5 Idaho State University Compliance Rules/Statement Purpose The Compliance Office subscribes to and enforces all rules and regulations of Idaho State University, Big Sky Conference, and NCAA. The Idaho State University Athletic Department has designated the Associate Athletic Director for Compliance and Student Support responsible for NCAA Rules of Compliance and Rules of Education. In addition to the above mentioned position there is a Compliance Officer who has direct authority and responsibilities in monitoring the prescribed policies and procedures. The Compliance Officer conducts monthly Rules Education Meetings. A representative from each sport is required to attend. All administrative staff is encouraged to attend. It is vital that all Athletic Staff members are knowledgeable of NCAA Rules and Regulations; and the systems used to monitor compliance at Idaho State University. Internal Compliance/Rules Manual This manual was designed for the reader to identify all areas of responsibility and the procedures used, the forms that are required, and the methods of filing such forms and storing records in order to carry out such responsibilities that fall on the shoulders of the compliance office staff. As with most manuals, this manual is to be updated annually or as certain procedure is changed and/or certain forms are either added or deleted from the compliance program. Throughout the course of the year there will be numerous items that must be either turned in or addressed by the coaching staffs at certain due dates, there will be numerous items that must be sent out at certain times of the year by members of the compliance office staff to administration and coaching staffs; there will be various audits made by compliance personnel to ensure that they have all the required documentation on file and that the athletic administration has institutional control over the sport programs’ operations. 7 Institutional Control Per NCAA bylaw 2.1.1 Institutional Control is the responsibility of each member institution to control its intercollegiate athletics program in compliance with the rules and regulations of the Association. The institution’s chief executive officer is ultimately responsible for the administration of all aspects of the athletics program. An institution demonstrates institutional control when: 1. Formal institutional policies and procedures for compliance are in place and being monitored and enforced, and are established in such a way as to deter violations before they occur. 2. Communication of compliance procedures occurs clearly and regularly and steps are taken to alter or correct a compliance system when there is an indication the system is not working. 3. Upon Learning of a violation, the institution takes swift and meaningful action. 4. The institution makes clear the violations of NCAA rules will result in discipline and possible discharge. 5. The institution makes clear that individuals have the responsibility to self-report any NCAA rules violation without fear of negative consequences. 6. Meaningful compliance-education programs exist for personnel engaged in athletic related activities. 8 COMPLIANCE MANUAL The National Collegiate Athletic Association’s (NCAA) purposes are to: Initiate, stimulate and improve intercollegiate athletics programs for student-athletes and to promote and develop educational leadership, physical fitness, athletics excellence and athletics participation as a recreational pursuit; To uphold the principle of institutional control of, and responsibility for, all intercollegiate sports in conformity with the constitution and bylaws of this Association; To encourage its members to adopt eligibility rules to comply with satisfactory standards of scholarship. Sportsmanship, and amateurism; To formulate, copyright and publish rules of play governing intercollegiate athletics; To preserve intercollegiate athletics records To supervise the conduct of, and to establish eligibility standards for, regional and national athletics events under the auspices of this Association; To cooperate with other amateur athletics organizations in promoting and conducting national and international events; To legislate, through bylaws or by resolutions of a Convention, upon any subject of general concern to the members related to the administration of intercollegiate athletics; and To study in general all passed of competitive intercollegiate athletics and establish standards whereby the colleges and universities of the United States can maintain their athletics programs at a high level. 9 REPORTING NCAA RULES VIOLATIONS Procedures for Reporting an NCAA Rules Violation A. Reporting a Violation – Any individual (e.g., athletics department staff member, student-athlete, university employee, representative of the university’s athletics interest, members of the community) shall report an alleged, rumored or suspected violation. The individual may report the alleged, rumored or suspected violation verbally or in writing. B. To whom shall an Alleged, Rumored or suspected Violation be Rpeorted To- If an alleged, rumored or suspected violation is communicated to any athletic department staff member, is duty bound to notify the Office of NCAA Compliance in a timely manner. Individuals other than athletic department staff members may report an alleged violation to any or all of the following persons: Associate Athletics Director for NCAA Compliance Director of Athletics Sr. Associate Athletics Director or an Associate Athletics Director CEO or Faculty Athletics Representative Director of Student-Athlete Academic Services C. Conducting an Investigation of an Alleged Violation-the Associate Athletics Director for NCAA Compliance is responsible for conducting investigations. The Director of Athletics is responsible for overseeing institutional investigations. The Faculty Athletics Representative will be informed of all potential major violations and will receive notice of violations that are secondary in nature. Associate Athletics Director for NCAA Compliance or the Director of Athletics may request the assistance of the Faculty Athletics Representative to conduct or assist in the conduct of an investigation. Associate Athletics Director for NCAA Compliance shall maintain a written record of all alleged violations. The record shall consist of the following: 1. Date that the alleged violation was reported to Associate Athletics Director for NCAA Compliance and who reported the violation. 