Notice Inviting Request for Proposal RFP Document No: C-1713/2016/ADCP/SN Request for Proposal for supply, delivery, installation and warranty support of Laptop, Desktop Computers with UPS, MFP Printers and Colour Printer for ADCP, Department of Animal Husbandry, Government of Kerala The Project Coordinator, ADCP, Department of Animal Husbandry, Government of Kerala invites RFP for procurement of Laptop, Desktop Computers with UPS, MFP Printers and Colour Printer through the e-procurement system of the Government of Kerala, as per details given below: Sl No 1 Name of Work Request for Proposal for supply, delivery, installation and warranty support of Laptop, Desktop Computers with UPS, MFP Printers and Colour Printer for ADCP, Department of Animal Husbandry, Government of Kerala for use in all district units and Project management unit of ADCP of Department of Animal Husbandry, Government of Kerala 1. RFP shall be accompanied with Earnest Money (EMD) of Rs.7,000 (Rupees Seven thousand only) & a tender fee of Rs.1470/- (Rupees One Thousand Four hundred and seventy only) deposited through the e-payment system in the e-procurement portal of the Government of Kerala, https://www.etenders.kerala.gov.in. The Bank Guarantee/Demand Draft shall be issued by any Nationalized Bank for an amount equivalent to 10% of the total estimated cost of the current project. Suppliers registered in store purchase shall be exempted from EMD. A bid will not be considered, if not accompanied with EMD & tender fee. 3. Application for this RFP supported by prescribed annexure shall be submitted through the e-procurement portal of the Government of Kerala. The bid applications will be received till 18 hours on 03/04/2017. 4. The bidders are advised to keep visiting the website https://www.etenders.kerala.gov.in from time to time (till the deadline for bid submission) for any updates in respect of the RFP document notice, if any. Failure to do so shall not absolve the applicant of his liabilities to submit the RFP document complete in all respect including updates thereof, if any. An incomplete application may be liable for rejection. 5. The Project Coordinator, ADCP, Department of Animal Husbandry, Government of Kerala reserves the right to verify the particulars furnished by the bidder independently. If any information furnished by the bidder is found incorrect at a later stage, he shall be debarred from tendering and taking up of any work in the Department of Animal Husbandry, Government of Kerala. 6. The Project Coordinator, ADCP, Department of Animal Husbandry, Government of Kerala reserves the right to reject any or all prospective applicants without assigning any reason and to restrict the list of pre-qualified firms to any number deemed suitable. 3. Background information & Scope of Work of the project Introduction: Department of Animal Husbandry is planning to strengthen its e-Governance in all district units and Project management unit of ADCP of the department. As part of this, Department is planning to purchase Laptop, Desktop Computers with UPS, MFP Printers and Colour Printer in the various offices of Department of Animal Husbandry. The successful Bidder(s) shall provide the following items and services: Supply, Delivery and installation of Laptop, Desktop Computers with UPS, MFP Printers and Colour Printer: The items to be supplied under this RFP are given in this section below. a. The bidder has to supply OEM packed boxes of Laptop, Desktop, Printers and UPS (including five year comprehensive onsite warranty ) to office of the Project Coordinator, ADCP, Department of Animal Husbandry, Government of Kerala. b. Supply and installation of the designated quantity, as per the technical specification (As given in Appendix E) and quality to be effected as per delivery schedule given below: TDate of receipt of supply order. This is not required to include in the Bill of materials and won’t be considered for L1 calculation. After sales service: 1. The Supplier will open or authorize a service centre in each district in “Kerala” for the maintenance/comprehensive warranty of Laptops, Desktops and Printers under this RFP. Similarly, the Supplier of Laptops shall keep at least 2% equipments as spare, to provide immediate replacement, with the service centre during the warranty period. It will be desirable that minor functional problems of these equipments are taken care of by the service centre only. In case of major& specific problems, respective vendors will have to rectify the defect within the time-limits prescribed in the RFP document; others must have to replace with the new one. In case the Bidder has no presence in above mentioned Page 7 of 40

