DocuSign Envelope ID: FA104EED-64A1-4CF2-B0B2-5E3A1F83C1EF TFC Contract No. 20-098-000 Veliz Company, LLC, dba Veliz Construction Amendment No. 4 Project No. 20-001-5160 RFQ No. 303-0-01718 P O No. 303-0-7035 AMENDMENT NO. 4 TO CONSTRUCTION MANAGER-AT-RISK CONTRACT BETWEEN THE TEXAS FACILITIES COMMISSION AND VELIZ COMPANY, LLC, DBA VELIZ CONSTRUCTION This Amendment No. 4 to the Construction Manager-at-Risk Contract (hereinafter referred to as “Amendment No. 4”) is entered into by and between the Texas Facilities Commission (hereinafter referred to as “TFC”), as Owner (as defined in 2015 UGC Section 1.28) and Veliz Company, LLC, dba Veliz Construction, (hereinafter referred to as “Construction Manager-atRisk,” or “CMR”) (hereinafter referred to collectively as the “Parties”), to the mutual benefit of the Parties and for the purposes set forth herein. Recitals. WHEREAS, on September 10, 2020, the Parties entered into that one certain Construction Manager-at-Risk Contract Between the Texas Facilities Commission and Veliz Company, LLC dba Veliz Construction TFC Contract No. 20-098-000; and WHEREAS, the Parties subsequently entered into Amendments numbered 1 through 3, inclusive, for the purposes set forth in those amendments; and WHEREAS the Parties now desire to enter into this Amendment No. 4 for Additional Services and fees and compensation; NOW, THEREFORE, the Parties agree to amend the Contract as follows: 1. Unless clearly provided otherwise herein, all terms and phrases in initial caps herein shall have the same meaning as the terms and phrases with initial caps in the Contract. 2. Article II, Scope of Services, Section 2.1, Scope of Services, is amended to include Additional Services including, but not limited to, recondition of existing concrete and terrazzo flooring from the 2nd to the 10th floors and any ancillary scope of related work to the Thompson Building Deferred Maintenance Renovations (THO) Building, as more specifically described in Exhibit A-3 Contractor’s Proposal dated January 17, 23, attached hereto and incorporated herein for all purposes. 3. Article IV, Consideration, Section 4.2, Contract-Sum Components, is amended to include additional funding in the amount of 9,998.35. Therefore, Section 4.2 is deleted in its entirety and replaced with Section 4.2, as follows. Page 1 of 3

Contract Sum–Components. Upon execution of a GMP Acceptance, the Contract Sum shall not exceed 1,886,655.39, which is the sum of the following components. 4.2.1. Pre-Construction Management Fee. The Pre-Construction Management Fee which, at Contract execution, shall not exceed the sum of 5,832.00. 4.2.2. Construction Management Fee. The Construction Management Fee not to exceed 3.05% of the Cost of Work, which sum will be finalized as part of the Contract Sum in the GMP Acceptance and shall, at time of execution, not exceed 42,029.68. 4.2.3. General Conditions Fee. The General Conditions Fee not to exceed 261,689.25, which sum will be finalized as part of the Contract Sum in the GMP Acceptance. 4.2.4. Cost of Work. The Cost of Work will be adjusted and finalized as part of the Contract Sum in the GMP. The budget for the Cost of Work shall not exceed 1,397,329.50. 4.2.5. TFC Controlled Contingency. The TFC Controlled Contingency of 179,774.96, which sum shall be maintained through construction, and included in the Contract Sum and finalized in the GMP Acceptance. 4.2.6. Unused Contingencies. Any unused portion of the CMR Contingency and the TFC Controlled Contingency shall be returned to TFC at the completion of the Project through a credit Change Order to the Contract Sum. 4. Article X, Records, audit, proprietary information, and public disclosure, Section 10.4 Confidentiality Provisions Applicable to CMR, is amended to include additional information. 10.4.2.8. Architectural and engineering drawings and specifications in any format including, but not limited to, CAD files, building information management and modeling (BIM) systems and technological system plans (e.g., information technology systems, security systems, fire controls and building automated systems).