2. Detailed summary of the nature of the alleged violations, including the names of all persons involved. 3. Chronology of actions taken by the University in the investigation of the alleged violation. 4. Rational for concluding whether the allegations was or was not determined to be violation of NCAA legislation. 5. If a violation has occurred, Associate Athletics Director for NCAA Compliance will keep a file copy pf the report of the violation and subsequent correspondences with the NCAA and BSC staff. Copies of the self-report will be sent t the following: a. Faculty Athletics Representative b. Director of Athletics c. President & CEO d. SWA/Associate Athletics Director e. 10 D. The Director of Compliance will maintain the reports of alleged violations for a period of six years. Records and reports of confirmed violations will be maintained in the office’s permanent files. E. Finding a Violation Occurred- The Associate Athletic Director and Director of Compliance are responsible for determining that a violation occurred whenever the preponderance of the evidence considered as a whole establishes the occurrence of the violation. It shall be the responsibility of the Associate Athletic Director and Director of Compliance in assessing the evidence to determine what weight and credibility will be given to it. The Associate Athletics Director for NCAA Compliance may request the assistance of the Faculty Athletics Representative to conduct or assist in the conduct of an investigation into an alleged violation and/or assist in determining that a violation has occurred. 12 NCAA Compliance Committee The role of the NCAA Compliance Committee at Idaho State University is to monitor the affairs of intercollegiate athletics at the institution as it relates to athletic financial aid, student-athlete conduct, admissions procedures, and to verify that the monthly duties and tasks associated with NCAA Compliance are completed accurately and on time. An institutional administrator assigned by the university president serves as the chair of the committee. The committee includes members from departments across the university. The representatives of each of these departments plays an important role in giving input at the committee meetings as their duties are closely related to the monitoring and operation of the athletic department and the athletic compliance office. Opportunities exist within the committee for each member to give meaningful input into the formulation of athletics department policies. The committee reviews items to be completed from a compliance calendar which details the tasks to be completed in accordance with NCAA rules and bylaws. The calendar details the tasks to be completed on a monthly basis. The responsible individuals for the completion of these tasks are committee members and report progress and completion of their assigned tasks. A wide variety of issues are discussed within this committee, including student-athlete conduct, financial aid, academic progress, and the athletic department mission statement. Policies implemented by the Athletic Department are discussed and reviewed by the Compliance Committee. The committee discusses new policies and gives their input and suggestions for implementation and improvement. Updated 3/7/2012

15 Idaho State University Ethical Conduct Agreement Sport: As an employee or student-athlete at ISU and the athletics department, I understand that I am required to adhere to all ISU, NCAA and Big Sky Conference rules, policies and procedures. Per NCAA bylaw 10.1, I am also aware that unethical conduct by a prospective or enrolled student-athlete or a current or former institutional staff member may include but is not limited to: 1. Withholding information from the NCAA or the institutional compliance office or senior staff members, relevant to a violation of NCAA or Big Sky Conference regulations. 2. Refusal to furnish information relevant to an investigation of a possible violation of an NCAA regulation when requested to do so by the NCAA or the individual’s institution. 3. Knowing involvement in arranging for fraudulent academic credit or false transcripts for a prospective or enrolled student-athlete. 4. Knowing involvement in offering or providing a prospective or an enrolled student-athlete an improper inducement or extra benefit or improper financial aid. 5. Knowingly furnishing the NCAA or the individual’s institution false or misleading information concerning the individual’s involvement in or knowledge of matters relevant to a possible violation of an NCAA regulation. 6. Receipt of benefits by an institutional staff member for facilitating or arranging a meeting between student-athlete and an agent, financial advisor or representative of an agent or advisor (e.g., runner). 17 Big Sky Conference Sportsmanship Initiative 2011-2012 Code of Conduct Statement for Student-Athletes Sport: The Big Sky Conference Student-Athlete Advisory Committee (SAAC) believes the most important aspects of sport are good ethics and positive sportsmanship. The Conference has undertaken an initiative to enhance this philosophy. We need your commitment to make this effort a success. The SAAC believes that, in order for an institution to convey a message of good ethics and positive sportsmanship, it must have the involvement and the participation of those individuals most involved in athletics on campus. While this includes, but is not limited to, the President, athletic administrators, coaches and fans, the most important individuals are student-athletes. It is our behavior, more than any other that can shape the perception of our teams and institutions by the public, the media and our opponents. Good ethics and positive sportsmanship are philosophies that must be displayed both on and off the playing field. Good sportsmanship on the field enhances the student-athlete image off the field. Not only should student-athletes be good citizens, they should show a general concern for others. We must take a leadership role to compete at the highest levels, always endeavoring for victory, but doing so with grace, class, dignity and respect. Please join us in supporting the Conference’s Sportsmanship Initiative. Such an initiative will help make the Big Sky Conference one of the premier athletic conferences in the country. 