.3.Construction and Borrow Pit/Waste Pile ActivitiesUpon request NCDOT shall provide DWQ a list of all new and completed constructionand borrow pit/waste pile activities subject to this permit.Part II Page 10 of 20

SECTION E INDUSTRIAL ACTIVITIES1.Develop, Maintain and Implement Stormwater Pollution Prevention Plansa.Objectivei.ii.b.Maintain and implement a Stormwater Pollution Prevention Plan (Plan)for each facility with an industrial activity that is covered by this permit.Develop and implement a Plan prior to operation of any new industrialfacilities.Management MeasuresThe NCDOT shall implement the following management measures to meet the objectivesof the Industrial Activity Program and shall notify the DWQ prior to modification of anygoals.Management MeasuresMaintain andimplement a SPPP foreach covered industrialactivity and relatedfacility.2.Measurable GoalsNCDOT shall maintain and implement a site specificStormwater Pollution Prevention Plan (SPPP) for eachcovered facility with an industrial activity. For newactivities or facilities, the SPPP shall be developed andimplemented prior to operation. SPPP requirements arelisted below.Stormwater Pollution Prevention Plan (SPPP) Requirements for IndustrialActivitiesa.The Plans shall be considered public information in accordance with theprovisions of this permit.b.The Plan shall include, at a minimum, the following items:i.Site Plan. The site plan shall provide a description of the physical facilityand the potential pollutant sources which may be expected to contribute tocontamination of stormwater discharges. The site plan shall contain thefollowing:(a)A general location map (USGS quadrangle map or appropriatelydrafted equivalent map), showing the facility's location in relationto transportation routes and surface waters, the name of thereceiving water(s) to which the stormwater outfall(s) discharges, orif the discharge is to a municipal separate storm sewer system, thename of the municipality and the ultimate receiving waters; andaccurate latitude and longitude of the point(s) of discharge.Part II Page 11 of 20

ii.(b)A narrative description of storage practices, loading and unloadingactivities, outdoor process areas, dust or particulate generating orcontrol processes, and waste disposal practices.(c)A site map drawn to scale with the distance legend indicatinglocation of industrial activities (including storage of materials,disposal areas, process areas and loading and unloading areas),drainage structures, drainage areas for each outfall and activitiesoccurring in the drainage area, building locations and impervioussurfaces, and the percentage of each drainage area that isimpervious. For each outfall, provide a narrative description of thepotential pollutants which could be expected to be present in thestormwater discharge.(d)A list of significant spills or leaks of pollutants that have occurredat the facility during the 3 previous years and any corrective actionstaken to mitigate spill impacts.(e)Certification that the stormwater outfalls have been evaluated forthe presence of non-stormwater discharges. The certificationstatement will be signed in accordance with the requirements foundin Part III, Section A, Paragraph 6.Stormwater Management Plan. The stormwater management plan shallcontain a narrative description of the materials management practicesemployed which control or minimize the exposure of significant materialsto stormwater, including structural and nonstructural measures. Thestormwater management plan, at a minimum, shall incorporate thefollowing:(a)A review of the technical and economic feasibility of changing themethods of operations and/or storage practices to eliminate orreduce exposure of materials and processes to stormwater.Wherever practical the permittee shall cover all storage areas,material handling operations, and manufacturing or fuelingoperations to prevent materials exposure to stormwater. In areaswhere elimination of exposure is not practical, the stormwatermanagement plan shall document the feasibility of diverting thestormwater runoff away from areas of potential contamination.(b)A schedule to provide secondary containment for bulk storage ofliquid materials, storage of Section 313 of Title III of theSuperfund Amendments and Reauthorization Act (SARA) waterpriority chemicals, or storage of hazardous substances to preventleaks and spills from contaminating stormwater runoff. If thesecondary containment devices are connected directly tostormwater conveyance systems, the connection shall be controlledPart II Page 12 of 20

by manually activated valves or other similar devices [which shallbe secured with a locking mechanism] and any stormwater thataccumulates in the containment area shall be at a minimumvisually observed for color, foam, outfall staining, visible sheensand dry weather flow, prior to release of the accumulatedstormwater. Accumulated stormwater shall be released if found tobe uncontaminated. Records documenting the individual makingthe observation, the description of the accumulated stormwater andthe date and time of the release shall be kept for a period of fiveyears.(c)A narrative description shall be provided of Best ManagementPractices (BMPs) to be considered such as, but not limited to, oiland grease separation, debris control, vegetative filter strips,infiltration and stormwater detention or retention, where necessary.The need for structural BMPs shall be based on the assessment ofpotential of sources to contribute significant quantities ofpollutants to stormwater discharges and data collected throughmonitoring of stormwater discharges.(d)Inspection schedules of stormwater conveyances and controls andmeasures to be taken to limit or prevent erosion associated with thestormwater systems.(e)Vehicle and Equipment Cleaning Areas. The plan must describemeasures that prevent or minimize contamination of thestormwater runoff from all areas used for vehicle and equipmentcleaning. The facility shall consider performing all cleaningoperations indoors, covering the cleaning operation, ensuring thatall washwater drain to the sanitary sewer system (i.e., not thestormwater drainage system, unless permitted by another NPDESgeneral or individual permit), collecting the stormwater runofffrom the cleaning area and providing treatment or recycling, orother equivalent measures. If sanitary sewer is not available to thefacility and cleaning operations take place outdoors, the cleaningoperations shall take place on grassed or graveled areas to preventpoint source discharges of the washwater into the storm drains orsurface