locations, he/she may furnish an undertaking for establishing the same within 30 days from the awarding of Contract. 2. The Bidder will deploy Online Monitoring Tool (OMT) and provide access to the Department by T 30. As soon as the user lodges a compliant at service centre, a system generated ticket no has to be communicated to the user via SMS/Mail. After the complaint resolution, the status has to be communicated to the user via SMS/Mail. 3. Bidder has to maintain a monthly report of the complaint lodging. The complaint resolution report with the SLA compliance details needs to be submitted by bidder to the Project Coordinator, ADCP on a monthly basis as per the dates agreed with the Department. Bidder has to provide access of OMT to the Project Coordinator, ADCP. 4. Department will authorize a person for acceptance of delivery of Laptop, Desktop, Printers and UPS . Date of distribution of Laptop, Desktop, Printers and UPS will be communicated to the supplier and to the end users well in advance. On the communicated date supplier will install OS and integrate with other accessories need by the department, ensure that the system is working fine and take sign off from the end user in presence of the designated person. Supplier will prepare a “Sign-off Report” and submit it to the department. Note: Bidders qualified for technical evaluation have to submit sample pieces to office of the Project Coordinator, ADCP, Department of Animal Husbandry, Government of Kerala for technical evaluation which can be returned after bidder selection. 4. INSTRUCTIONS TO BIDDERS FOR SUBMISSION OF PROPOSAL General Instructions Project Coordinator, ADCP, Department of Animal Husbandry intends to appoint a single supplier for the assignment, so as to complete the project within the stipulated time, as detailed earlier in this document, after the issue of the work order. However, Project Coordinator, ADCP shall increase or decrease the scope of services under the assignment as mutually agreed between the parties concerned Project Coordinator, ADCP, Department of Animal Husbandry intends to adopt a two cover bidding process (Prequalification cum Technical Cover & Financial Cover) for selection of eligible bidders for the assignment, as per the Scope of Work set out in the previous section of this RFP document. The proposals received from eligible bidders shall be evaluated on the basis of the criteria set out in this RFP document. The bidder shall be responsible and pay for all of the costs associated with the preparation of its proposal and its participation in the bidding process The Successful Bidder is required to enter into an agreement with Project Coordinator, ADCP, Department of Animal Husbandry. The charges payable to the successful bidder by Department of Animal Husbandry shall be in the manner as set out in the said agreement The period of engagement of the successful bidder will be from the date of the work order for supply & installation of the Laptop, Desktop, Printers and UPS as per the delivery schedule mentioned earlier in the document, and also including the warranty period. Any extension beyond this should be mutually agreed to between the successful bidder & Project Coordinator, ADCP with adequate modifications in the pattern of payment disbursal, at the appropriate time. The proposal submitted by the bidder shall remain valid for a period not less than 180 days from the Proposal Due Date (Proposal Validity Period). Project Coordinator, ADCP, reserves the right to reject any proposal, which does not meet this requirement. The proposal validity period may further be extended on mutual consent. Project Coordinator, ADCP, Department of Animal Husbandry reserves the right to change Page 8 of 40

the quantity before placing the order. PRE-QUALIFICATION CRITERIA (a) (b) (c) (c) (d) (e) (f) (g) (h) (i) (j) (k) The bidder should be a Company registered, under Indian Companies Act 1956 or partnership, proprietary firm.(Proof of same should be provided in the “Pre-Qualification Cover” of the bid) The bidders should be an OEM/Authorised Distributor/System Integrator with minimum three years of experience in bulk supply, installation &delivery of Laptop, Desktop, Printers and UPS in India. The bidder/OEM should have executed a minimum of three orders with order quantity of at least 500 Laptop, Desktop, Printers in the last three years in India. (Copy of minimum three relevant Work/ Purchase Order & order completion certificate from the respective Head of the institution to be submitted in the “Prequalification Cover” of the bid) Scan copies of the valid Registration of the Firm, License No., PAN No. of the firm to be attached in the “Prequalification Cover” of the bid The bidder or his authorised representative, with proof for authorisation from the bidder, should already have a fully operational office that is capable of providing after sales support in Kerala that should function in the duration of the contract which will originate out of this RFP (Details to be submitted in the Prequalification cover of the bid). The bidder/OEM should have minimum ISO 9001:2008,ISO 14001:2004 / ISO 14001:2015 certifications.