18 FORM 10-3 Student-Athlete Anti-Hazing Agreement NCAA Bylaw 10 Purpose: To ensure student-athletes have been advised and educated on university and athletics department policies governing hazing and inappropriate behavior. Action: The compliance office will administer prior to the 1st practice or 1st day of school, which ever comes earlier. Administration Date: Prior to 1st practice each year. 19 Idaho State University Anti-Hazing Agreement Sport: Definitions per Idaho Statutes adopted as Idaho State University Policy Hazing is a violation of State Statute 18-917 of the Idaho Code and is understood as an activity which endangers the mental or physical health or safety of a student. Hazing typically involves acts of initiation, admission, affiliation, or conditions for continued membership in a group or organization. Such activities may include requiring feats of endurance, consumption of alcohol, acts of perversion, or subjection of individuals to road trips, kidnapping or being abandoned and left to find their way home. I understand that hazing is also a fundamental violation of human dignity, and that it is strictly prohibited at Idaho State University. The Athletic Department defines hazing as, “intentionally or recklessly subjecting any person to the risk of bodily harm, or severe emotional distress, or causing or encouraging any person to commit an act that would be a violation of law or university regulations, for the purpose of initiating, promoting, fostering, or confirming any form of affiliation with a student group or organization, as defined by the ISU Student Code of Conduct. The expressed or implied consent of the victim will not be a defense.” I understand that if I know that another person is the victim of hazing as defined above and is at the scene of such activity shall, to the extent that I can do so without danger or peril to myself or others, report such activity to an appropriate law enforcement or university official as soon as reasonable practicable. If I fail to report, I may be subjected to university sanctions and or athletics department sanctions including but not limited to expulsion, reduction or cancellation of aid, indefinite or temporary suspension. I also understand that if I, or my team is found responsible for hazing which in any way jeopardizes the health and safety of other individuals in connection with any school or social activity related to the school, the team or myself shall be suspended indefinitely until information yields facts to the contrary. 21 Gambling & Wagering (1) In accordance with NCAA Bylaw 10, sports wagering includes placing, accepting or soliciting a wager (on a staff member's or student-athlete's own behalf or on the behalf of others) of any type with any individual or organization on any intercollegiate, amateur or professional team or contest. Examples of sports wagering include, but are not limited to, the use of a bookmaker or parlay card; Internet sports wagering; auctions in which bids are placed on teams, individuals or contests; and pools or fantasy leagues in which an entry fee is required and there is an opportunity to win a prize. It should also be noted that a "wager" is any agreement in which an individual or entity agrees to give up an item of value (e.g., cash, shirt, dinner) in exchange for the possibility of gaining another item of value. The following individuals at ISU shall not knowingly participate in sports wagering activities or provide information to individuals involved in or associated with any type of sports wagering activities concerning intercollegiate, amateur or professional athletics competition: (a)ISU Staff members in the athletics department; (b) Non-athletic department staff members who have responsibilities within or over the athletics department (e.g., chancellor or president, Faculty Athletics Representative, individual to whom athletics reports; (c) also included in this policy are Big Sky Conference staff members and (d) all ISU student-athletes. (2) The prohibition against sports wagering applies to any institutional practice or any competition (intercollegiate, amateur or professional) in a sport in which the Association conducts championship competition, in bowl subdivision football and in emerging sports for women. The provisions of Bylaw 10.3 are not applicable to traditional wagers between institutions (e.g., traditional rivalry) or in conjunction with particular contests (e.g., bowl games). Items wagered must be representative of the involved institutions or the states in which they are located. (3) The following sanctions for violations of Bylaw 10.3 shall apply: (a) A student-athlete who engages in activities designed to influence the outcome of an intercollegiate contest or in an effort to affect winloss margins ("point shaving") or who participates in any sports wagering activity involving the studentathlete's institution shall permanently lose all remaining regular-season and postseason eligibility in all sports. (b) A student-athlete who participates in any sports wagering activity through the Internet, a bookmaker or a parlay card shall be ineligible for all regular-season and postseason competition for a minimum of a period of one year from the date of the institution's determination that a violation occurred and shall be charged with the loss of a minimum of one season of eligibility. If the studentathlete is determined to have been involved in a later violation of any portion of Bylaw 10.3, the studentathlete shall permanently lose all remaining regular-season and postseason eligibility in all sports.