(Proof to be submitted in the “Prequalification Cover” of the bid) The bidder should not have been blacklisted by any Government department, organization, entity, etc. (An undertaking by the authorised signatory to be submitted to this effect by the Bidder in the “Prequalification Cover” of the bid) The bidder should have in place an effective mechanism to address & redress the various after sales service issues on 24 x 7 basis (Bidder to submit an undertaking that they have capability to offer 24*7 support. Details of the support mechanism to be given in the Prequalification cover of the Bid) The bidder should furnish its standing & goodwill through customer satisfaction certificates from its clients to whom services have been provided in the past (Minimum 3 such client certificates on successful project completion & satisfaction should be submitted along with the Prequalification cover) The Company should have a turnover minimum of Rs.5 crores in each year or Rs.12 crores cumulative for the last three financial years (Copy of the audited financial statement should be submitted as proof in the Prequalification cover of the bid). If the bidder is not an OEM, the bidder should also attach a “Manufacturer’s Authorisation Form” as per Form-C in the Prequalification Cover of the RFP. Project Coordinator, ADCP, Department of Animal Husbandry reserves the right to carry the capability assessment of the bids and the department’s decision shall be final in this regard. EARNEST MONEY DEPOSIT (EMD) & TENDER FEE (a) (b) (c) Bidders shall remit along with their Bids, Earnest Money (EMD) of Rs.7, 000 (Rupees Seven thousand only) & a tender fee of Rs.1470/- (Rupees One Thousand Four hundred and seventy only) through the e-Tender portal of the Government of Kerala (As per Government rules).Supporting documents shall be submitted by the companies. EMD of all unsuccessful bidders would be refunded. The EMD amount of the successful bidder would be returned upon submission of Performance Bank Guarantee/Demand Draft as per the format provided in “Form A” and execution of agreement The EMD amount is interest free and will be refundable to the unsuccessful bidders without interest, whereas the Tender Fee is non-refundable Page 9 of 40

(d) (e) The bid/proposal submitted without EMD & Tender Fee mentioned above, will be summarily rejected The EMD may be forfeited: i. If a bidder withdraws its bid during the period of bid validity. ii. In case of a successful bidder, if the bidder fails to sign the contract or fails to submit the Performance Bank Guarantee in accordance with this RFP CLARIFICATIONS & AMENDMENTS TO RFP DOCUMENTS: Bidders may request a clarification of any of the issues related to the RFP document up to the prebid meeting date indicated in the Data Sheet. Any request for clarification must be sent in writing/by e-mail to the address indicated in the Data Sheet prior to the pre-bid meeting. The responses of the Project Coordinator, ADCP, Department of Animal Husbandry will be uploaded in the website https://etenders.kerala.gov.in, without identifying the source of inquiry. At any time before the proposal closing date, the Project Coordinator, ADCP, Department of Animal Husbandry may, whether at his own initiative, or in response to a clarification requested by a firm, amend the RFP by issuing an amendment. The amendment shall be uploaded in the website https://etenders.kerala.gov.in only. Such amendments shall be binding on all the bidders. To give bidders reasonable time to take an amendment into account in their proposals, Project Coordinator, ADCP, Department of Animal Husbandry may at his discretion, if the amendment is substantial, extend the deadline for the RFP submission by uploading a notice. In case there is a substantial change in RFP, Project Coordinator, ADCP, Department of Animal Husbandry will publish the revised RFP. Revised RFP will also be uploaded in the website https://etenders.kerala.gov.in only and the same should be submitted by the bidder. As such, the bidders are advised to closely follow the aforementioned website, for probable developments with regard to RFP. PERFORMANCE GUARANTEE The selected bidder shall furnish within 20 days of the date of issue of Work Order, an unconditional Bank Guarantee/Demand Draft. The Bank Guarantee/Demand Draft shall be issued by any Nationalized Bank for an amount equivalent to 5% of the total cost quoted by the successful bidder for the current procurement. The Performance Guarantee shall remain valid for a period of four months beyond the scheduled date of completion of services. The performance guarantee shall be submitted as per Performa at Form – A. The Performance Bank Guarantee may be forfeited if successful bidder fails and/ or does not withstand to the agreement and SLA terms. CONTRACT AGREEMENT The selected bidder shall enter into and execute the Service Agreement and SLA with the Project Coordinator, ADCP, Department of Animal Husbandry, Government of Kerala. The Contract Agreement shall include the RFP document; copy of the Demand Draft /Bank Guarantee for Performance Security; the minutes of the Pre-Bid meeting if any, all letters/communication exchanged between the successful bidder & the Project Coordinator, ADCP, before the date of execution of the Contract, Scope of Work, Contract Fee, Payment Schedule, Project Time Schedule, and other clauses like Indemnity Clause, Provisions for Modification of Contract; Termination of Contract; Confidentiality; Obligations and Liability of the Parties; Settlement of Disputes; Liquidated Damages; Representations, Warranties and Disclaimer; Force Majeure; Severability; Survival Clauses etc. The Contract will be executed within 7 days from the date of issue of Work Order. If the successful bidder fails to execute the contract within the specified time-lines specified for any reason whatsoever, the successful bidder will be liable to compensate the Project Coordinator, ADCP, with liquidated damages equivalent to 10% of the total estimated fee of the current assignment payable under the present agreement. It is hereby clarified that the Work Order shall be issued only after all mandatory clearance at the Government of Kerala level and penalty shall be applicable only in case of delay solely due to the actions of the successful bidder. RIGHT OF REJECTION Project Coordinator, ADCP, Department of Animal Husbandry reserves the right to reject any proposal that does not address all the requirements of the RFP. In addition, the Project Coordinator, ADCP, Department of Animal Husbandry reserves the right to accept or reject any proposal submitted by the bidders, and to cancel the RFP process and reject all proposal submissions at any time, without thereby incurring any liability to the affected bidder/bidders or any obligation to inform the affected bidder the grounds for his action. DISQUALIFICATION The Evaluation/Selection Committee may disqualify bids on account of but not limited to the following reasons: i) If the bidder disregards any of the terms & conditions of the bid and/or leaves any ambiguity in calculation of the rates quoted ii) If the participant attempts to influence any member of the selection committee iii) Conditional bids The decision of the selection committee (constituted for the purpose) in the matter of disqualification shall be final and binding on the firms. TERMINATION OF BID i) Against all expectations entertained by the Project Coordinator, ADCP, Department of Animal Husbandry if none of the participating firms could be declared by the selection committee as the winner of the bid, the bidding will be regarded as terminated ii) Project Coordinator, ADCP, Department of Animal Husbandry reserves right to accept or reject only / all bidders including the lowest bidder without assigning any reason(s) whatsoever. SETTLEMENT OF DISPUTES The decision of the Tender Committee appointed by the Project Coordinator, ADCP, Department of Animal Husbandry shall be final & binding on participating firms. In the event of any grievance, the aggrieved party may make a representation before the Director, Directorate of Animal Husbandry, Government of Kerala, within 3 working days of the announcement of the successful bidder. The Director, Directorate of Animal Husbandry, Government of Kerala, will decide upon the issue raised by said aggrieved party and will give his finding in writing on receipt of said representation. The findings of the Director, Directorate of Animal Husbandry, Government of Kerala will be final and binding upon the aggrieved party. Any disputes arising out of the contractual agreement shall be subjected to the courts in the jurisdiction of Thiruvananthapuram District. ADDITIONAL INFORMATION The Project Coordinator, ADCP, Department of Animal Husbandry, reserves the right to: i) Postpone and/or extend the date of receipt of or to withdraw the bidding notice without Page 11 of 40

assigning any reason thereof, entirely at his discretion. In such an event, the bidders shall not be entitled to any compensation in any form, whatsoever ii) Reject or accept proposals; and iii) Cancel the bidding process and reject all or any of the proposals and will not be bound to accept lowest or any proposal or to give any reasons for the decision in the consultation with the Selection Committee iv) This document is non - transferable 5. PREPARATION & SUBMISSION OF PROPOSAL General i) ii) iii) (iii) (iv) (v) (vi) (vii) (viii) (ix) The bidders must read the RFP document carefully and submit their bids in strict conformity with the requirements as given in the document, through the e-procurement portal of the Government of Kerala. The proposal and related correspondence and documents shall be written in English language The bidders must submit an undertaking to the effect that they have read, understood and agree to abide by the terms & conditions of this RFP. Failure to submit this undertaking will be treated as non – compliance of the terms and as such bids will not be considered for evaluation Sub-contracting of the work in full or in part is not allowed as per this RFP.
